RECOMMENDATION :
The Planning Commission and staff recommend that the City Council
uphold the decision of the Planning Commission and approve Zane
Change No. 84- 2 by the adoption of the attached ordinance .

FINDINGS ^7R APPROVAL :
1 . The proposed rezoning of the property in question would
conform to the General Plan and is consistent with the intent
of the Townlot Specific Plan.
2 . The change of zoning eliminates the present spot zoning of
some of the properties along 17th Street as comriercial .
3 . The properties along 17th Street have failed to meet the
provision of ne-olution No. 1078 for consolidation of ar.
entire half-block for consideration for commercial zoning .
DISCUSSION
Zone Change No. 84-2 is a request to change the zoning on . 26 acres
of property locat d on the northwest corner of Olive Avenue and
17th Street, from (Q)C31 General Business District combined with a
qualified classification . to `Townlot Specific Plan, Area 1, Section
B . If. approved by the City Council , Zone Change No . 94--2 would
rezone all of the (Q) C3 property within this area of the Townlot
Specific Plan .
Staff analysis indicates that residential zoning on the properties
would be more consistent with the intent of the General Plan for
this area. Properties across 17th Street are currently developed
li residential . The vacant land north of the subject property is also
zoned for residential . The tavern across Olive Avenue is a legal
nonconforming use which would have to be developed as residential
should * recycle. Ample space for office uses is available in the
downtown area closer to Main Street and there is no need for
scattered small office buildings in the Townlot area. The existing
office building locates] on Lots 5 and 7 would be allowed to remain
as a legal nonconforming use . In the event that the use on this
site was recycled it would have to be rebuilt as reeidential in
keeping with the character of the Townlot Specific Plan area. It
is the intent of the property owner of Lots 1 and 3 to construct
two single family dwellings in the near future. Attached for your
review rs the staff report sent to the Planning Commission on
March 6 , 1984 .
On July 6, 1983 , the Planning Commission approved Zone Change No.
83-7 , a request to change the zoning on the subject property from
0-r_3 to Townlot Specific Plan, Area One, Section B . In its
approval of Zone Change No. 83-7 , the Planning Commission also
changed the zoning on the adjoining two lots from. Q-1Ca to Townlot
Specific Plan , Area One, Section B.
on September 6 , 1983 , Zone Change No. 83-7 was heard by the City
Council. At this meeting, a motion was made by MacAllister and
seconded by Finley to adopt Ordinance No. 2637, after reading by
title. The motion failed by the following roll call vote :
AYES: MacAllister, Finley
-2- 4-5- 84 - RCA
NOES: Pattinson, Thomas , Kelly
ABSTAIN : Bailey
ABSENT: Mandic
Because the motion failed to adopt Ordinance No. 2637 , the Q- '3
zoning was retained on the subject property. Zone Change No. E -7
was essentially the same as the present request to change the
zoning from Q-C3 to Townlot Specific Plan, Area One , Section 8 .
Attached for your review are the City Council minutes dated
SeplLi;mber 6 , 1983 .
ENVIRONMENTAL STATUS:
On August 1 , 1983, the City Council approved Negative Declaration
No . 83-18 , therefore , no additional environmental assessment is
required at this time .
ALTERNATIVE ACTION:
The City Council may consider denying Zone Change No. 83-5 which
would retain the existing (Q)C3 zoning on the subject property.

SUBEJCT: ZONE CHANGE NO. 84-2 located at the northwest corner of:

Zone Change No. 84-2 , a request to change the zoning on the subject
property from (Q)C3 to Townlot Specific plan, Area One , Section A, was
I continued by the Commission on March 6 , 1984 , to allow staff
additions` time for the revision and preparation of an ordinance to
include Lets 5 and 7 within the proposed zone change .
The ordinance has been revised to include Lota S and 7 , and the zone
change has been re-advertised for ten ( 10) days as: required by code.
Staff still recommends approval. of Zone Change No . 64--2 as modified by
staff to include Lots 5 and 7 . Approval of. Zone Change No . 84-2, as
recommended by staff , would change the zoning or. Lots 1, 3 , 5 and 7 of
Block 317 , Huntington Beach, 17*h Street Section from (Q)C3 to Townlot
Specific Plan Area One - Section B.
Attached for the Commission' s review are copies of the revised
ordinance , the staff report presented to the Commission on March 6 ,
1984, and the minutes from the March 6 , 1994 meeting . .
