Recommendation, Analysis, Funding Soj+rce, Alternative Actions, Attschrronts: STATEMENT OF ISSUE: Transmitted for your consideration is Zone Change No. 54-4 , a request by Treat Western Savinqs to rezone approximately . 26 acres of property from R3 (Medium lligl- Density Residential.) to C4 (Flighway Commercial) . The subject property is located on the north side of Stark Avenue , approximately 150 feet west of Bf:ach Boulevard and is intended to be used as a parking lot for the Great Western Savinqs to be reconstructed on ad;oininq property zoned C4 . RECOMMENDATION Planning Ccimmiss'ion Action and Recom,nendation: The Planning Commission held a public: hearing on the zone. Change request on May 1 , 1984 . ON MMION BY WINCHELL AND SECOND SY LIViENGOOD ZONE CHANGE NO . 94-4 WAS APPROVED AND RECOMMENDED TO THE CITY COUNCIL FOR ADOPTION WITH THE FOLLOWING FINDING , Or THE FOLLOWING VOTE: AYES : Higgins , Winchell , Livengood , Forter , Mirjahangir NOES : None hBSENT : Ersk!Lne , Schumacher ABSTAIN : None Staff Recommendation : Staff recommends that the City Council adopt Zone Change No. it4-4 , changing the zoning designation on the Lubject property from R3 (Medium High Density Residential) to C4 (llighway Commercial ) . ANALYSIS: The subject property was the object of Use Perm : No. 93 -69/Condi'tional Use Permit No. 84-3 , both of which were approved MOW ft by the Planning Commission on February 22, 1 84 . The Use Permit was to allow constructior; of an 11 , 500 square foot financial building in a C4 zone, and the Conditional Use Permit was to permit a parking lot for the project in an R3 zone . Among the conditions of approval for both the Une Permit and the Conditional Use Permit: was the requirement that the applicant file for a zone change (with lot consolidation, if appropriate) from R3 to C4 at the time of taking out i)uildinq permits and prior to the issuance of a certificate of occupancy. Zone Change No. 84 - 4 is in response to that condition. Staff reLearc h has indicated that tie seven lots on which the project is located were recorded into parcel (Parcel Map 25-44 ) on November 10 , 1969. As such, nr, lot consolidation is necessary at this time . The R3 zoned portion of the property has been used as a parking lot since the original consolidation of lots in 1969 . There have been no complaints registered with the city during that period of time. The recently approved Use Permit anal Conditional Use Permit bith restrict use of the R3 zoned portion of the property to continued use as a parking lot . Even though the Genceal Plan designation on the subject property is Nigh Density Residential , the zone change to C4 is permissible under the City ' s General Plan. Section 3 . 4. 3 . 2 of the General Plan states that inconsiste:icies between honing and general plan designation are: permitted if the area in less than one acre. The subject property is . 26 acres. Staff foresees no problems related to general plan consistency of land use compatibility if the parking lot is rezoned from R3 to c:4 . ENVIRONMENTAL STATUS : Pursuant to Section 15150 of the California Environmental Quality Act guidelines , the proposed project is categorically exempt. FUNDING SOU:<E: No funds required . ALTERNATIVE ACTION : The City Council may deny Zone Change No. 84-4 and allow the subject property to be used as a parking with the Existing R3 toning as permitted by Conditional Use Permit No. 84-3 . The proposed subdivision for purposes of splitting one lot into two lots is consistent with the City' s General Plan. The property was studied and approved for this intensity of land use and for this type of residential structure at the time the R21 Medium Density Residential designation was placed on the property . SUGGESTED CONDI,rIONS OF APPROVAL 1. The tentative parcel map received by the Department of Development Services on March 23 , 1984 , shall be the approved layout . 2 . A parcel map shall be filed with the City and approved by the Departments of Development Services and Public Works and recorded with the County of Orange. A copy of the recorded map shall be filed with the Departments of Development Services and Public Works. 3 . At the time of new construction of dwelling units on the subject property , a common driveway shall be installed to service both developments . 4 . Grading and street improvement plans shall be provided to City standards at the time the parcel is developed. 5 . Water supply shall be through the City of Huntington beach water system at the time said parcels are developed. 6 . Sewage disposal shall be through the City of Huntington Beach sewage system at the time said parcels are developed. All utilities shall installed at the time said parcels are developed . The public hearing was opened . .Jerry Welch. representing Great Western Savings, said tie would answer any questions the Commission had . Seeinq there were none, the public hearing was closed. Commissioner Mirjahanqir asked staff if the lot consolidation was considered appropriate. Mr . Adams referred to Mr. Welch who stated that the lot consolidation occurred in 1969 .
