The 1978 zonfa. change on the applicant' s 0. 13 acre parcel and the adjacent parcel to (Q) C3 created a s=11 area of commercial zoning in the midst of an area that was in- tended for residential use. The intended land use of the area is desig- nated as Medium Denaity Residential in the City ' s General Plan and in the residential Townlot Specific Plan adopted for the area. The Planning Commission addressed the issue of allowing :'commercial uses in the Townlot area in 1971 by adopting Resolution No. 1078 . This re- solution of intent stated that any commercial development along. 17th Street should be at least one-half block in size and accompanied by a comprehensive development plat) . The site that is currently zoned (Q) C3 does not meet this , size criteria. The Commission also recommended that the adjacent lot should be rezoned to Townlot Specific Plan. The property owner , James Forx, of the one lot adjacent to the site of the applicant' s zone change request submitted a letter to the Planning Commission opposing the potential change of zoning on his property. The Plat,nirg Commission considered this letter at their July 6. 1983 meeting but voted to include Nlr. Paxx ' s lot in the zone charge recommendation to City Council . James Foxx was notified of the Planning Commission' s action following the July 6 . 1983 meeting. Residential-', , zoning on the properties would be more consistent with the intent of they General Plan for this area. Properties accross Seventeenth Street are already developed as residential . The vacant land behind the subject property is zoned for residential. The tavern accross Olive Avenue is a legal nonconforming use which wotild have to be developed as residential should it recycle. Ample space ,-for office uses is planned for the Downtown area aLoser to Main Street and there is no need for scattered small office buildings in the Townlot area . Should a res i dential zoning by placed on the larger 0.26 acre site three lots) as recommended, the existing offi--e building would be allowed to remain as a legal nonconforming use. ENVIRONMENTAL STATUS: Pursuant to environmental regulations in effect at this time, the Department of Develo?ment Services posted draft Negative Declaration No. 03-18 for ten days and no comments, either verbal or written were received. In November, 1978 the City Council ippro ed zone Change No. 78--14 changing the zoning to (Q) C3 an a . 26 acre site which included the current applicant's Marcel and the ad..jacent parcel . At this time it was the property owner' s intent to remodel the office building on the northern half of the site , demolish an existing automotive , garage on the corner and construct a second office building . In order to ensure that development on the entire site would be i-Itegrated and that ..-ahicular access would be off of the rear alley , tra pity Cour.Ci. l conditioned the zone change to require dedication of access rights on Seventeenth Street and a use permit application fox, nei: development. March 13 , 1979 the Planning Commission approved Use Permit 78--73 hllowing for remodeling of the existing office building and constructs of a r,ew• 4 , 500 square foot office building on the applicant's parcel . A condition of approval of the Use Permit was that one of the six rugoir?u parking spaces for the existing office building was to be provi& 3 In the parkinglot for the new building. An easement was to be recorded dedicating this parking space and access to it in oral--r to accommodate the parking arrangement.
