In addition she feels that a decision on this piece should not have been made prior to the decision on the change to the whole Gothard Area. She stated that to be consistent she voted against the change . PLANNING COM14ISSION RECOMMENDATION: The Planning Commission recommends approval of Zone Change 77-26 , a change from Ml to Q--R2-PD. SUMMARY ANAL%1S I S: Zone Change Nc: . 77-26 is a request to implement the recently approved medium density residential. designation imposed on the subject property by the recently approved General Plan Amendment No. 77-1 . The subject property consists of approximately 38 . 7 acres of vacant land. It is presently subdivided into 25 by 50 foot lots of which approximately 90 percent have been consolidated . The subject property as noted earlier is composed. of non-conforming - small lots with several owners . Although 90 percent of these lots have been consolidated, it was felt that the remaining holdouts would discourage industrial development. Again, however, similar ownership pattern problems would have to be resolved for any type of 'deve lopmenr. In addition to an expansion of the area, the Staff has alsr initiated the "Q" prefix on the requested R2-PD zoning . It was felt that with the subject property' s orientation to the surrounding industrial properties that special conditions would be necessary to insure desir-- able residential development. Specifically, the Staff feels that a minimum 45 foot building setback line should be imposed on the north and west property lines of the 38 . 7± acre site. Also, access to the property should be subject to the City ' s approval and should be analyzed on the site prior to any development. These conditions of approval were deemed necessary because of the following: 1. The surrounding vacant properties to the north and south when developed will be industrial in nature. This will subject the site to an increase in the amount of noise , odors , and visual intru- sion of the industrial onto the residential uses . 2 . Present ownership patterns of the site indicate that development patterns could be haphazard in nature and could also encourage requests for numerous access points . Therefore, the Staff suggested the impcsition of several conditions of zoning approval which will insure minimum setbacks , a minimum site area of la+ acres that must be reviewed rind approved for develop- ment, a maximum density of 0 . 5 units per acre and a limit of the number of access points that will be allowed for each 19± acre site. Let me read the petition. ' It is dated November 14 , 1977 and says: "Dear Mayor Pattinson, Council Members i Bartlett , Wieder, Coen, Gibbs , Siebert, ; . and Shenkman : We the undersigned residents and bus- inessiaen of .the City of Huntington Beach ask that you support residential zoning for the land on the north side of Talbert Avenue between the railroad tracks and., the .existing residential dwellings on , Baron Circle Next, ' I' would ' like to give you a brief history of the Land Ilse de-cisions . whith 'changed the City' s General Plan from Industrial to Medium Density Residential. The ; change was 'a long time in coming. In early *197E the Planning Commission asked. the planning staff for an Industrial - Land Use Study. Although this study was to cover all industrial areas of Huntington Beach, I believe" the obvious blight and lack of good industrial uses along the Gothard corridor were strong consider - at"ions in the Planning Commission' s request . The study was completed in June 1976 and "examines the City' s existing industrial uses , employment structure, and revenues/ expenditures generated by industrial uses . " Among the study conclusions were the following: "Warehousing, storage, wrecking yards , and junk yards constitute an important .share of acreage in some places, most notabley along the Central Industrial Corridor . " "While the City shows a net revenue gain from developments in the Huntington Industrial Park 'Area, it exhibits a substantial net loss from activities along the Central Industrial Corridor. " "Margi.nal uscs . with minimum improvements in the Gothard corridor. . . . do not generate significant employment and income multiplier effects to other , sectors of the local " economy. " The study further recommended general areas of the corridoL which should be converted from industrial to 'other uses . 1n September 1976 the study results were presented to a joint meeting of the Planning Commission and City "Council . Both bodies made extensive .comments. on the study.,:findifigs and asked `that a, further. study, be , conducted. It was .to include a detailed analysis of the new input and recommendations. made at 'the 'joint ;meeting: ' General Plan amendment 76-2 was" also before the Planning Com- mis"sion and City Council in September and Qct 'ber and since . further sL-udy was now underway both bodies voted to continue the redesignation of- the 38 acre parcel `on Talbert to •General Plan Amendment 76--3 . When General Plan. Amendment 7673 came before: the Planning Com- mission and the City Council in November and December , the new detailed industrial study was still in process . Both bodies again voted to continue their decisions to the next General Plan Amendment, 7 7-1. Industrial 'Land Use Study Il was completed in February 1977 . It resulted in specific recommendations based on an industrial land suitability analysis , revenue/expenditure comparision on land uses over time , and a industrial land owners survey. . It also :presented two alternative land use plans reflecting the direction set at the September 1976 joint study session, . The study . resu.lts showed the 38 acre parcel on Talbert to have a low suitability for industrial development and recommended it . be redesignated. to medium density residential use. Industrial suitability wes based on transportation access , recycle 'cap- 'ability, public utilities and municipal services , physical features ,. parcel size, shape, frontage, ownership consolidation, and economic factors . In particular, severa]. reasons favoring redesign��tion of the Talbert parcel -were: 1. Low 'su.i tabi.lity for industrial uee because of poor location, need for extensive site improvements and fragmented numership 2. : No frontage o ' .Gothard Street but rather fronting of Talbert Avenue. 77 3 Lack ,of 'compatability with . residen't ial uses to the East and -North, 4. Lack of compatabilityl with the. major public improvements of tile . Central Park and Library. After all 'of this time, rEsearch, analysis and public hearings the Planning Commission c6nclude'd on June 7 , 1977 that the Talbert parcel should be -redesignated to Medium Density Residential. On August 1, 1977 the City Council agreed and voted to amend the General Plan. I believe this decision ,aas based 'on more itifor.- mation, more investigation, and more study than any previous General Plan Amendment. Shortly after this General. Plan Amendment , I applied for rezoning to R2-PD. The Planning staff modifed my request -by recommending that the rezone be to Q-R2-PD with. the following conditions : 1 . Minimum setback of 45 feet from industrial zoned properties . 2. Either a single 38 acre development or two 19 acre developments . 3 . Maximum density of 8 . 5 dwelling units per acre. (Normal R2-PD. density is 15 du/a) 4. Single street access point for each 19 acre site subject to approval by both Public Works Planning Department. 7 concvr d. with the planning staff recom,nendations and- on November 1 , . x977 the Planning Gonnission .held public hearings and approved .Che reeotmaanded zone cbange by 'a substantial majority. `Some of the objectives this zone change will accomplish are the .irol lowing; 1 . Provide a 45 feet residential seperation plus .a 45 feet industrial seperation (90 feet total) between the two uses where they are adjacent.. ' 2. Provide a verti,.:al buffer of 20 to 30 'feet from remaining industrial uses due to the high elevation or bluff effect of the resid- ential -parcel . 3 . Beautify e th street a earence on Talbert PP for more pleasant access to . the' Central Park and Library. We propose a bike path on each side of the street , a 16 foot land- soaped medium, . left turn pockets 'and full street improvement with curbs , gutters , sidewalks , and lighting etc . 4. Provide a substantial net revenue to the City. from new low density PUD instead of a revenue loss from vacant land or low quality industrial uses . 5 . Solve she problem of fragmented ownership by private enterprise and without the use of -the Redevelopment Act . 6 . Pay' Park and Recreation fees while also,'providirig residents of the project with private green belts and recreational areas , maintained by the home- : owners association. 7 : Provide additional presidents with purchasing power to support the new ecannercial center at .Talbert and Beach. (This new neighborhood shopping 'center ; has Very little housing nearby' because of the „ cemetery, school facility, an"d hospital to the East and the great deal of industrial land to the West. ) : 8 . . Pay for or construct the needed. storm drain facilities for this area with ' private investor funds. 9 . Pay the sewer assessment fees for the pump station built in this area with City funds some years ago. 10. Convert . a low suitability industrial parcel into an aestheticlly pleasing residential development In summery, an extensive study has concluded that this parcel is not good for industrial development . The recommended zone change will be highly compatible with the existing major cultural facil- ities nearby. The Q-R2--PD zone, the site size, and my pride as a builder will insure that the new residential development 4.s an aesthetic asset to the community.
