The Planning Commission requested that a "Q" be placed on this zone change in order to acid two specific conditions : 1) Vehicular access shall b-:i dedicated on 17th Street, and; 2) . a use permit shall be filed with the Planning Division of the Department of Development Services for any future development on the site. This zone change was approved by the Commission and :subsequently approved and an ordinance was adopted by the City Council on December 18 , 1978. Under the provisions of Article 964 (a ) , qualified classification , a zone change with a qualified classification has a time limit for eighteen (18) months after the effective d4-a to of the ordini neo, unlevs there is substantial physical clove 1op►r►ent . This use permit was rejected insofar as it did not address all four of the lots originally designated in Zone Change r; No. 78-14 . The plan that was originally submitted to the Planning - ,. Commission at the time of the zone change depicted one development t plan for all four lots. The building existing on the interior two lots is short one parking space, therefore , the plan presented to the Planning Commission utilized one parking on the exterior two lots to satisfy parking for the building on the interior two Lots. The plan submitted to the B. Z .A. did not depict this F parking arrangement . The Planning Commission requested that the City Attorney ' s office 9 an are re opinion discussing - the status of the QC3 prepare P zoning on the property. on May 28, 1981 , the City Attorney ' s office prepared and distributed a memorandum of opinion which has been attached to this transmittal . Also attach_0 d to this transmittal is a letter that was suLmitted to the Chairman of the Planning Commission and a letter addressed to the City j Attorney on May 26 from Mr . Foxx ' s attorney, discussing the background of this particular issue and including a full ehrorol- Orly of events from August 7 , 1978 thr.0 May 19 , 1981 . i Pursuant to the Planning Commissiods direction, the staff has scheduled a public hearing and requested an ordinance which would revert the QC3 zoning to the `I'ownlot: Specific Plan. This item has been scheduled for. the July 7 , 1981 Planning Commission Ineeting .
