Services (✓ "p Subject: ZONE CHANGE NO. 84 -4 Statement of Issue, Recommendation, Analysis, Funding Source, Alternative actions, Attachments: STATEMENT OF ISSUE : Transmitted for your consideration is Zone Change No. 84-4 , a request by Great Western Savings to rezone approximately . 26 acres of property from R3 (Medium High Density Residential) to C4 (Highway Commercial) . The subject property is located on the north side of StarK Avenue , approximately 130 Feet west of Beach Boulevard and is intended to be used as a parking lot for the Great Western Savings to be reconstructed on adjoining property zoned C4. RECOMMENDATION Planning Commission Action and Recommendation: The Planning Commission held a public hearing on the zone change request •wn May 1, 1984 . ON BY WINCHELL AND SECOND BY LIVFNGOOD ZONE CHANGE NO . 84-4 NA+'- : .ePROVED AND RECOMMENDED TO THE CITY COUNCLL FOR ADOPTION WITH THE FOLLC*IING FINDitiG , BY T11E FOLLOWING VOTE: AYES: Higgins, Winc hell, Livengood , Porter , Mirjahangir NOES: None ABSENT: Erskine , Schumacher ABSTAIN : None Staff Recommendation : Staff recommends that the City Council adopt Zone Change No. 84-41 changing the zoning designation on the subject property from R3 (Medium High Densitv Residentialt to C4 (Highway Commercial) . ANALYSIS i The subject: property was the object of Use Permit No. 83-69/Corelftional Use Permit No. 84-3 , both of which were approved Pic 4/81 by the planning Commission on February 22, 1984 . The Use Permit waf. to allow construction of an ll, 500 square foot financial building in a C4 zone, and the Conditional Use Permit was to permit a pa6:ing lot for the project in an R3 zone. Among the conditions of approval for both the Use Permit and the Conditional Use Permit was the requirement that the applicant file for a zone change (with lot consolidation, if appropriate) from R3 to C4 at the tune of taking out building permits and prior to the issnAnce of a certificate of occupancy. Zone Change No. 84-4 is in response to that condition. Staff research has indicated that the seven lots on which the project is located were recorded into one parcel (Parcel Map 25-44) on November 10 , 1969. As such, no lot consolidation is necessary at this time . The R3 zoned pc:_tion of the property has been used as a parking lot since the original consolidation of lots in 1969 . There have been no complaints registered with the Ci;v during that period of time. The recently approved Use Permit and Condit.:,onal Use Permit both restrict use of the R3 zoned portion of the property to continued use as a parking lot . Even though the General Plan designation on the subject property is High Density Residential, the zone change to C4 i3 permissible under the City ' s General Plan. Section 3 . 4. 3 . 2 of the General Plan states that inconsistencies between zoning and general plan designation are permitted if the area is less than one acre. The subject property is . 26 acres. Staff foresees no proble:^s related to general plan consistency or land use compatibility if the parking lot is rezoned from R3 to C4 . ENVIRONMENTAL STATUS : Pursuant to Section 15150 of the California Environmental Quality Pict guidelines , the proposed project is categorically ei.empt. FUNDING SOURCE: No funds required. ALTERNATIVE ACTION : The City Council may deny Zone Change No. 84-4 and allow the subject property to be used as a parking with the existing R3 zoning as permitted by Conditional Use Permit. The proposed subdivision for purposes of splitting one lat into two lots is consistent with the City ' s General Plan. The property was studied and approved for this intensity of land use and for this type of residential structure at the time the R2, Medium Density Residential. designation was placed on the property . SUGGESTED CONDITIONS OF APPROVAL : 1. The tentative parcel map received by the Department of j Development Services on March 23 , 1984 , shall be the approved layout. 2. A parcel map shall be filed with the City and approved by the Departments of Development Services and Public Works and recorded with the County of Orange. A copy of the recorded map shall be filed with the Departaients of Development Services and Public Works. 3 . At the time of new construction of dwelling units on the subject property , a common driveway shall be installed to Service both developments. 4 . Grading and street improvement plans shall be provided to City standards at the tiwe the parcel is developed. 5 . Water supply shall be throuqh the City of Huntington beach water system at the time said par,:els are developed. 6 . Sewage disposal shall be through the City of Huntington Beach sewage system at the time said parcels are developed. All, utilities shall installed at the time said parcels are developed . The subject property is located on the north side of Stark Avenue , approximately 150 feet west of Beach Boulevard and is intended to be used as a parking lot for the Great Western Savings to be reconstructed on adjoining property zoned C4. RECOMMENDATION Planning Commission Action and Recommendation: The Planning Commission held a public hearing on the zone change request on May 1, 1984 . ON MOTION BY WINCHELL AND SECOND BY LIVENGOOD ZONE CHANGE NO. 84-4 WAS APPROVED AND RECOMMENDED TO THE CITY COUNCIL FOR ADOPTION WITH THE FOLLOWING FINDING , BY THE FOLLOWING VOTE : AYES: Higgins, Winchell, Livengood, Porter , Mirjahangir NOES:. . None ABSENT: Erskine, Schumacher ABSTAIN : None Staff Recommendation : Staff recommends that the City Council adopt Zone Change No. 84-4 , .changing the zoning designation on the subject property from R3 (Medium High Density Residential) to C4 (Highway Commercial) . ANALYSIS: The subject property was the object of Use Permit No. 83-69/Condi.tional Use Permit No. 84-3 , both of which were approved Q+i Flo 081 by the Planning Commission on February 22 , 1984 . The Use Permit was to allow construction of an 11, 500 square foot financial building in a C4 zone, and the Conditional Use Permit was to permit a parking lot For the project in an R3 zone . Among the conditions of approval for both the Use Permit and the Conditional Use Permit was the requirement that the applicant file for a zone change (with lot consolidation, if appropriate) from R3 to C4 at the time of taking out building permits and prior to the issuance of a certificate of occupancy . Zone Change No. 64- 4 is in response to that condition. Staff research has indicated that the seven lots on which the proji!et is located were recorded into one parcel (Parcel Map 25-44) on November 10 , 1969. As such, no lot consolidation is necessary at this time . The R3 zoned portion of the property has been used as a parking lot since the original consolidation of lots in 1969 . There have been no complaints registered ,with the City during that period of time . The recently approved Use Permit and Conditional Use Permit broth restrict use of the R3 zoned portion of the property to continued use as a parking lot. Even though the General Plan designation on the subject property is High Density Residential, the zone change to C4 is permissible under the City ' s General Plan. Section 3 . 4. 3. 2 of the General Plan states that inconsistencies between zoning and .general plan designation are permitted if the area is less than one acre. The subject property is . 26 acres. Staff foresees no problems related to general plan consistency or land use compatibility if the parking lot is rezoned from R3 to C4 . ENVIRONMENTAL STATUS: Pursuant to Section 15150 of the Callfornia Ynvironmental Quality Act gu-idelines, the proposed project is categorically exempt. FUNDING SOURCE : No f undE required. ALTERNATIVE ACTION : The City Council may deny Zone Change No. 84- 4 and allow the subject property to be used as a parking with the existing R3 zoning as permitted by Conditional Use Permit No. 84-3 .
