Belsito, Acting City Administrator FROM: Planning Commission DATE : May 11, 1976 RE : Zone Change No. 76-11 i APPLICANT: Initiated by Planning Department LOCATION: The subject property is composed of approximately 38 acres and is located on the west side of Beech Boulevard, extending approximately 2100 feet to the west, and south of Atlanta Avenue extending approximately 1300 feet to the south. REQUEST: A change of zone from C3 (General� 4 g ors ( eiie 1 Business District) , R5 (Office-Professional ) and R5-0 (Otfiee-Professional combined with oil production) to R2-PD (Medium Density Residential - Planned Development) . The change of zone will also eliminate the present 50 foot building setback line on that portion of the site that fronts onto Beach Boulevard. I PLANNING COMMISSION ACTION : ON MOTION BY BOYLE AIJD SECOND BY BAZIL ZONE CASE NO. 76-11 WAS APPROVED WITH THE FOLLOWING FINDINGS By 'rHE FOLLOWING VOTE: 1 . The requested change of zone will provide for a medium density resi- dential zoning which is consistent with the medium density residential designation of the General Plan. 2. The R2--PD zoning will provide for the highest and best use of the property by providing design flexibility and additional development reviews . AYES : Parkinson, Bazil, Finley , Slates , Shea , Boyle , Kerins NOES: None ABSENT: None PLANNING COMMISSION ' S RECO"MENDATION : The Planning Commission recommends approval of Zone Case 76-11, a change of zone from C3 ? R5 , and R5-0 to RZ-PD. 76 N )10 Page 2 BACKGROUND INFORMATION AND SUMMARY OF STAFF REPOR"' : The subject site was recently designated afi Medium Density Presidential as a part of the General Plan Amendment No. 76- l "A" . This amendment. was approved by the City Council in March of. 1976. Subsequent to this amendment process , representatives for the property owner filed a request for a chance of zone (76-09) in order to implement- the General Plan Land use designation . The Planning Commission in reviewing this request determined that it would be desirable to rezone the contiguous C3 parcel fronting on Beach Boulevard at the same time as the subject site of Zone Case 76-09 . The staff was Plso directed by the Planning Commission to complete the necessary procedure whereby the Commission could attach the "Planned Development" suffix to the base zoning should it be so desired . This direction was accomplishecl through the legal notification of Zone Case No. 76- 11. i I� The subject parcel is approximately 38 acres in size . The parcel ' s size and close proximity to the City ' s beach area create a development sig- nificance on the site as it relates to the surrounding areas. It was therefore the desire of the Commission that a quality development be implemented on the site , and that this could be accomplished through j the development standards and mandatory reviews required by a R2--PD zoning. Additionally , the staff and Commission discussed the existing plannin; data which indicates that some development constraints (soils , seismic considerations , etc. ) could possibly exist on the site and the 1 fact that the "Planned Development" suffix would provide design flexibility necessary to overcome the constraints . Therefore , the Planning Cummi.ssion denied the R2 zoning request of Zone Case No . 76-09 and approved the city initiated Zoije Case No. 76-11 . ADDITIONAL INFORMATION: j Mr . William Frost, representing the propeart- owner , addressed the Plan- ning Conunission during the public hearing and discussed the merits of a land use depicting both R2 and R2-PD zoning on the site. A Mr . Gordon Of€stein addressed the Commission and spoke in opposition , citing the following reasons. I . The site is located in a flood plain. 2 . The site has serious seismic considerations . jENVIRONMENTAL STATUS : I The subject site was a part of General Plan Amendment No . 76-1."A" and was revised for environmental assessment as a part of that document . It was approved by the Planning Commission on March 16 , 1976 and adopted by the City Council on March 29 , 1976 . 2 . 0 GENERAL INFORMATION: The Planning Commission directed the staff to incorporate the State surplus property adjacent to subject property of Zone Change No. 76-09 into Zone Change 76-11 and to provide the proper legal notice in order to implement the "PD" (Planned Residential Development) Suffix to the requested R2 zoning. The property is designated as Medium Density Residential and was recently approved by the Planning Commission as a part of the General Plan Amendment. w Page Two ""one Case No. 76-11 3 . 0 SURROUNDING LAND USES AND ZONING: Properties to the west and south are zoned R5 (office-professional) and developed with mobile home parks. To the east are properties zoned C4 and developed as a commercial shopping center . To the north are properties zoned C3 and R5 and are vacant of any develop- merit. 4 . 0 ANALYSIS: In response to Zone Case No . 76-09 , the Planning Com.ission directed the staff to provide the necessary procedure for the Commission to implement the "PD" suffix on the subject parcel . As a part of the analysis of Zone Case No. 76-09 , the staff indicated its concern of the lack. of control of the type of development that co' .1d possibly be proposed under the R2 zoning . however , representatives for the property owner have indicated a desire to provide a diversity of housing types on the approximately 38 acre parcel and have thus re- quested that the "PD" suffix not be placed on the entire parcel . The staff arguments for a similar position are contained in the analysis section of Zone Case 76-09 . � Should the Planning Commission consensus be in accordance with the housing diversity concept , then the staff would recommend that Zone Change No . 76-11 be continued in order that the staff can more accurately determine the appropriate area on which the Planned Development Suffix should be ibraplemented.
