AYES : Higgi. 9 , Livengood, Porter, Erskine, Schumacher, Mirjahangir NOES: None ABSENT: Kinchell ABSTAIN: None DISCUSSION: Zone Change No. 83-6 is a request to rezone property located on the inland side of Pacific Coast Highway, approximately 350 feet south east of Admiralty Drive from RI and C4 to R2- ( 7 . 4) . The zone change also includes removal of the fifty (50) foot setback line along Pacific Coast Highway on the portion of the site that is currently zoned C4 . This setbac:c does not pertain to properties zoned for residential . At their June 7, 1982 meeting, the Planning Commission approved Tentative Parcel Map No. 83-560 which created an approximately 6, 9170 square foot parcel . This is the site of the proposed zone change . An F2 zoning on the property would be consistent with the Medium Density Residential general plan designation on the site. Residential use would be compatible with the residential uses immediately abutting the site oi: the north and with residential uses to the northeast across the channel . Access to the parcel would be from Pacific coast Highway. Prior to delreiopment of the site, permits for a driveway onto Pacific Coast Highway will have to be obtained from the City' s Public Works Depart- ment and from the California State Department of Transportation. Tentative Parcel Map 83--560 contains a condition that access to the site be limited to one dri•i�way with right turns in and out only and that turnaround area be provided an the subject property so that cars will not have to back out onto Pacific Coast Highway. The Planning Commission and staff are recommending that a maximum of two dwelling units be " allowed on the subject property . Buildable area an the property is limited by the irregular shape of the lot and by the location of a 13 foot wide public easement on the site. Building potential is also restricted by Cie limited access onto Pacific Coast Highway. For these reasons, the Planning Commission and staff feels RCA ' July 5, 1983 Page 3 that the site cannot accommodate more than Iwo dwelling units . It is reccmn. ended that the zoning on the site be changed to R2- ( 7 . 4) . The suffix - (7 .4) indicates the number of units per gross acre . The sub- ject property contains . 27 gross acres which would allow two units ( . 27 gross acre] X 7 . 4 units/gross acre) . The subject property is in the coastal zone . The City ' s coastal land use plan contains a policy that new development provide both vertical and lateral access to and alcng the shoreline when possible. The policy notes that access to the bulkhead areas of Huntington Harbour is generally not appropriate because it cani,ot be provided consistent with privacy standards . The subject property is small in size and the public access along the channel would only extend for approximately 137 feet. It would not connect to any other path or accessway. There would be very limited parking opportunities for persons who might use the accessway, and this parking would be along Pacific Coast Highway which could create traffic and safety hazards to the flow of traffic. ror these reasons the provision of significant public access opportunities on the subject site are not possible or appropriate. The Planning Commission and Staff are re commending that a pier head line be established for the subject property to allow a boat dock ad- jacent to the site. A resolution to establish this pier head litre is being submitted to the City Council by the Public Works Department under a separate RequeEt for Council Action for the July 5, 1S93 meeting. ENVIRONMENTAL STATUS: Pursuant to the environmental regulations in effect at this time, tht. Department of Developmenr. Services posted draft Negative Declaration No. 83--13 for 10 days and no comments , either verbal or written were j received. The staff in its initial study of the project has recom- mended that a negative declaration be issued for Zone Change No . 83--6 . At its June 6, 1983 meeting the Planning Commission reco..unended approval of Negative Declaration No . 83-13 to the City Council. It is necessary for the City Council to act on Negative Declaration No. 83-13 before takin7 action on Zone Change No. 83-6 . FUN]2ING SOURCE: Not appl.ic=ible . In 1967 a small strip of land northwest of the subject property was re-zoned from C4 to R2. In 1981, a single family home was proposed for the portion of the subject property that is currently zoned R1. The two parcels that are zoned R1 contain approximately 2, 676 square feet with 58� feet of frontage. This did not constitute a legal building site under the Rl zoning and the applicant fii.ed for a conditional exception (C.E. . No. 81-05) to build the single family house. The conditional exception was denied by both the Planning Commission and by the City Council. Information supplied in 1981, by the applicant for C.E. No. 81-05 indicated that the two smaller parcels zoned RI were parcels that were left after divisions of land were approved to the northwest (Division of Land No. 66-19) , to the southeast (Tract 21) and �o the north (Tract No. 6874) . 7 . 0 ANALYSIS : Tentative Parcel Map No. 83-560 is a request to create one parcel approximately 6 , 970 square feet in size to establish a legal building site. The proposed parcel will combine two existing parcels , 2 , 676 square feet in size, with a portion of an adjacent larger parcel. The remainder of the larger parcel would become a new parcel of approxi- mately . 91 acres in size. It is currently occupied by t:he Rank of America building and parking lot . There is a 13 foot easement dedicated to the City of Huntington Peach for aawer and storm drain purposes on the subject property running from Pacific Coast Highway to the rear o:: the site approximately 17 feet from tie northeast property line . Zone Change No. 83-6 is a request to rezone the parcel created b_y Tentative, Parcel Map No. 83-560 from R1 and C4 to R2 . The 6 . 97tT square foot parcel would be a legal building site under the R2 zoning district and would be allowed a maximum of three dwelling units . The applicant hr.i indicated that he plans to build ' two dwelling units on the prop-•.r try. The R2 zoning would be consistent with the Medium Denisty Resi• ntial general plan designation on the site. Residential use would be com- patible with the residential uses to the northeast of the bite across the channel and with the residential immediately abutting the site on the north.
