The Planning Commission also voted to direct staff to prepare a zone chang�! to R1 (Low Density Residential District) to bring the zoning into consistency with the General Plan. Prior to voting on the Zone Change , the Planning Commission expressed concern regarding how a commercial project might be treated to attain compatibility with adjacent residential uses. Staff suggests that a "Q" (Qualified) designation could be attached to the C2 base zone to address the Planning Commission' s concerns. If the Council wishes to enhance the compatibility of the proposed commercial project, a "Q" (Qualified) designation could be added with the following conditions: 1. A: �- Re: Appeal from Denial of Petition for Ceneral •Plan Amendment and Petition for Zone Change No . 83-10 19100 Bushard (Southwest Corner of Bushard and Garfield) Gentlemen and Ladies : This letter is an appeal from the denial by the Planning Commission , at their meeting on April 3 , 1984 , of the above- captionzd Petitions . The Commission recommended against the P.mendment of the General Plan frcm low density residential to general commercial (C-2 ) and denied the Petition for a Zone Change from R-5 (office-professional) to C--2 (general commercial) . The Commissior, further directed that the Planning Staff l..epare a report for a change of zone of the subject property from R-5 to R-1 . The owners of the subject property and the proposed purchaser and developer of the property respectfully disagree with the action the Planning Commission has taken on these Petitions for the following reasons : 1 . Although the gross area of the subject property is 2 . 21 acres , measured from the center of the adjoining streets , the net usable acreage is only slightly more than an acre and a half (1 . 61 acres) . Such a small parcel is not suitable for R-1 zoning and development. Garfield Avenue, a primary arterial , presently carries about 9 , 500 vehicles per day and has a capacity of 30 , 000 daily vehicle trips ; Bushard Street , a secondary arte- rial , has an existing traffic volume of about 10 , 600 daily trips , with a capacity of 20 ,000 ; thus , presently, more thin 20 , 000 vehicles pass this corner daily; and the potential capacity in the future is 50, 000 . Such a volume of traffic clearly does not lend itself to residential development . In addition , the noise factor alone makes this corner unsuitable for residences . Ingress and egress to an3 from residential driveways would create danger not only to the residents but also to passing traffic . 2 . The adjacent residential properties , which were developed years ago , are protected by an approximate 8--foot block wall. A similar wall around the subject property to protect against noise and air pillution and to provide safety for small children would be impractical and aesthetically unacceptable . Adjacent to the property to the south is a General Telephone switching facility on rightly more than 1 acre . This use is inconsistent with R--1 development. 4 . To develop the property economically with apart- ments or other multiple residences , the developer would be forced to erect two or three-story buildirgs ; such a development , no doubt , would be •inacceptable to the re.,ideritial neighbors because they would lose some of their privacy when the sight--line from upper stories would intrude on them. 5 . Although the propar.ty is presently coned R-5 , to develop it with professional offices would be an economic mistake . A recent study by Williams Kuebelbeck & Associates , market analysts , prepared for the City of Huntington Beach , shows that the City in June last year had over 750 , 000 available square feet of office-professional space of which 47% was then vacant. Such a development of the property to be economically feasible would require at least two-story or higher structures. This development would also be unacceptable to the nearby residents for the same reason that multi-story residential would be � unacceptable . 6 . A general commercial development of this parcel seems to be it- only logical use . As stated above , tho property does not lend itself to other development because of a.tv limited usable size ; because of its location on a very busy, noisy corner; because the property on the Northeast corner of Garfield and Bushard (although not in the City of Huntington Beach) is already developed for commercial use , because a large General Telephone installation is adjacent immediately to the South . The integri,.y of the adjacent residential properties is protected by a. .high block wall . The alternate possible developments of the property would create visual intrusion on the adjacent residential properties . To force the applicants to develop the property only as single ` family residences would create almost unsaleable: homes. This conclusion is substantiated by the Staff Report prepared by the Planning Department in connection v ith these two Petitions submitted to the Planning Commission. The applicants recognize that seldom is the development of any property acceptable to all interested parties . In this case, however, the proposed use appears to be the best solution for this particular parcel. The alternatives as outlined above or the leaving of the parcel vacant are less desirable. The site substantially conforms to the General Plan land use criteria for commercial uses Which recommends commercial uses which recommends commercial convenience centers be located at the intersection of a local or secondary arterial. street . . C. the study area , the site is located at the corner of: a primary and secondary arterial . ) Although located in are area of predominantly low intensive residential uses , the site is buffered to the north and east by arterial streets and to the south by the General Telephone switching facility. The applicant has indicated that conceptual plans for the neighborhood center are of a single story design which would serve to minimize any adverse visual impacts with the adjacent single family homes .
