On February 1 , 1972, the above- referenced case was denied
by the Huntington Beach Planning; Con•uziission. At this tinie
I would like: to appeal this decision to the City Council, for
which my check in the suns of $75. 00 is enclosed.
The basis for the denial at that time was due to a problem of
density and it is nay opinion that the Planning Cornn-iission
should leave granted an approval based on a density that would
be satisfactory to the Commission.

The atuff has reviewed Zaae, Use No. 72-7 and offers tho following information
fcr rur considerations
1. This application is a proposal to rezone a 4.48 acre pascal of land located
at the souU%east corner of Algonquin and Pearce Struts frcu R2 Two Fsaily
Residential :li tric t to R3-PD Limited Multiple Family Residence District -
Plannad Aesidutial Developmeat.
2. Subject property was studied as a portion of Master Plan Amendment No. 71-3
Study Area "C" at which time it was a consensus of the Coaoalasion to have
the property ruin in the R2 clasalfitativa and Master Planned for medium
density residential use.
The surrounding prcperties were proposed to be rezoned by Zane Case No. 71-20
Areas "C" and "D" as follawst
Area "C", the C4 parcel on the northwest corner of Algonquin Street and
Boardwalk Drive to be rezoned R3. This zone case has. trot becom effective
because the second reading of the ordinance 3s being withheld pending
approval of a planned residential development.
Area "D", that portion of this area Located south of subject property was
propose to be rezoned from R3 to R2. Thtt portion of Area "Q" east of subject

was proposed Co be rezoned from R2 to R1. Final action on

proposals were not taken because the City Council indicated that no actigzs
would be taken to rezone the property if an assessment district is formed to
Install street improvemeata, sewers, water, etc. The matter will be recon-
sidered by the City Council on Parch 20, 1972.
3. The applicant states that a 156 unit project is necessary to support the
special axwmities proposed for the development such as; tennis courts, pool,
gymnasium, indoor driving range, putting green, etc.
4. - It should be noted that the R3-P0 does not allow an apartment project and
requires that a Planned Residential bevelopeaint be constructed in conformance
with Article 931 of the Ordinance Code.
S. The present R2 none permits an AO unit planned residential development and a
72 unit apartment compl".
An k3-PD zone will permit 130 units. This is 26 units furor than requested
by the applicant.
6. in November 1970# a conditional, exception application was filed on this
property to permit voRctivation &ad testing of a ncm-conforming oil well for
a period of six months. The request was denied by the Plannlug Commission.
The Oil field Department indicates that the property was cleared of all
oil equipment on May 13, 1971 .

period, we suggest that thie matter be set for the earliest possible City
Council meeting, because the purpose of any appeal is to have a hearing
before the City Council and this is already being accomplished. We
further sugf.-eat that you not accept any appeal , as it will serve no purpose.
If approval has been recomnended other than as requested, the City Council
will be required to hold a public hearing on this matter. However, there
is a possibility that the Planning Commission' s decision will be appealed

MEMORANDUM

RE : Zone Case No. 72-4
( Initiated by Planning Commission)
DATE : February 15 , 1972
Zone Case No. 72-4 is a proposal to change the zone on a 4 . 6 acre
parcel of land located 260 ft . west of the centerline of New-
land Street and 600 ft . north of the centerline of Tolbert Avenue
from R2 Two Family Residence District to R2-PD (10) Two Family
Residence District , Planned Residential Development (10 units
per acre) . This zone change was initiated to implement the
Maateir Plan Amendment No . 72--1 Study Area B .
This zone case was first heard by the Planning Commission at
the February 1, 1972 meeting at which time action was continued
to February 15th to allow time for the City Council to make a
determination on the zoning of the property to the south . You
will recall that the property owner to the south had petitioned
for en R2-PD zone and that the Planning Commission had originally
recommended R2-PD (10 )'. This decision was appealed to the City
Council and referred back io the Planning Commission for further
consideration . At that time, it was the consensus of the
Commission that the property should be rezoned R1 if the density
Was not limited to 10 unite per acre . The final action by the
City Council was to approve the northerly 5 acres of that 10 acre
parcel to R2-PD (12) and to have the southerly 5 acres remain
in the Rl zone .
This action by the City Council leaves several aptiona open to
the Planning Commission for consideration.
1 . The Planning Commission could approve subject zone change
for an R2--PD (10) to be transmitted on to the City Council
For their action. I(` the property owner or developer did-
agrees with this recommendation, they can present their
views to the City Council for consideration .
2. The Planning Commission may wish to continue action on Zone
Case No . 72-4 until the City Council has held a first
reading of the ordinance effecting the zon9 change to R2-PD (12)
on the property to the south,.
3. The Planning Commission may wish to recommend approval for
an R2-PD (12) to conform with the proposed zoning of the
property to the south .
The public hearing on this zone case has not been opened.

Gentlemen :
Transmitted herewith is a report on the Planning Commission ' s
recommendation for Zone Case No . 72 -2 Area "B" . This zone
case was initiated ,by the Planning Commission for a change
of zone from A11 Light Industrial District to R1 Single Family
Residence District . 'rhe subject property consists of 2 . 8 acres
of 'land located an the north side of Slater Avenue , approximately
670 f t , east of the centerline of Goldeawest Street.
The Planning Commission approved Zone Case No . 72-2 Area "B"
on February 1 , 1972 and recommends adoption by your Honorable
Body .
Reasons given by the Planning Commission for their action :
1 . This zone change will implement amendments to the
proposed Nfaster Plan of Land Use .
2 . This proposal will establish a boundary line between the
R1 Single Family Residence District and the Nil Light
Industrial District , which will facilitate a more
logical land use pattern for the area .
