This zone change request has been processed concurrently with Area 3.3 of Land 'Use Clement Amendment 84 -2 . The applicant has requested that the zone change be withdrawn. PLANNING COMMISSIOR ACTION AND RECOMMENDATION : The Planning Commission held a public hearing on the zone change request on October 16 , 1984 . On motion by Livengood and s •ccond by Schumacher Zone Change No. 84-9 was approved to Q-C4 with the following conditions on the "Q" , anti recommended to the City Council for adoption by the following vote : AYES : Higgins , Wiiichell , Livengood , Potter , Erskine , Schumacher , Mirjahangir NOES : None ABSENT : None Abl ' None COrQ i t ions on "Q" • 1 . Any future development will be subject to approval of a Conditional Use Permit by the Planning Commission . 2 . The proposed development shall be designed so that the building orientation is compatible with the adjacent residential areas. 3. The proposed development shall not Ingress or egress on to Fear::-. Street . 4 . The proposed development shall preserve the existing nature trees on site to the greatest extent possible. No 4151 3 . Any future development of this site shall be. designed in conjunction with the adjacent property zoned C4 to the south . FIN51NGS: 1 . The C4 zoning is consistent with the recommended commercial designation in Land Use Element Amendment No. 84-2 . 2 . Rezoning the site to accommodate commercial uses would be compatible with surrounding land uses . At the City Council ' s direction , the Planning Commission reviewed the zone change request again on November 13 , 1984 to consider the applicant ' s request for withdrawal . On motion by Higgins and second by Schumacher Zone Change 84 -9 was recommended for withdrawal according to the applicant ' s request provided that any residential project proposed for the site be designed to take access off of Pearce Drive , by the following vote : AYES : Higgins , Erskine , Schumacher, Mi:jahaniir NOES : Livengood , Porter III ABSENT: None ABSTAIN : Done STAFF RECOMMENDATION: Staff recommends that Zone Change 84-9 be approved to Q-C4 with the findings and conditions as recommended by the: Planning Commission at their October lb, 1984 met.ting . If the City Council approves withdrawal of the Zone Change , staff would concur with the Planning Commission ' s recommendation that any residen*:al prciect on the site provide access off of Pearce Drive. ANALYSIS Zone Change No. 84 -9 , was referred back to the Planning Commission for review of the applicant ' s request for withdrawal . Upon discussion, the Planning Commission agreed to recommend approval of the request for withdrawal provided that any residential project on the site be required to provide access only from Pearce Drive. The a plicant presently has approved Tentative Tract 12206 on the site which has access off of Pearce Drive . That approval is under appeal to the City Council and is scheduled to be heard at the November 19 , 1984 meeting. Staff continues to feel that the site is most appropriate for commercial use and has therfore recommended that Area 3. 3 of LUc 84 -2 be approved for a change to General Commercial . Consequently , staff also recommends that Zone Change 84 -9 to Q-C4 also be approved. If the City Council approves the request for withdrawal of the item , staff would recommend that the Council deny the appeal of the Planning Commission 's approval of TT12206 and retain access off of Pearce Drive . The reason 1 am requesting this action is as follows : i filed for the zone change at the 53me Lima as my TT 12206 & CE 84-05 because of' the deadline date in doing so with the city . During these last few nonths , since filing , I have had a market analyst ` done by Charles Clark , a planner here at the city , and have bee► working with several brokers regarding developing this ir'. j ccmmercial project: . With the input that has been receivec, from those with experience in the develop-ment of strip shopping centers , I nave been advised that this is not a good location and that the price of the land is tc, high for the type, of retail aid commercial development we would beable to pout: in . AND ZONE CHANGE NO. 84- 9 I On November 5 , 1984 the City Council reviewed Land Use EZbment No . 84-2 . Prior to the meeting Council reviewed a letter from the anpl;cant for Area 3 .3 . The amendment would redesignate 3 .0 acres located on the southeast corner of Holsa Chica Street and Pearce Drive from medium density reside►, zial to general commercial . In addition , Zone Change No . 84-9 requesting a change frow R2 to C4 was processed concurrently with the Land Use Amendment . The applicant indicated that tie had doci ded that he would prefer to develope the site under the existing medium density residential designation. Due to the fact that the Planning Commission recommended approval of the amendment and zone change at the meeting of October 16, 1964 ; the City Council referred this requer.t for withdrawal back to the Planning Commission. The City Council directed that the Planning Commission review this request and report back to the Council by their November 19 , 1984 meeting. In addition, the applicants request for residential subdivision io:ntative Tract 12206 on the subject property has been appealed to the City Council by adjacent property owners . The appeal is scheduled to be heard by the City Council on November 19, 1984 . The applicant is redesigning the project to take access off of Bolsa Chica Street rather than Pearce Drive as approved by the Planning Commission. This new design will be presented to the City Council as an alternative to the previous layout . Recommenda t ion Staff recommends that the Planning Corivniss.ion uphold their approval of Land Use Element Amendment No . 84-2 and Zone Case No . 84-•9 and recommend adoption by City Council . The site would contain 61 , 80O square feet of retail ccmirE47cial uses , and would include 2 . 34 additional acres of existing commercially zoned prolerty directly South c. f the area of concern . The: projoct would then be integrated ►.ith e: fisting office and commercial developments to the south . If the 3 .0 acre site was zoned For commercial use and i ntentled. to be a separate entity , it would Le desirable to limit access to Pearce Street in order to reduce curb cuts along balsa C-Mca Street . I € unavoidable , one access point could be allowed on bolsa Chic:a Street as far south of Per-Arse Street as i:ostsible . To :educe '. mpacts on residential area to the north, cne access point on Golso Chica Street would be desirable provit..- d that the site ir. integrated with the corratercial pope. ties and ac % :lot.ments to the south . A commercial mining reties ignation of the site would l,e compatible with the commercial areas to the south . bolsa C:hica Street Fit a major arterial would Frovide sufficient aeparat ion to make the site ' compatible with the medium densit} residential Brea to the west . Proper building siting , se'tbacka , and buffering required under the C4 district will minimize impacts on the residential arear, more cl.osel.y located to the north and east . The f:roposed commercial designation can be additionally compat iblc: with the low derisity residential neighborhood across Pearce Street, provided that during consideration of development entitlementb , ringle-story and low intensity user; (such as the pxoposed nursery and existing vegetation) are sited at the north end of the subject property„ As indicxated in Land Use Element Amandrient No . 84-2 , the proposed two-story development of commercial users on the site rail ). be similar to development heights in the general area, and will not obstruct Airport operations at Meadowlark .
