STATEMENT OF ISSUE :
Zone Change No. 84 -9 is a rernest to rezone 3 . 0 acres of a property
located on the southeast corner of Pearce Drive and Bolsa Chica
Street from R2 (Medium Density Residential District ) to C4 Mghway
Business District) . This zone change request has been processed
concurreLt ly with Area 3 . 3 of Land Use Element Amendment 84-2 . The
applicant has requested that the zone change be withdrawn.
PLANNING COMMISSION ACTION AND RECOMMENDATION :
The Planning Commission held a public hearing on the zone change
request on October lb , 1984 .
On motion by Livengood and second by Schumach:.r Zone Change No. 84 -9
was approved to Q-C4 with the following conditions on the "Q" , and
recommended to the City Council for adoption by the following vote :
AYES : Higgins , Winchell , Livengood , Porter , Erskine ,
Schumacher , Mirjahangir
NaES : None
ABSENT : None
ABSTAIN : None
Conditions on 'IV :
1 . Any future development will be subject to approval of a
Conditional Use Permit by the Planning Commission.
2 . The proposed development shall be designed so that the
Euilding 'orientation is compatible with the adjacent
residential areas.
3 . The proposed development shall not ingress or egress on to i
Pearce Street .
4 . The proposed development shall preserve the existing mature
trees on site to the greatest extent possible.

5 . Any future development of this site shall be designed in
conjunction with the adjacent property zoned C4 to the south.
FINDINGS :
1 . The C4 zoning is consistent with the recommended commercial
designation in Land Use Element Amendment No . 84-2 .
2 . hezoning the site to accommodate commercial uses would be
compatible with surrounding land uses .
At the City Council ' s direction , the Panning Commission reviewed
the zone. change request again on November 13 , 1584 to consider the
applicant ' s request for withdrawal .
On motion by Higgins and second by Schumacher Zone Change 84-9 was
recommended for withdrawal according to the applicant ' s request
Provided that any residential project proposed for the site be
designed to take access off of Pearce Drive , by the following vote:
AYES : i:iggins , Erskine , Schumacher, Mirjahanjir
NOES: Livengood, Porter
ABSENT: None
ABSTAIN : None
STAFF RECOMMENDATION :
Staff recommends that , Zone Change 84-9 be approved to Q-C4 with the
findings and conditions as recommended by the planning Commission at
their October 16, 1984 meeting. If the City Council approves
withdrawal of the Zone Change , staff would concur with the Planning
'Commission ' s recommendation that any residential project on the site
provide access off of Pearce Drive .
ANALYSIS
Zone Change No. 84-9, was referred back to the Planning Commission
for review of the applicant ' s request for withdrawal . Upon
discussion ; the Planning Commission agreed to recommend approval of
the request for withdrawal provided that any residential ' project , z:.
the site be required to provide access only from Pearce Drive . The
applicant presently has approved Tentative Tract 11206 on the site
Which has access off of Pearce Drive. That approval is under appeal
to the Cit�j► Council and is scheduled to be heard at the November 19 ,
1984 meeting.
Stsff c6ntinues to feel that the site is most: appropriate for
commercial use and.; has therfore recommended that Area 3 : 3 of LUE
84-2 he approved for a chang.j to General Commercial . Consequently ,
staff also recommends tbat . Zone Change 84-9 to ,Q-C4 also be
approved. , If the City Councilapproves the request for withdrawal
of the item, s eEf. would recommend that the. Council deny the appeal
of the Planning , Commission 's approval of TTl1206 . and retain access
off of Pearce Drive.

I would Dice �o request that you not take action on LAND USE ELEMENT
NO . 84 -2/EIR 84-3 Zone Case No . 84-9 , at th : !, time , but to send it
back down to the Planning Commission for recLnsideration .
The reason I am requesting this action is as follows :
I filed for the zone change at the same time as my TT 12206 & CE 84 -05
because of the deadline date in do ! ng so with the city . During
these last few months , since filing , I have had a market analysis
done by Charles Clark , a planner here at the city , and have been
working with several brokers regarding developing this into a
commercial project . With the imput that has been r .c.eived from
those with experience in the development of strip shopping centers ,
I have been advised that this is not a good location and that the
price of the land is to high for the types of retail and commercial
development we would beable to put in .
Therefore , I have oecided to build ten four-plexs and cne tri -plex
apartment building as shown on TT 12206 . These btfildings are
appraised at approximately $730 , 000 . 00 each which is consistent
with the surrounding neighborhood .
In closing . I would like to state that I will be avaible to discuss
with any of you any questions you may have regarding my request to
withdraw my application for rezoning .

On November 5 , 1984 the City Council reviewed Land Use Element No .
84--2 . Prior to -the meeting Council reviewed a letter from the
applicant for Area 3 . 3 . The amendment would redesignate 3.0 acres
located on the southeast corner of Bolsa Chica Street and Pearce
Drive from medium density residential to general commercial . In
addi t on, Zone' Change No . 84--9 requesting a change from R2 tt. C4
. processed 'concurrently with the Land Use Amendment. The ar..?7 ca it
indicated that he had decided that he would prefer to develope tl e
site unde: the existing medium density residential designation.

Due to the fact that thF '' lanning Commission recommended approval of
the amendment and zone change at the meeting of October 16 , 1984 ;
the City Council referred this request for withdrawal back to the
Planning Commission . The City Council directed that the Planning
Commission review this request and report back to the Council by
their November 19 , 1984 meeting. In addition, the applicants
request for residential s:ibdivisi.on Tentative Tract 12206 on the
subject property has beer, appealed to the City Council by adjacent
property owners . The appeal is schediled to be heard by the City
Council on November 19 , . 1984 . The , applicant is redesigning tiie
project to take r ccess. off of Bolsa Ch tca Street rather than Pearce
Drive as approved by the Planning Commission. This new desig►.3 will

Staff recommends that the Planning Commission :
1 . Approve Environmental Impact Report No . 84- -
2 . Adopt by resolution Land Use Element Amendment No . 84--2 with
the staff recommendations outlined in Section 2 . 0 of this
report .
2 .0 BACKGROUND IVEORMATION :
Transmitted for public nearing are Land Use Element Amendment No.
84 2" and Environmental Impact Report No . 84-3 . The amendment
addresses two admtnastrakive items as requested by the City, and
three proposed changes to the General Plan Land Use Liagran; as
roques to d by the City and private property owners . The amendment
-onsists of the following recommended changeb :
Item 2 . 1 - Staff requests that a solid waste facility land use
designation be created in order to satisfy recent State
leigislatton regarding the siting of solid waste j
facAltttes . In' siting a solid waste facility the law
requires that 'loc.- ! agencies make a finding of
consistency with the general plan . In order for this to
d,ccur, the local jurisdiction must identify the facility
on . the,,land use diagram o; the land use.. element based on
findings of c.ompatibi1it;y, with surrounding uses . Staff
'recommends that policy language be created establishing
this - new 6esignation and that such f":cilitie' s meet the
following location criteria of being ,located within or
'predominantly surroundedby inaustrial and/or
public/quasi-public utility ;.,areas , and be in cloze
pru:cinlity to designated truc;; 'routen .

Item 2 . 2 - St.aft requests that policy language be added to the Land
Use Element to meet the requirement of State law which
provides that local general plans be consistent with
courity airport environs land use plans . Staff recommcnds
that the following policy Ianguage be added to the Land
Use Element :
"Any project which requires a notice of proposed
construction of alteration by IA the A, under FAR part 77,
shall submit a copy of the FAA application to the Airport
Land Use Commission (ALUC) , and provide the City with the
FAA and ALUC responses . If the ALUC requests review of
the project , then the project shall be submitted to the
Commission . Notice of any ALUC determination of
inconsistency, with the Commission ' s Airport Environs
Land Use Plan (AELUP) , must be given to the City within
60 calendar days from the date of referral of the
application to the ALUC, and .-hall be considered before
the City takes any action on the project. If the
Commission fails to give such notice of inconsistency
within that period, the proposed project shall be deemed
consistent with the ALLUP . "
Area 3 .1 - Ths'°'City--initiated request is to redesignate 4 .65 acres
located west of Mchols Street and approximately 1^0
feet south of Warner Avenue from General Indu�,, trial to
Solid Waste Facility. Staff recommends approval of the

Area 3 .2 -- The applicant' s request is to redesignate 10.4 acres
located west of Magnolia Street and, approximately 450
feet north of Warner Avenue from Genera]. Contmer^ial to
Mixed Development . Staff recommends that the applicant' s
request be denied, and that the site retain the General
Commercial designation. Zone Change No . 84-10 was
submitted by the applicant to be processed concurrently
with this land use amendment request.
Area 3 . 3 - The applicant' s request is to redesignate 3 .0 acres
located east of Bolsa Chica Street and south of Pearce
Street from IMedium Density Residential to General
Commercial . Staff recommends that the Planning .
Commission approve the applicant' s request to General
Commercial . Zone Change No . 84-9 was submitted by the
applicant to be processed concurrently with this land use
amendment request .
3 .0. ENVIRONMENTAL STATUS
Vend Use Element Amendment No. 84-2 was prepared to conjunction with
Environmental Impact Report No. 84-3 . EIR 84-3 was posted for a
45-6ay . revi.ew period , which ended on October 12 , 1984 . Written
comments and responses are contained in the LUL/EIR report .

The applicant , Ken Moody, 'has requested a redesignation of
approximately 3 .0 acres of land from R2 (Medium Density Residential )
to C4 (Highway Commercial District ) to accommodate a proposed
commercial shopping plaza . 'one silo would contain 61 , 800 square
feat of retail commercial uses , ano would nclude 2 . 34 additional
acres of existing commercial!;, zoned property directly south of the
area o 7 concern . The project would then :.je integrated with existing
office and commercial developments to the south . The comprehensive
nature of the project would allow the new con. r.erciZi. area between
Warner Avenue and Pearce Street to meet the locati.onal criteria
specified in the General Plan . As indicated in the market study
j conducted for Land Use Element Amendment No . 84-2 , Area 3 . 3 , the
site is capable of supporting commercial uses in conjunction with
others th i t could develop on the Meadowlark Airport site ,
If the 3 .0 acre site was zoned for commercial use and intended to be
a separate entOty, it would be desirable to limit access to Pearce
Street in order to reduce curb cuts along Bolsa Chica Street . if
unavoidable , one access point could be allowed on Bolsa Chica Street
as far south of Pearce Street as possible . To reduce impacts on the
residential area to the north, one access point on Bolsa Chica
Street would be desirable provided that the site is integrated with
the commercial properties and developments to the south .
A commercial zoni.na redesignation of the site would be compatible
with the comn:erci�l areas to the south . Bolsa C7iica Street as a
major arterial would provile sufficient separatio-1 to :Hake the site
compatible with the ureditun density residential area to the west .
Proper building siting, setbacks , and buffering .required under the
C:4 district will minimize impacts on the residential areas more
closely located to tae north and east . The proposed commercial.
designation can be additionally compatible with the low density
residential neighborhood across Pearce Street , provided that during
consideration of development entitlements , a i.ngle-story and low
intensity uses (such as the proposed nursery and existing
vagetat.lori) are sited at the north end of the subject propertf. As
in:icated in Lana Use Element Amendment No. 84-2 , the proposed
two-story dev,: lopment c,f commercial us-as on the s i t:e will be similar
to development heights L -•, the general area, and will not- obstruct
airport opor&t.ione at Meadowlark .

On October 24 , 1984 , the applicant submitted a letter reques tinq
that his reque;:t be removed from consideration . His rational is
that ae would prefer to go with development of a medium density
residential subdivision on the property. He received approval of
Tenta+ive Tract 12206 from the Planning Commission on September 18 ,
1984 . That approval is now under appeal to the City Council . 1E
the City Council removes Area 3 .3 from the Land Use Element
Amendment and refers it back to the Planning Commission as per his
request, then zone Change No . 84-9 should also be sent back .
Environmental Status :
The environmental impacts of. Zune Change No . 84-9 are addressed in
Environmental Impact Report No . 84--3 which also covers Land Use
Element Amendment No . 84-2. The City Council must approve EIR No .
84-3 before approving this zone change .
ALTERNATIVE ACTION:
The City Council may adopt the Planning Commission and staff
recomu:ondation, or modify as desired.

5 . 0 ISSUES AND ANALYSIS :
The applicant , Ken bloody, has requested a redesignation of
approximately 3 . 0 acres of land from R2 (bledium Density Residential ) to
C4 (Highway Commercial District ) to accommodate a proposed commercial
shopping plaza. The site would contain 61 , 800 square feet of retail
commercia) uses , and would incli.de 2 . 34 additional acres of existing
commercially zoned property directly south of the area of concern . The
project would then be integrated with existing office and commercial
developments to the south . The comprehensive nature of the project
would allow the new con►nercial area between Warner Avenue and Pearce
Streek to meet the •locational criteria specified in the General Flan .
As indicated in the market stud} conducted for Land Use Element
Amendment No . 84-21 Area 3 . 3. the site is capable of supporting
commercial uses in conjunction with others that could develop on the
Meadowlark Airport site .

If the 3 .4 acres site w-is zones for commercial Ilse and i ntenued to be a
separate entity, it would be desirable to 1 intit access to Pearce Street
in order to reduce curb cuts along Bolsa Cli i .a Street . if unavoidable ,
one access Foint could be allowed on Bolsa Chica St-r( set far south of
Pearce. Street as "possible . To reduce impacts on the Yesidential area
to the north , one access point can Belsa Chica Street would be desirable
provided that t:he site is integrated %vi. t.h the. con►merciil l;r.opertie_s and
deve lopmen is try the south .
A commercial zoning redesignation of the site would be compatible with
the commercial areas to the south . Bolsa Ch ica Street as a major
arterial would provide sufficient separation to make the site
compatible with the medium density residential area to the west .
Proper building siting , setbacks , and buffering required under the C4
district will minimize impacts on the residential areas more closely
located to the north and east . The proposed commurcia.l designation can
be additionally compatible with the low density residential
neighborhood across Pearce Street, provided that wiring consideration
of development entitlements , single-story and low intensity uses (such
as the lroposed nursery and existing vegetation ) are sited at the nortli
end of the subject property . As indicated in Land Use Element
Amendment No . 84-2 , the proposed two-story development of commercial
uses on the site will be similar to development heights in the geij .ral
area , and will not obstruct airFort operations at Meadowlark .
0 .0 RECOMMENDATION :
Staff_ recommends that the PI ann i ny Commission approve Zones Change No .
F34-9 with the following findings , for recommendation to the City
Council after action has been taken on Land Use Element Amendment No .
84--2 .

AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY AMENDING SECTION 9061 TO PROVIDE FOR CHANGE
OF ZONING FROM MEDIUM DENSITY RESIDENTIAL DIS-
TRICT TO QUALIFIED HIGHWAY COMMERCIAL L'-ISTRICT
ON REAL PROPERTY GENERALLY LOCATED SOUTH OF
PEARCE AND EAST OF BOLSA CHICA STREETS (ZONE
CASE NO. 84-9)
WHEREAS , pursuant co the State Planning and Zoning Law , the
Huntington Beach Planning Commission and Huntington Beach City
Council have had separate public hearings relative to Zone Case
No . 84-9 wherein both bodies have carefully considered all infor-
mation presented at said hearings , and after due consideration of
the findings and recommendations of the Planning Commission and
all evidence presented to said City Council , the City Council
finds that such zone change is proper , and consistent with the

NOWT THEREFORE, the City Council of the City of Huntington
Beach does ordain as follows :
SECTION 1 . The following described real property, generally
located south of Pearce and east of Bolsa Chica Streets , is hereby

said district map, as amended hereby is available for inspection
in the office of the City Clerk .
SECTION 3 . This ordinance shall, take effect thirty days after
its passage .

I would like to request that you not take action on LAND USE ELEMENT
NO . 84-2/EIR 84-3 Zone Case No . 84-9 , at this time , but to send it
back down to the Planning Commission for reconsideration .
The reason 1 am requesting this action is as follows :
I filed for the zone change at the same time as Py TT 12206 & CE 84-05
because of the deadline date in doing so with the city . During
these last few months , since filing , I have had a market analysis
done by Charles Clark , a planner here at the city , and have been
working with several brokers regarding developing this into a
commercial project , With the imput that has been received from
those with experience in the development. of strip shopping centers ,
I have been advi-ced that this is not a good location and that the
Price of the '. and is ;:o ii i gh for the types of reta i 1 and commercial
development we would beable to put in ,
Therefore , I have decided to build ten Four-plexs and one tri -plex
apartment building as shown on TT 12206 . These buildings are
appraised at approximately $ 730 , 000 . 00 each which is consistent
with the surrounding neighborhocd .
In closing , I would like to state that I will be avaible to discuss
with any of you any giestions you may have regarding my request to
withdraw my application for rezoning ,
