Zone Change No. J 7 7 Page Two PLANNING COMMISSION RECOMMENDATION: The Planning Commission recommends approval of Zone Case No. i7--27 , a change from Ml--A and C4 to (Q) -R1--PD, based on the findings and con- ditions as outlined above . SUMMARY ANALYSIS : Zor,e Change No. 77-27 is a request to implement the recently approved low I . density residential designation imposed on the subject property by General Plan Amendment 77-1 . The specific property to be rezoned has been expanded by the staff to include all those properties redesignated as a part of the General Plan process . The subject property Consists of approximately 11. 2 acres of land and is composed of approximately 400 25 x 49 foot lots. A significant consoli- dation of these lots has taken place but the site still possesses serious problems relating to ownership patterns (Refer to attached map) . it is because of this ownership problem that the staff p:,oposed the "Q" prefix . This prefix will allow the imposition of appropriate conditions of approval to insure that any development proposal will be on the entire site and thus avoid haphara;d development patterns . Additionally, the property is borderod on the westerly prcnerty line by indubtrially zoned properties . The "Q" prefix: would allow consideration ` of minimum setbacks for the residential units from the industri,'.l zoning so as to mitigate lanes use: incompatibilitic's , i. e . , noise, odors, visual intrusions , etc. -his setback concept is also consistent with what: the staff and Planning Commiu:A011 has deemed appropriate on surrounding resi- dential propur.tier, t belt border industrial zoning . The subject property was .a part of .that amendment process , and therefore, does not require additional environmental assessment at . this time. 3 . 0 GENERAL INFORMATION Zone Change..No. 77--27 is a request to implement the recently approved low density residential designation imposed on the subject property by General Plan Amendment No. 77-1. The specific property to be re- zoned has been expanded by the staff to include all . those properties "redesignated as a part of the General Plan process,; . 4'. 0 SURROUNDING ZONING AND LAND USES : The properties to the north are zoned C4 and R5 and are developed .with commercial, retail and off ice,/professional uses . To the south arc: properties zoned R1 and C4 which are vacant, hoorevc:r. the P,l property is under -cdns.ideration for a 61 unit planned residential development. T1ie ` sroperties to the west are zoned MI-A and are vacant. To :the east .ib : C4 property which is developed with a commercial shopping center. : -Page-'Two , ZC 77 27 5. 0 ANALYSIS: The subject property consists of approximately 11 . 2 acres of land and is composed of approximately 400 25 x 49 foot lots . A significant consolidation . o.f these lots has taken place but the site still possesses serious. problems relating to ownership patterns. (Refer to attached map) . It is because of this ownership problem that the staff has proposed the "Q" prefix. . This prefix will allow the imposition of appropriate con- ditions of` approval to . insure that any development proposal will be on .the 'entire ' site and thus avoid haphazard development patterns . Additionall , the property is bordered on the westerly property line b Y P , P Y YP P, Y Y . industrially zoned properties . The "Q" prefix would allow consideration of minimum setbacks for ' the residential units from the industrial zoning so as to mitigate land use incompatibilities , i.e. , noise, odors, visual intrusions, etc. This setback concept is also consistent with what the staff and Commission has deemed appropriate on surrounding residential prop- erties that border industrial zoning. The existing subdivision characteristics and ownership patterns would also pose significant problems in overlaying a comprehensive circulation system for the site, unless such a plan was done on a total concept basis . Therefore, the. staff feels that a condition regulating access to the site is necessary and desirable. The staff feels that the Q--R1-PD is the most desirable zoning for the property and is the .most consistent with the General Plan Land Use designation of low density residential on the properties. 6 . 0 RECOMMENDATION: The staff recommends; approval of Zone Case No. 77--27 , a change from MI--A to Q--R1--PD, based on the following findings and subject to the following conditions : FINDINGS: 1 . . Tile Land Use Element of the General Plan designates the subject property as low density residential. Therefore, the requested low density zoning is consistent with and actually implements the General Plan 'designation. 2. The resulting residential uses will be more compatible with the existing residential uses to the northwest and immediate south. CONDITIONS: i I 1. There `shall be a minimum forty--five (45) ' foot setback line, 'mea sur4d from the west property line of the 11'. 2 acre site , if such property line abuts industrially zoned property at the time of development approval . { .
