The •proposed zone change is compatible with surrounding commercial uses. ono.O% ANALYSIS: In July of 19841 applications were filed to rebuild an existing service station with a food mart , detached car wash and to add the zone suffix -SS . The applications were subsequently rejected in that the existing service station location was not in compliance with the locational criteria . The criteria in effect at that time required service stations to be located at the intersection of major and/or primary highways. The service station operator initiated Code Amendment No. 84-21 to ar-end the locational criteria . This Code Amendment to Article 948 hart been approved by the Punning Commission and adopted by the City Council and became effective duly 3 , 1985 . The amendment will permit a service station site to be located at the intersection of a sc;:ondary highway ( Edwards ) and any other highway ( Balsa ) provided that two of the three remaining corners are zoned and general planned commercial . The applicant 's request complies with this new provision in that the northeast corner is within the Westminster Nall and the southwest corner (within Huntington Beach ) is zoned and developed as commercial . A conditional use permit for new service station development is required at this location per the new locational criteria of the code amendment . A new development proposal , Conditional Use Permit No. 84-240, consisting of a convenience market combined with gasoline station and a small detached building for office and restrooms , was approved by the Planning Commission on August 5 , 1985 . ENVIRONMENTAL STATUS: Pursuant to the environmental regulations in effect at this time, the Department of Development Services pasted draft Negative Declaration No . 84-28 for ten days , and no comment , either verbal or written were received . The staff, in its initial study of the project , has recommended that a negative declaration be issued. Prior to any act ton on Zone Change No . 84-14 , 11. t is necessary for the City Council to review and ace on Negative Declaration No . 84-28. After review, we have concluded that the project as proposed will probably have little impact on the Westminster Mall area . However, we agree with you, that the driveways on Edwards Street should be closed off to eliminate a source of potential accidents and alleviate congestion at the intersection , both of which could be aggravated by the increased intensity of the develop- ment, We feel that the use is too intense given the limited area of the property and that the carwash should be eliminated from the plan . A conditional use permit for new service station development is required at this location per the code amendment: . Service station at.andards ( S. 9481 . 4 . 1 ) allow service stations with a car wash attached to the main building. Section 9432 . 8 allows a convenience market, with gasoline sales. S . 9430. 7 allows a car wash where gasoline sale is a significant part of the operation subject to the approval of the use p.Gmit . Eight parking spaces are required for the convenience market ; parking required for 4 drive-through car wash is not specifically addressed in the Code . The applicant has proposed seven on-site spaces ; Conditional Exception No . 84-45 seeks relief from the eighth space requirement . Thzre is adequate space in the car wash -entry to accommodate two spaces , and would be comparable to S. 9791 . 9 . 8 which allowa .,stacking credit for commercial establishments with drive-through windows . Three of the seven on-site parking spaces are adjacent to vacuum arid air/water hoses which minimizes the utility of these services . However , the southernmost vacuum outlet could be eliminated and the afr/wa.ter relocated adjacent to the northernmost space. The remaining five parking spaces would be available for customer and employee use of the market . These five spaces do not satisfy S. 9430 . 8. 2(a ) which requires 8 spaces for all convenience markets combined with gasoline sales . Public- Works Department has informed staff that the exit driveway from , the car wash onto Edwards would not be permitted. This would necessitate rerouting the car wash exit lane and eliminating one or two parking spaces . Rerouting the car wash exit lane may cause a tra M c conflict with automobiles entering the site.. The proposed car *wash exit lane may also create a traffic conflict with . automobiles exiting the car wash and re-entering the site to utilize the vacuum or air/water facilities. By eliminating the car wash use, the required parking for the zonvenience market may be served by a single driveway on Edr:ards Street . 6. 0 RECOMMENDATION : StaEE recommends the Planniny Commission approve Zone Change No: 84 --14 and Negative, „Declaration_.No. 84-28 and deny Condilivnal Use Permit: No. 84 -24 and Cond; t:ional Exception No. 84-45 based on the following f i'ndings. Because of the size, configuration , shape and lack of unique topographic features of the subject property, there does not appear to be exceptional or extraordinary circumstances or conditions applicable to the land, buiidings or premises Div I that does not apply generally to property or .:lass of uses same diatrict . 2 . Since the subject property can be fully developed within re -,llar established setbacks, such a conditional exception is not necessary for the preservation, and enjoyment of substantial property rights . 3 . When the customer pnv!; for his gasoline , by asking; the cashit!r, he will hc, given a number which will operate the! czar wash. Just outside the entrance to the car wash is a machine which will activate the car wash by pushing; two numbers given the customer by the cashier . The customer can push the numbers into the machine, and then drive Into the car wash , and stop when the wash is finished. The customer drives out and exits the property. Our plot plan shows stacking space for. 4 cars waiting for a car t.as!- in a space that is completely out of the was of on-site auto circulation. Past experience has shou-n that r.he number of customers that use the car wash works out to be a. small percentage of the total number of customers that will be buying gasoline at our sta-icon . The car wash is tieing offered n.; an added attraction to our customer:: in an effort to increase the sale of -gasoline. This site has ample room for maneuvering; of on-site vehicular trai ,i,� which will coincide with the different functions offered on this site. We has provided 7 on-site parking stalls to accommodate on-site vehicular traffic which dova not purchase gasoline at our station . Past experience with the proposed types of uses has shown that the number of trips generated by such facilities is negligible . Our proposed would instewd make use of the traffic already on existing; streets. In closing, I feel our proposal. will make a good addition to the cotmnet zi.al bujinesses, aB well as nit neatbotic asset to the city of Huntington Beach. Commissioner Porter was concerned about an item that was not mentioned in the staff report with regard to 'discardi.ng surgical by-products which could create an undesirable situation . He felt the Commission need to addresn the area of procedure for disposal of veterinary medical wastes . Commissioner Schumacher added that this was also one of her concerns . She stated that most of these facilities have outside dog runs . There was no such indication in Lhis facility. She stated concern about the overnight keeping of animals. Dr . tMaito, the veterinarian for the cliniF, responded that the animals would only be there as long as they are ill or recover from surgery . She stated that the surgical waste would be tre"ated just the same as ether hospitals do . It does not go down the sewer , it is double bagged an placed in the commercial trash container .
