BUILDING ENTERPRISES Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Ac3;ans, Attachments: STATEAfENT OF ISSUE : Zone Change .No . 84-17 is a request by C . P. Building Enterprises to rezone 33,000 sq . .Ft . of property located on the south side of Yorktown Avenue approximately 340 feet east of Beach Boulevard from R5 (Office Professional ) to R3 (medium-high Density Residential ) . If approved , the i�. ,plicant intends to construct a twenty-four unit , three story apartment complex. Staff recommended approval and Negative Declaration No. 84-37 and adoption of Zone Change No . 84 -17 with the addit +.on of a (Qualified Classification) designation based on findings and conditions (see attached staff report ) for better design control . The .Planning Commission reviewed the request and is recommending rezoning the property to (Q) R2 (Qualified Medium Density Residential ) with conditions. RECOMMENDATION: Planning Commission Recommendation : Approve Zone Change No . 84-17 for rezoning to (Q) R2 ( qualified-medium Density Residential ) with conditions and findings as outlined under PLANNING COMMISSION ACTION. Staff Recommendation : Staff recommends approval of Zone Change No. 84 -17 for rezoning to R3 (med-.um-high, Density Residential ) , staff recommends the addition of a "Q" (Qualified Clsssif.ication) designation with conditions and findings as follows : Conditions of the " " : 1 . ANALYSIS : Zone Change No 84 -17 is a request to change the zoning on a 33 , 000 net square foot (43,560 rocs square feet) site from R5 (Office-Professional) to R3 (Medium-High Density Residential ) . If approved , the applicant intends to construct a twenty-four unit , three story apartment complex . A conceptual plan of the apartment development was submitted with the request . Staff reviewed the request and determined that the site is suitable for multiple family development . Combining the three existing parcel creates . a .site adequate in size to accommodate such a development . Staff recommended that , due to` the site location adjacent to a community park, the subsequent development be subject to Design Review Board approval. They are concerned about intense development and a bulky building appearance. By rezoning to R2 , a lower density development will occur which will be more compatible with surrounding uses and development . ENVIRONMENTAL STATUS: Pursuant to the environmental regulations in effect at this time , the Department of Development Services posted draft Negative Declaration _ No. 84-37 for ten days , and no comments , either verb O. or written were received. Staff , in its initial study of the dange roject has recommended that negative declaration be issued for Zone No . 84-17. Prior to any action on Zone Change No . 84-17 , it is necessary for the City Council to review ano act on Negative Declaration No. 84-37. ALTERNATIVE ACTION: The City Council may deny Zone Change No. 84 -17 . Findings for Denial : 1 . A change of zone on the subject property from 5 (office professional ) to RS (medium-high densii,r residential ) is not compatible with surrounding tuning j designations. 2 . The subject property is not of adequate size and shape for multiple-family residential development. 3 . The zone change would be inconsistent with the goals and objectives of the general plan. DEC. # 84-37 At the October 16, 1984 P.C. ►nceting, motion a,- approve ZONE CHANGE #i84-17 and N.D. #84-37 was made and seconded; the roll .;all vote was three ayes and four noes. A legal opinion at the time indicated that a Second motion to 'deny was unnece;isar�, and automatic denial of the case occurred due to failure of the first mo}ion. Subsequently, a review of the Planning Commissioner's By-Laws was made. . it was determined that no application shall be deemed denied without an affirmative action by a vote of four or more Commissioners. Therefore, Zone Change No. 84-17 and Neg. Dec. #84-37 needs to be reconsidered In order for an affirmative action to be made. The main concern of -the Commissioners was that the proposdd building appearance was bulky and no architectural variations in terms of bldg, offsets heights end roof lines were presented. The placement of a qualified zone was discussed for better design control . The applicant has submitted a revised elevation of the conceptual plan showing added roofllne variation and landscaping. It is slightly better than tha previous elevation, but still lacks front building line offsets and varied building heights. In order to achieve such standards, it may be necessary to mo- dify the size of units and include one-bedr�im, two bedroom, and three bedroom lay outs. Also, ' reducing the size and/ or recessing protruding balconies might be necessary. Staff 's reconrrvandation is the same as in the previous report, approve the zone change with the addition of a 'IQ" designation. However, four additional conditions have been added to the "Q" designation in order to achieve an aesthetically ploasing development and one that blCnds better with the surrounding environment.
