Transmitted for consideration is Zone Change rlo. 78-9 , a change
of zoning from R2 , Medium Density Residential to C4 , Highway
Commercial on a parcel of land that is presently developed with
a commercial building .
RECOMMENDATION :
The Planning Cotru�iif�,ion and Planning Staff recommends that: the
City Council approve 'Lone Change No. 78-9 and (Jive attached ordinance

°FINDINGS:
1 The subject property �s developed with a commercial building
and was not to be included in the ordinance for Zone Change
No. 77-9
2. The proposed C4 zoning is consistent with the CitY' s General
Plan.
DISCUSSION:
On September 7 , 1977 , the Planning Commission approved Zone Change
No. 77-9 , a change of zoning from C4 to R2 on the properties
located south of Warner Avenue , north of Blaylock .Drive, east of the
alley between Beach Boulevard and "A" Street: and west of "B" Street.
However, due to the new commercial building located on the subject
property, this site was excepted froin Zone Change No . 77-9 by
the Commission. When this zone change was transmitted to the City
Council the subject property was inadvertently included in the
adopted ordinance. This has created a hardship for the property
owner in trying to obtain a loan for the sale of this property .
The subject property, is designated on the Land Use Element of the
General Plan as Medium Density Residential , however, as pointed out
in the General Plan under size criteria for determining land use dasig--
nations the subject site is leas than one and one-half acres of
commercial use and a more appropriate zoning designation based on the
character of the area can be determined. The proposed commercial zoning,
therefore , can be considered consistent with the General Plan even
though the Land Use Element and zoning are not identical .

6. 0 ANALYSIS :
On September 7 , 1977 , the Planning Commission approved Zone Change No, 77•-9 ,

Warner Avenue, north of Blaylock Drive , east of the alley between
Beach Boulevard and "A" Street and +rest of "B" Street . However , due to
the new commercial building located on the subject property , this site
was Excepted from zone Change. No . 77-9 by the Commission . When this
` zone change was transmitted to the City Council the subject property was
