Palin , Director of Development Service SUBJECT: REPORT FROM PLANNING COMMISSION ON ZONE CHANGE NO . 84-3A At the meet:-ng of June 19 , 1984 staff advised the Commisnion of the action taken by the City Council in regard to the subject zone ,change request at your meeting of June 18 , 1984 . At that time , the Council approved for adoption R3-20 zoning for only Lots 3-10 and 36-43 along Koledo Lane within the Oakview Redevelopment Area. The remainder of the properties within the zone change area lore to be reviewed kj,, the Planning Commission. Due to the lateness of the hour it was not possible for the Commission to review and discuss a possibly treatment for the remainder of the properties originally included in the zone change . Staff has been directed to return the matter to the. Planning Commission for its July 10 , 1984 meeting , and a report will be forthcoming to the City Council after that rteview. CWT:JWP :HS :Jf r' t ORDINANCE No. 2707 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH ANENDYNG THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING FROM MEDIUM HIGH DENSITY RESIDENTIAL DISTRICT TO MEDIUM HIGH DENSITY RESIDENTIAL DISTRICT (TWENTY UNITS PER ACRE) ON REAL PROPERTY GENERALLY LOCATED ON KOLEDO LAVE NORTH OF SLATER AVENUE (ZONE CASE No . 84-.3-A) WHEREAS, pursuant to the state Planning and Zoning Law, the Hultl�ington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Case No . 84-3-A wherein bot'-, bodies have carefully considered all information presented at said hearings , and after due considers-- tion of the findings and recornnflendations of the Planning Commission and all evidence presented to said City Council , the City Council finds that such zone change is proper, and consistent with the general plan, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: SECTION 1. Palin, Director, Development Services Subject: ZONE CHANGE NO. 84-3A Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions, Aunchments: STATE MENT OF ISSUE: Transmitted for your consideration is Zone Change No. 84- 3h, a request to rezone approximately 37. 6 acres of property from R3 (Medium High Density Residential) to R3-20 (Medium High Density Residential, 20 units per acre) . The property is located within the Oakview Redevelopment Area north of Slater Avenue and west of Beach Boulevard. This zone change request was processed through the Planning Commission as Zone Change 84-3 , but has since been redesignated as Zone Change 84-3A due to a case number conflict with another zone change ordinance. RECOMMENDATION : Staff Recommendation: Staff recommends that the City Council approve Zone Change No. 89 -3A from R3 to R3-20 by adoption of the attached ordinance. Planning Commission Recommendation: The Planning . CommisiE�ion recommends that the City Council approve Zone Change No. 84-3A with an amendment to the attached ordinance to specify R3-16 zoning with a maximum allowance of up to 20 units per acre with a density bonus . ANALYSIS: Applicant : City of Huntington Beach Location: North of Slater. Avenue, east of Nichols Street and Oakview. School, south of a parallel line 145 feet north of Mandrel). Planning Commission Action on February 7 , 1984 : ON MC(fION BY LIVENGOOD AND SECOND BY SCHU MACHER ZONE CHANGE NO. 84-3 WAS APPROVED WIT14 R3-161 MAXIMUM ALLOWANCE OF UP TO 20 UNITS PER ACRE WITH DENSITY BONUS, AND R�:CO.4KENDED TO THE CITY COUNC11i FOR ADOPTION BY THE FOLLOWING VOTE : AYES: Wirchell, Livengood, Porter, Schumacher , Mirjahangir NOES: None ABSENT: Higgins, L r skive ABSTAIN : None Finding for Approval : 1. Rezoning of the property from R3 to R3-20 is consistent with the City' s adopted Land Use Element of the General Plan which designates the area as Medium High Density Residential. Discussion: On November 28 , 1983 , the City Council approved a General Plan Land Use Element Amendment changing the land use designation in the Oakview Area from Medium Density Residential to Medium High Dei?s.i ty Residential. The amendment was intended to bring the Ger._:ral Plan designation into consistency with the existing R3 zoning and to permit the development of the proposed Koledo Lane impirovement Project within the Oakview Redevelopment Area. The Couitail was concerned , however, that the amendment would permit higher densities to occur in the Oakview Area than presently exist. Because of this concern, LUE 83 -3 was approved on the � condition that a zone change limiting densities to 20 units per acre (R3-20) be initiated for the Oakview Area. Zone Change No. 84-3A has been prepared in response to that direction. R3 zoning , when utilized in conjunction with a General Plan designation of Medium High Density Residential, will permit a density of 23 units per acre. The Oakview Area, which has both R3 zoning and a General Plan desig;iaL on of Medium High Density Residential, is presently developed to an overall density of 16 units per acre. The proposed Koledo Lane project is proposing additional units and rehabilitation of existing units ano will I have a density of 20 units per acre . The proposed zone change to 73-20 will permit the Koledo Inane project to be completed and will limit densities in the remainder of the Oakview Area to 2*1-1 units per acre. The Planning Commission, however, in its review of the zone -ch nge request was concerned about permitting . the density that R3-20 zoninq would allow. They felt. that densities of 25 units per acre -2- 6--5-84 - R-A could result if density bonuses were requested . The Planning Commission eherefore recommended that the zone change ordinance be amended to specify R3-16 zoning with a maximim allowance of up to 20 units per acre with a density bonus . Staff does not concur with the Planning Commission ' s recommendation. The existing overall density in the Oakview AL'ea, at 18 un..ts ner acre , already exceeds the Planning Commission' s proposed R3-16 zoning . Further , the City has not solicited or receiv �d affordability commitments From the Kuledo Lane property owners For the improvement project- which will be developed at 20 units per acre. Secretary Palin stated that the proposed zone change would bring the area into consistency. The public hearing was opened . Lengthy discussion took place regarding the possibility of developers requesting density bonuses in this area . Secretary Palin stated that there was nothing in the proposed ordinance to prevent that , however, he explained that the Commission did not have to grant these requests that deviate from the code . The City Clerk informed the Council that the Resolutions calling the election, citir.g the measures end requesting the names of Councilmembers wishing to write the arguments were in the City Attorney's Office. COMMENTS RE ALBERTSON'S MARKET NOISE PROBLEM Councilman MacAllister expressed his concern regarding the Albertson Market located at Yorktown Avenue and Brookhurst Street and stated that he hoped the problem could be resolved. COMlE= KF PARKING PROBLEM - COASTLINE COMMUNITY COLLEGE STUDENTS -- PETERSON SCHOOL - STAFe TO INVESTIGATE Councilman MacAllister stated his concern regarding the parking problem created by Coastline Community College students at the Peterson School facility. The City Administrator stated he would direct staff to review the problem. PERMIT PROCESS FOR Cut"1 ITY SERVICES GROUPS Councilman MacAllister expressed his concern regarding protlems encountered by Community Services groups in obtaining permits to hold events in the city. The City Administrator stated that the permit procedure had been revamped whereby groups will be able to conduct all business related to obtaining permits in one city depar�.ment . The City Administrator stated that controls would exercised on the vendors. MOBILEHOME PARK RESIDENT RELOCATION Councilman Mandic expressed his concern regarding relocation of mobilehome park residents necessitated by redevelopment. He wanted to know what funding remained in relocation accounts. The Redevelopment Coordinator stated that $400,000 had been allocated for general relocation. He stated that in a typical obligation the amount for relocation would come to approximately $200,000 for Huntington Shores Mobilehome Park. Councilman Mandic requested staff to look more closely at the problems of the. Huntington Shores group, possibly with two councilmembers attending the meeting. The City Administrator stated that work was progressing regarding the mushroom farm project for this p+irpose and information regarding the project would be presented to Council at the July 2 , 1984 meeting.' The City Attorney stated that Ordinance No. 2699 relating t:) standards for relocation assi3tance for mobilehome owners did apply to Huntington Shores Mobilehome Park residents.
