Alternatiw Actlo .Attachments: STATEMENT Of ISSUE : Zone Change No. 84 - 9 is a request to rezone 3. 0 acres at' a pnroperty located on the southeast corner of Pearce Drlv,. and Balsa Chica Street from R2 (Medium Density Residential District ) to C4 ( Highway Business District ) , This zone change request has Lezv processed concurrently with Area 3 . 3 of Lend Use Element Amendment 84 - 2 . The applicant has requested that the zone change be withdrawn . PLANNING C0WI SS ION ACTION AND RECOMMENDATION : The Planning Comelssion held a public hearing on the zone change request on October 16 , 1984 . On motion by Livengood and second by Schumacher Zonp- Change No. 84 -9 was approved to Q-C4 with the following conditions on the "Q" , and recommendcd to the City Council for adoption by the following vote : AYES : Higgins , Winchell , Livpngood , Porter , Erskine , Schumacher , Mirjuhfingir NOES : None ABSENT: None ABSTAIN : None Conditions on "Q" : 1 . Any future development will be subject to approval of a Conditional Use Permit by the Planning Commission. 2 . The proposed development shall be designed so that the building orientation is coirpatible with the adjacent residential areas . 3 . The proposed development shall not ingress nr egress or, to Pearce Street . 4 . The proposed development shall preserve the existing mature trees on site to the greatest extent possible. rw men S . Any future development of this site shall be designed in conjunction with the adjacent property zoned C4 to the south. FINDINGS : 1 . The C4 zoning is consistent with the recommended commercial designation iii Land Use. Element Aeendrent No. 84 -2 . Z . Rezoning the site to accommodate commercial uses would be compatible with surrounding land uses . At the City Council ' s direction , th-e Pla "%nins Commission reviewed the zone change request again on November 13 , 1984 to consider the applicant ' s request for withdrawal . On motion by Higgins and second by Schumacher Zone Change 84 -9 was recommended for withdrawal according to the applicant ' s request provided that any residential project proposed for the site be designed to take access off of Pearce Drive , by the following vote : AYES : jiiggins , Erskine , Schumacher , Mirjahanjir NOES : Livengood , Porter ABSENT: None ABSTAIN : None STAFF RECOMMENDATION : Staff recommends that Zone. Grange 84 - 9 be approved to Q-C4 with the findings And conditions as recommended by the Planning Commission at their Oc tobe: 16 , 1984 rare t i ng . If the City Council approves withdrawal of the Zone Change , staff would concur with the Planning Commission ' s recommendation that any residential project on the site provide access off of Pearce Drive. ANALYSIS Zone change Co. 84 -9 , was referred back to tLe Planning Commission for review of the applicants Bequest for withdrawal . Upon diseussicn , the Planning CommI ssion agreed to recommend approval of the request for withdrawal provided that any residential project on the site be required to provide access only froe Pearce Drive . The applicant presently ha!: approved Tentative Tract 12206 on the site which hss access off of Pearce Drive. That approval is under appeal to the City Council and 1s scheduled to be heard at the November 19 , 1984 meeting . Staff continues to feel that the site is anst appropriate for commercial use and has therfore recommended that area 3 . 3 of LUE 84-2 be approved :or a change to General Commercial . Consequently , staff also recommends that Zone Change 84-9 to Q-C4 also be approved . If the City Council approves the request for withdrawal of the item, staff would recommend that the Council deny the appeal of the planning Commissiol- 's approval of TT12206 and retain access off of Pearce Drive. To t PlA+ining Commission From: Development Services Date : November 13, 1964 Subject : LAND USk ELE•:MENT AMENDMENT NC. 64 -2 AREA 3 .3 PEARCf-BCLSA CHICA AREA AND ZONE CHANGE; NO . 84--9 on November 5 , 1984 the City Council reviewed Land Use Element No . 84-2 . prior to the meeting Council reviewed a letter from the applicant for Area 3 .3 . The amendment would redesignate 3 .0 acres located an the southeast corner of Bol sa Chico Street and Pearce Drive from medium denrsit} residential to general coamercial . In addition, Zone Cl:ang.i No. 64 -9 requesting a change from h2 to C4 was processed concurrently with the Land Use Amendment . The applicant indicated that he had decided that he would prefer to develope the site under the existing tedium density residential designation. Due to the fact that the Planning Commission recommended approval of the asrenoment and zone change at the meeting of %ctober 16 , 1984 the City Council referred this request for withdrawal back to the Planning Commission. The City Council directed that the Planning Commission review this request and report back to the Council by their November 19, 1964 meeting . In addition, the applicants request for residential subdivision ':en to t i ve Tract 12206 on the subject property has been appealed to the City Council by adjacent property owners . The appeal is scheduled to be heard by the City Count: i 1 an November 19 , 1984 . The applicant is redesigning the Froject to take access off of Bola Chica Street rather than Pearce Drive as approved bl the Planning Commission. This new design will be presented to the City Council as an alternative to the previous layout . Rezoning the site to accommodate commercial uses would be compatible kith surrounding lr.nd uses . STAFF' RECOMMENDATION: The staff recomr,enda t i on is identical to that of tho Planning Commiscion. AWALYSIS : The applicant , Ken Moody, has requested a redesignation of approximately 3 . 0 acres of land from R2 (Medium Lenaety Residential ) to C4 (Highway Commercial District ) to accommodate ra proposed commercial shopF: ing plaza . The site would contain 61 ,800 square feet of retail commercial uses , and would include 2 . 34 additional acres of existing commercially zoned property directly south of :he area of concern. The project would then be integrated M i th existing office and comra- rc i 71 developments to the south . The comprehensive nature of the project would allow the new commercial area tetween Warner Avenue and Pearce Street to meet the locational criteria specified in the Ceneral Plan . As indicated in the market study conducted for Land Use Element. Amendment too. 84 -2 , Area 3 . 3 , the site is capable of supporting commercial uses in conjunction with others that could develop on the Meadowlark Airport site . If the 3 .0 acre site was zoned for conmerc is 1 use and intended to bop a separate_ entity, it would be desirable to limit access to Pearce Street in order to reduce curb cuts along Bolsa Chica Street . If unavoidable , one access paint could be allowed on Bolea Chica Street as far south of Pearce Street as possible . To reduce impacts on the residential area to the north . one access point on Solna Chica Street would be desirable provided that the site is integrated with the commercial properties and developments to the south . A commercial zoning redesignation of the site would be compatible with the commercial areas to the south . balsa Chica Street an a major arterial would provide sufficient separation to make th.i site compatible with the tedium density residential area to the wee-jt . Proper building siting, setbacks , and buffering required under the C4 district will minimize impacts on the residential ereaw more closely located to the north and east . The proposed commercial designation can be additionally compatible with the low density residential neighborhood across Pearce Street, provided that during consideration of development entitlements , tingle-story and low intensity uses (such as the proposed nursery and existing vegetation ) are sited at the north end of the subject property. As indicated in Land Use Elemorit Amerndtk-.it No. 84-2 , the proposed two-story developtirnt of commercial uses on the stte will be similar to development heights in the general area , and will not obstruct airport operations at Meadowlark.
