BUILDING ENTERPRISES Statement of Issue, Reoommandation, Analysis, Funding Soures, Alternative Actlons, Attachme ts: ' STATEMENT OF ISSUE : Zone Change No. 84 - 17 is a request by G . P. Building Enterprises to rezone 33 ,000 sq . ft . of property located on the south side of Yorktown Avenue approximately 340 feet east of Beach Boulevard from RS (Office professional ) to R3 (medi+im-high Density Residential ) . If approved , the applicant intends to construct a twenty-four unit, three story apartment complex . Staff recommended epprovel and Negative Declaration No. 84 -37 and adoption of Zone Change No . 84 -17 with the addition of a "Q" (Qualified Classification ) designation based on findings and condl - ions ( see attached st3ff report ) for better design control . The Plannis;-n Commission reviewed the request and is recommending rezoning the property to (Q) R2 ( Qualified Medium Density Residential ) with conditions . R ECOMMENDAT I 0 N : Planning Commission. RecoaaendatloD : Approve Zone Change No . 84-17 for rezoning to ( Q) RZ ( qualified -medium Density Residential ) with conditions and findings as outlined under PLANNING COMIMISSION ACTION. Stx£f Recommendation : Staff recommends approval of Zone Change No . 84-17 for rezoning to R3 (medium-high Density Residential ) , staff recommunds the addition of a "Q" (Qualified Classification) designation with conditions and findings as follows : Conditions of the "all : I . ABSTAIN : None A legal opinion at the time indicated that a second notion to deny was unnecessary and automatic denial of the case occurred due to failure of the first motion . Subsequently , a review of the Planning Commissioner ' s By-Laws was made. It was determined that no application shall be deemed denied without an affirmative action by the Commission . Thus , the Planning Commission held another hearing to reconsider zone Change No 84 - 17 on Aovenber 13 , 1964 . ANALYSIS : Zone Change No 54 -17 is a request to change the zoning on a 33 , 000 net square foot ( 43 ,560 ross square feet ) site from RS ( Office-Professional to R3 (Nedium-High Density Residential ) . if approved , the applicant intends to construct a twenty-four unit , three story apartment complex . A conceptual plan of the apartment development was suhmitted with the request . Staff reviewed the request and determined that the site is suitable for multiple-family development . Combining the three existing parcels creates a site adequate in size to accommodate such a development . Medium-Nigh density resident.( & ] is compatible with surrounding land uses . A "Q" ( Qualified Classification ) designation was recommended because the conceptual plan was inconsistent. with City standards . This allows imposition of conditions to assure a high quality development with regard to better land planning techniques , complimentary architecture , landscaping , site layout and design . In addition , Staff recommended that , due to the site location adjacent to a community park , the subsequent development be subject to Design Review Board approval . ( 14334 ) �� 04- November 20 , 1914 t Rezoning the property to ( Q) RZ with conditions is recommended by the Planning Commission . They are concerned about intense development and a bulky building appearance. By rezoning to R2 , a lower density development will occur which will be more compatible with surrounding uses and development . ENVIRONMENTAL STATUS : Pursuant to the environmental regulations in effect at this time , the. Department of Development Services Posted draft Negative Declaration No. 84 -37 for ten days , and no comments , either verbal or written were received . Staff , in its initial study of the project has reconviended that negative declaration be issued for Zone Change No. 64 - 17. Prior to any action on Zone Change No . 84 -17 , it is necessary for the City Council to review and act an Negative Declaration No. 64 -37 . ALTERNATIVE ACTION : The City Council may deny Zcne Change No. 84 - 27 . Findings for Denial : 1 . A change of zone on the subject properly from R5 (office professional ) t.o K3 (medium-high density residential ) is not compatible with surrounding zoning designations . 2 . The subject property is not of adequate site and shape for multiple-family residential development . 3 . The zone change would be inconsistent with the goals and objectives of the general plan . (1257d) staff Report 10-16-Wi 6 .0 ISSUES AND ANALYSISs The su~,ject_ pro,pert} consists of three parcels , each wi th a single family revidence , totalling one gross gore and .33, 000 net square fee t . It approvc: d, the proposed zone change will allow a maxi mu: of 24 dwelling units to be constructed on the subject property. The site is suitable for multiple family dwelling units since it in located on an arterial street, buffered from commercial cases by a pet cemetery to the west and south , and sufficiently separated from less Intense residential cevelopments by a park and arterial street . The site is of adequate size to accommodate a high quality, aetitheti.cally pleasing developpie,it . In order to assure that a► %' proposed development will be of high quality with regard to beti.e:r land planning techniques with maxim-der• use of aesthetically pleasing architecture , landscaping , site layout and design , staff recomme;,ds that a "0" , qualified classification , be added to the proposed change of zone . Zone Change No . 64 -17. can be found zonsistent with the General Plan because of the characteristics of the area - Due to the size of the site (one acre or less in sixes ) , a generel flan :ametiidwent to not necesssarl, . A conceptual plan has been subbitted it conjunction with the zone change which shows a three-story, twenty-four unit apartment complex . Covered parking is �)rovide;i on the first floor with stacked units above . A curacry review of the plans for conformance with the zoning and apartment standards indicates two deficfjncies : the front balconies encroach into the required front setback area ; and the building coverage exceeds 50% of the lot area . An in-depth plan check and �estgn review will occur when a use permit is filed. 7 .0 RECGMMENDATION: Staff recommends that the Planning Commission approve Zone Change No . 84-17 and Negative Declaration No . 84-37 with the additi°,gin of a "0" (Qualified Classification) designation with the outlined conditions and recommend adoption by the City Council based on than following findings : Conditionsof the "0" : 1 .
