Due to the lateness of the hour it was not possible for the Commission to review and discuss a possible treatment for the remainder of the properties originally included in the zone change . Staff' has been directed to retilrn the watter to the Planning Commission for its July 10, 1984 meeting , and a report will be forthcoming to the City Council after that review. This zone change request was processed through the Planning Commission as Zone Chanqe 84 - 3 , but has since been redesignated as Zone Change 84-3A due to a case number conflict with another zone change ordinance . RECOMMENDATION : Staff Recommendation : Staff recommends that the City Council approve Zone Change No. 84-3A from R3 to It 3- 20 by adoption of the attached orri i nance . Discussion: On November 28 , 1983 , the City Council approved a General Plan Land Use Element Amendment chang ir.q the land use designation in the Oakview Area from Medium, Density Residential to Medium High Density Residential. The arrtendmont was intended to bring the General Filar. designation into consistency with Lhe existing R3 zoning and to permit the development of the proposed Koledo Lane Im*rovement Project within the �.akview Redevelopment Area. The Cooncil was concerned , trciweve r , that the amenriment would permit higher densities to occur in thy- Oakview Area than presently exist. Because of 0is concern , LUE 83 -3 was approved on the condition that a zone chan-le 1 , 11niting densities, to 20 units per acre (R3 -20 ) be ini hated fer the Oakview Area. Zone Chanqe No. 84 -3A has been prepared in response to that direction. R3 zoning , when utilized in conjunction with a General Plan designation of Medium High Density Residential , will permit a density of 25 units per acre. The Oakview Area , �,hich has both R3 zoning and a Genera : Tian designation of Medium High Density Residential , is presently developed to an overall density of 18 units per acre . The proposed Koledo Lane 1. :o j eet is proposing additional units and rehabilitation of existing units And will have a density of 20 units per acre . The proposed :::me change to R3-20 will permit the Koledo Lane project to be completed and will limit densities In the remainder of the Oakview Area to 2U units per acre. The Planning Commission, however , in its review of the zone change request was concerns.-d about permittinq the density that R3.20 zoning would alloy.:. They felt that densities of 25 units per acre -2- 6--6-B4 - RCA could result if density bonuses were requested. The Planning Commission therefore recommended that the zone change ordinance be amended to specify R3-16 zoning with a maximum allowance of up to 20 units per acre with a density bonus. Staff does not concur with the Planning Commission 's recommendation. The existing overall density in the Oakview Area, at 18 units p^ r acre , dlready exceeds the Planning Commission' s proposed R3-16 zoning. Further , the City has not Solicited or received affordability commitments from the Koledo Lane property owners for the improvement project which will be developed at 20 units per acre . The 20 :nit per acre density incentive is to encourage upgrading of the neighborhood rather than ensured affordability . As such, R3- 10 zoning is the minimum zoning necessary for the project to continue . ENVIRONMENTAL STATUS : Zone Change No . 84 -3 was originally assessed throuqh Environmental Impact report No . 83- 2 whico was adopted by the City Council on November 28 , 1983 . Further environmental analysis is not required under the provisions of the California Environmental Quality Act . ALTERNATIVE ACTION : The City Council may consider denyinq Zone Change No . 84-3A and retaining the existinq R3 zoning with no additional limitation. On November 28 , 1963, the City Council approved Land Use Element Amendment No. 83--3 . The Cuunci1 was concerned , however . that the arendnent mould permit much higher densities to occur in the Oakview Area than presently exists .
