STATEMENT OF ISSUE :
Zone Change No. 78-.28 is a Planning Commission-initiated change of
zoning on the site located south of Taylor Drive, from R3 , Medium
High Density Residential , to Q-R2-PD, Qualified Medium Density
Planned Residential Development. Also included is deletion of a
15 foot setback on the easterly C4 property abutting the subject
site.
RECOMMENDATION:
Grant Negative Declaration No. 78-115 . Approve Zone Change No.
78-28 . Adopt Ordinance .
ANALYSIS :
Applicant: Initiated by the Planning Commission
Location: 289 feet west of Beach Boulevard, 495 feet south
of Taylor Drive.
Request: From R3 to Q-R2-PD and deletion of 15 ft . setback
in C4 .

DISCUSSION :
The proposed zone change is compatible with commercial uses to the j
north and to the east on abutting properties . The proposed zone
change is also compatible with the n,,,_;dium high density residential
property to the south . The proposed zone change is also compatible
with the low density resident..al development to the west . Ordinarily,
a medium density residential development is utilized to buffer low
density residential development from commercial uses .

Zone Change No. 78-28 is a Planning Commission-initiated change of zoning

Development.
The Planning Commission on November 7 , 1978 , took the following action :

The Commission action follows a denial of Zone Change 78--16 , which dealt
with the northern portion of the subject site . Zone Change 73-16 was a
request from C2 to R3. The property was to be combined with the R3
properties to the south as one integi.ated development. The Commission
denied the zone change primarily because of the potential traffic problems .
The applicant tips appealed the denial , but requested a continuance to
January 22, 1979 , in order to allow the Planning Commission sufficient
time to consider Zone Change No. 78-28 .
A portion of the subject site is owned by Wilson Ford , but will be traded
to the owners of the residential property to the south in exchange for
commercial property along Beach Boulevard south of Wilson Ford.
The property owner has requested that Zone Change No. 78-28 be continued
to December 19 , 1978 , in order to present an alternative conceptual
development plan to the Planning Commission on December 12 , 1978.
3. 0 SUMMARY OF ISSUES :
Major issues of concern regarding Zone Change No. 78-28 are : 1) consistency
with the General Plan; 2) relationship to existing land uses ; and 3) vehicu
lar access .
li 4 . 0 ENVIRONMENTAL STATUS:
Negative Declaration No. 78-115 was posted for a ten-day period ending
November 27 , 1978, and no comments were received. The Environmental.
Resources Section recommends granti.nq Negative Declaration No. 78-115 .
5. 0 SURROUNDING LAND USF. , ZONING, AND GENERAL PLAN DESIGNATION : �
The subject site contains 4 . 875 acres and is zoned C2 , community business
district on the northern 1 . 55 acres . The remainder of the site is zoned
R3, medium high density residential.
The properties to the north and east are general-planned and zoned commer-
cial and are in use by automobile sales dealerships. Property to the west
is general-planned , zoned , and developed low density residential. The
property to the south is general-planned nigh density residential, zoned
medium high density residential , a portion of which is vacant and the
remainder developed with multiple residential.
6 . 0 ANALYSIS :
A portion of the proposed zone change (C2 to Q-R2-PD) is not consistent
with the General Plan Land Use Diagram and is larger than one acre maximum
allowed by the size criteria for permitting a finding of consistency
(subject site is 1. 55 gross acres) . However , the size criteria should be
applied flexibly since determination of the character of an area is the
overriding issue. In this case , a portion of the subject property is the
rear of a deep commercial lot which abuts residential property to the west
and normally would be buffered from commarcia]. uses by a higher density►

residential development. The proposed zone change would achieve the
desired buffering effect. The proposed medium density residential. -none
change would be consistent with the General Plan locational requirements
in that the subject site is : 1) adjacent to an intensive land use area;
2) near a major transportation route (Beach Boulevard) ; 3) proximal to
commercial area; and g ) accessible to work areas . Finally , the proposed
zone change %would further thirteen General Plan policies chile deterring
eight policies ( "Proposal Consistency with the General Plan" is attached) .
The portion of the proposed zone change within the area general-planned
high density residential is consistent with the General Plan Land Use
Diagram as defined in the Zoning and Land Use Element Consistency Matrix.
The proposed zone change is compatible with commercial uses to the north
Street and to the east on abutting properties. The proposed

zone change is also compatible with the medium high density residential
property to the south. The proposed zone change is also compatible with
the low density residential development to the west . Ordinarily , a medium
density residential development is utilized to buffer low density resi-
dential development from commercial uses.
Vehicular access has been a significant problem for the subject site .
Previous plans for access to Pammy Lane and Beach Boul.�vard proved inade-
quate. Access to Taylor Drive as the only point of access may be inadequate
to serve the site , in view of the heavy use of Taylor Drive by the
abutting commercial uses. Also, unless Taylor Drive is closed east of
Pammy Lane as required by the Taylor-Dcnch specific Plan , the residential
neighborhood to the west may face an increase to existing traffic problems .
If additional access can be provided to Steep Lane , signalization of the
intersection of Taylor Drive and Beach Boulevard is completed , and Taylor
Drive :is closed east of Pammy Lane, then adequate circulation will be
available for the site. However , access to Steep Lane will not be possible
for the foreseeable future . Temporary access to Beach Boulevard along
the southern boundary of the subject site could substitute until access to
Steep Lane can be accomplished .
7. 0 RECOMMENDATIONS :
Continue Zone Change No. 78-28 to December 191 1978 , in order to review
an alternative conceptual development plan on December 12 , 1978.
If the Commission desires to act on Zone Change No. 78-28 , then stuff
recommends the following;
1 . Find the "Q" 112-PD Lone consistent with the General Plan .
2 . Grant Negative Declaration No. 78-115 .
3. Approve Zone Change 78-•29 . a change of zone from C2 (Community Business
District) anti h3 (Medium High Density Residential District) to
"Q" R2-PD (Qualified Medium Density Residential/Pl.anr_ed Development) .

1 . The proposed zone change is consistent with and furthers the intent
of the General Plan .
2 . The proposed zone change is compatible with surrounding land uses.
SUGGESTED CONDITIONS :
1 . The developer shall participate in the cost of signalizing the inter-

section of Taylor Drive and Beach Boulevard.
2 . The developer shall participate in the cost of the closure of Taylor
Drive.
3. Temporary vehicular access shall be provided to Beach Boulevard in
addition to existing permanent ve.hicular access through Taylor Drive
and shall remain in force until such time as permanent vehicular
access to Steep Lane can be provided.

pany , hereby appeals the decision of the (Tanning Commission on Zone
Change 73-28.
This appeal is the result of a long process of alternative proposals
aimed at development of the Goeden Company property. As a result of
this process , there has been an increasing amount of confusion and mis-
understanding surrounding, the development request . In order to clarify
this confusion, the followina outline is a histnry of the various steps
the Goeden Company has undertaken .
STEP 1 : Initial contact with City Staff was made by the tIoeden Company
in late 1976 and staff suggested that access to the Goeden Com-
pany R3 property should be via Pammy Lane. As a result of this
recommendation, the Goeden Company purchased Lot ll of Tract
3933 to provide this access .
STEP 2 : May 1977 - Staff changed their position and recommended access
via Taylor Drive. '
STEP 3 : A map was prepared showing access to the R3 parcel through the
Wilson Ford dealership to Taylor Drive. Upon staff review,
the staff again changed their posit:un stating that if additonal
frontage along Beach Boulevard were provided, that access to
Beach would be preferable .
STEP 4 : The Goeden Company purchased additional frontage or, Beach Boule-
vard , i .e . the Lerner Gas station , and staff again .hanged posi-
tion and were not sure which way was preferable.
STEP 5: !n April 1978 Goeden Company contacted Hunsirker & Associates ,and
requested that Tentative Tract No . 10440 be prepared ,and filed ,

STEP 5: (Continued) taking access to Panvny Lant--. This was done in order
to receive direction from the decision making body .
STEP 6: Tentative Tract No. 10440 was filed with the city on May 18 , 1978.
(See attached Exhibit el ) .
TEP 7: July 1978 - Staff takes position that Pamrny Lane access is un-
acceptable and that the tract. will be recommiended for denial .
STEP 8: August 1978 - Tentative Tract Map expanded to include Wilson Ford
Agency property providing access to R3 property through the Wilson
Property via Taylor Drive . (See attached Exhibit �2) .
SETP 9: September 5 , 1978 - Zone Change No, 78-16 Filed on Wilson Ford
Property, requesting rezone from C-2 to R-3 , this change required
prior to further tentative map processing and for R3 access .
STEP 10: October 17, 1978 - Planning Commission denied Zone Change 78-16
and No. 18-67 . The Planning Commission stated that access to
Taylor Drive was a problem due to existing conjestion in the
area and suggested a study session to review ;-alternative access
opportunities .
STEP 11 : October 24 , 1978 - Appeal filed with City Council to Co.rn!ission
Denial of :Zore Change �73-16 .
STEP 12 : No.,errber 7, 1978 - Met with city --,ta ff and Commissioner Russel i .
Commissioner Russell agreed to move for reco;.sideration of Zone
Change 078-16 . Planning Commission concurred . Cormissioner
Russell indicated that access via Beach Boulevard may be a pos-
sible solution co access issue.
STEP 13: November 8, 1978 - Requested City Council to continue appeal on
Zone Change #78-16, to allow Planning Commission time to re-
examine their findings . (Appeal continued to January 22, 1979) .
STEP 14 : November 2.8, 1978 - Met with staff to review revised tentative
tract map which takes access from Beactr Boulevai-d and deletes
Wilson Ford Property and access via Taylor Drive. Informed that
the Planning Commission has initiai;ed Zone Chance 478-28 which
encompasses Goeden Company R3 property and Wilson Ford property
coverer+ under Zune Chanq,-N #78-16
STEP 15: November 29, 19-8 - Request Commission to continue hearing on Zone
0drige d78-28 from Dec;ernber 5th to December 1 nth, in order to
meet in a Study Session on December 1121th to discuss alternatives
relating to access . (Ser? attached letter) .

STEP 16 : December 12, 1978 - Staff Indicates that the Planning Conmission
agenda is extremely heavy and that a number of Commissioners will
not be in attendance and suggested that we reshcedule the Study
Session to December 19th.
STEP 17 : December 13, 1978 - Filed letter requesting continuance of Zone
Change 478-28 from December 19th to January 3rd to allow Study
Session with the Planning Commission rn December 19th to discuss
alternatives relating to access . ( See attached letter) .
STEP 18: December 19 , 1978 - Planning Conmission hearing on Zone Change
#18-28, the staff report does not mention request for continu-
ance and study session , rather in order to expedite the matter .
the staff scheduled the Zone Change next to discussion Item - ! ,
which was the conceptual plan for Tentative Tract 10440 Revised .
This was intended to permit Commission discussion oil both items
concurrently. The Commission then proceeded with the Zone Change
Hearinq . During the hearing the staff and the developer tried
to dis.--uss the issue of' Access , however, the Commission chose
to proceed with the Zone Change instead . The Conmission deleted
the Wilson Ford Property from the zone change and rezoned the
Goeden Property from R3 to QR2-PD. After passing on the Zone
Change , the Corranission then proceeded to Item -1 , Concepuual Plan
Review, and stated that the proposed layout, which was based on
the existing R3 zone , was not consistent with the QR`-PD which
they had just approved.
STEP 19: Preparation and filing of this appeal to .'_one Change #78-28,
DncFmber 28, 1978.
The justification for this appeal is that in this case there has been no
discussion of the real issue. The Commission has not considered the
initial source of the Zone Change Request , which was to provide for proper
and safe a.-cess to the proposed residential development. within Tentative
Tract No. 10440.
The current access as proposed by Tentative Tract No. 10440 dated November 30,
1978 (See attached Exhibit >r3) is a safe and adequate access to the proposed
development. Under this proposal , the Goeden Company would participate in
the installation of a traffic signal at the intersection of Beach Boulevard
and Taylor Drive. This will improve the existing traffic circulation by
reducing accident potential at this intersection and will at the same time
provide !traffic regulation which will allow for safe entry onto Beach
Boulevard from the proposed development.
We feel that there is no justification for the Zone Change since the exist-
ing medium high density R3 zoning is consistent with the General Plan, which
calls for high density residential . Also, since the Gon-ral elan 1hould he �

amended to medium density if the QR2-PD zoning is approved, and espec-
ially since the Commission has deleted the proposed altarriative access
to Taylor Drive through the Wilson Ford Property , which was the issue I
that started the zone change proceedings to begin with. We therefore
request that the City Council direct that the existing p3 zoning be re-
twined and that the Commission expedite the approval of Tentative Tract
1O440, as revised, at the earliest possible date .

AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY AMENDING SECTION 9061 THEREOF TO PROVIDE
FOR CHANGE OF ZONING FROM MEDIUM-HIGH DENSITY
RESIDENTIAL DISTRICT TO QUALIFIED MEDIUM
DE14SITY RESIDENTIAL PLANNED DEVELOPMENT DIS-
TRICT ON REAL PROPERTY LOCATED SOUTH OF TAYLOR
DRIVE WEST OF BEACH BOULEVARD AND TO DELETE A
SETBACK REQUIREMENT ( ZONE CASE NO . 78-28 )
WHEREAS , pursuant to the state Planning and Zoning Law,
the Huntington Beach Planning Commission and the Huntington
Beach City Council have had separate public hearings relative
to Zone Case No. 78-28 wherein both bodies have carefully con-
sidered all information presented at said hearings , and after
due consideration of the findings and recommendations of the
Planning Commission and all evidence presented to the City
Council , the City Council. finds that such zone change is
proper, and consistent with the General Plan,
NOW, THEREFORE, the City Council of the City of Huntington
}each does ordain as follows :
SECTION 1 . The following described real property located
495 feet south of Taylor Drive , approximately 289 feet west of
Beach Bot:levard is hereby changed from R3 , "Medium-High Density
Residential District , " to "Q" R2-PD, "Qualified Medium Density
Residential Planned Development District , " with the following
condition:
1. A reasonable buffer shall be, provided to the R-1 ,
"Low Density Residential" area to the west .
That: portion of Section, 35 , Township 5 , South, Range 11

of Orange, State of California, as shown on a reap recorded in
Book 51 , Page 13 of Miscellaneous claps, in the office of the

SECTION 2 . The Huntington BL!ach Ordinance Code is hereby
amended to delete the setback lines on those properties located
west of Beach Boulevard between Taylor Drive and Ellis Avenue .
A document containing an enlargement of a portion of Sectional
Di.stric` Map 35-5-11 showing in brackets the setback lines to
be deleted is attached hereto and incorporated herein as Exhibit
"An
SECTIO14 3 . The Planning Director of the City of Huntington
Beach is hereby directed to change District Map 39 (Sectional
District Map 35-5-11) to incorporate the zone change described
in Sections 1 and 2 hereof , and as said district map shall have
been amended, the same shall be in full force and effect and be
a part of the Huntington Beach Ordinance Code . A copy of said
district maps as attended hereby, is available for Inspection in
the office of the City Clerk .
SEC`rION 4 . Section 9061 , District Map 39 thereof, is r.ereby
amended by 'Lone Case I'lo. 78-28 .
SECTION 5. This ordinance shall take effect thirty days
after its adoption . The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days after ac:opt{on in the Huntington Heath Independent , a news-
paper of general circulation, printed and published in Huntington
Reach , California .
