Staff supports the request because the rezone is consistent with General Plan, compatible with adjacent zoning designations and is the most appropriate zoning for the property based upon the use. RECOMMENDATION: Planning Commission Recommendation: PLANNING COMMISSION ACTION ON JUNE 14, 1994: THE MOTION MADE BY GORMAN, SECONDED BY RICHARDSON, TO APPROVE ZONE CHANGE NO. 94-1 WITH FINDINGS CARRIED BY THE FOLLOWING ROLL CALL VOTE: AYES: KERINS, GORMAN, INGLEE, DETTLOFF, RICHARDSON, NEWMAN, BIDDLE NOES: NONE ABSTAIN: NONE ABSENT: NONE MOTION PASSED _ I Staff Recommendation: Motion to: "Approve Zone Change No. 94-1 with findings as outlined in the June 14, 1994 Planning Commission Staff Report and adopt Ordinance Nol 24r ANALYSIS: Zone Change No. 94-1 is a request to rezone a 4,139 square foot lot from RI (Low Density Residential) to ROS-O (Recreational Open Space with Oil Productions). It was submitted in order to comply with Condition No. 2 of Tentative Parcel Map No. 94-124 which requires the lot be rezoned to Recreational Open Space. The two (2) lots designed for single family homes are not as deep and are wider than the original layout (see Attachment No. 3). In order to create a precise zoning boundary between the Seacliff Golf Course and the proposed single family dwellings, the Zoning Administrator required Seacliff partners to rezone the subject lot to Recreational Open Space which will restrict the use of the lettered lot to recreational uses. General Plan Conformance: The proposed zone change is consistent with the General Plan land use designation of Low Density Residential based upon the Zoning and Land Use Element consistency matrix which allows for ROS (Recreation Open Space) and O (Oil Production) designations in this land use category. In addition, the Land Use Element states that the City should maintain both active and passive recreation open space areas. The proposed zone change will retain recreation open space and will result in a net gain of a .095 acre increase in recreation open space. The zone change area is also contiguous to an area zoned Recreational Open Space which is greater than 20 acres in size. SUMMARY: The subject lot was originally intended to be used as part of a 13 lot subdivision. Upon re- evaluation of the location of three (3) single family residential lots and the proximity to the golf course, the applicant revised the original subdivision to create two (2) single family residential lots with a third lot (subject lot) for use as part of the golf course. The proposed zoning will be identical to the ROS-O (Recreational Open Space-Oil Production) zoning on the adjacent golf course. It will preclude use of the property as residential, or any other use other than those uses listed under Article 941, Recreational Open Space District and Article 968, Oil District. The golf course use of the property complies with the proposed zoning. Since the lot will be used in conjunction with the golf course, the most appropriate zoning is ROS-O (Recreational Open Space-Oil Production) rather than R1 (Low Density Residential). RCA 7/18/94 2 CD94-53 Environmental Status: The proposed zone change is categorically exempt pursuant to City Council Resolution No. 4501, Class 20, which supplements the California Environmental Quality Act. The result of the request will be to reduce the number of homes directly on the golf course north of Island Bay Lane from three homes to two homes (lots 1, 2 and 3) and to create more open space area. This change has been necessitated by the relationship of the homes to the golf course and the resulting potential interference problems with users of the golf course during play. This relationship became evident during final house plotting and review. Note that the location, amount and frontage of the open space view corridor at the end of existing Island Bay Lane remains unchanged. To make the above change to 1) reduce the number of lots and 2) return more open space to the golf course, requires modifying the tract map, processing a zone change and additional time to draw and process the map. On the May 16 , 1994, City Council Meeting, the Council voted to create a Committee to include Councilmen Silva and Sullivan with community input to study the issue of limiting vehicular access on Seapoint to Pacific Coast Highway. A few days later, I left phone messages for Councilmen Silva and Sullivan requesting that members of The Seacliff Coalition be included on this Committee . After all , The Seacliff Coalition is the primary party disputing the proposal to connect Seapoint to Pacific Coast Highway for all traffic. The Coalition cannot understand how any study on this issue can be conducted with any integrity without all primary parties participating. A few days after my phone messages were made, Councilmen Silva returned my call and talked to my wife Barbara, a member of The Seacliff Coalition Steering Committee . He told her that he would see to it that no member of The Seacliff Coalition would be on this Study Committee because he thought that members of The Coalition booed him at- the May 16 City Council meeting, which is probably true . The point of this letter to you is that The Seacliff Coalition insists that they be represented on this Study Committee. We are a group of highly educated professionals who can and will conduct ourselves with dignity and expect the same from Councilman Silva. And make no mistake, it is clear that Councilman Silva already has his mind made-up on the Seapoint issue . Unless he shows some sign of objectivity on this issue, he should expect no rounds of applause from the Coalition. It is our strong opinion that Councilman Silva would love to stack-the-deck on this Committee with Kohl representatives whom he clearly represents , even though as an elected official he is supposed to represent objectively the people of Huntington Beach. And with all of this, The Coalition believes that it can work with Councilman Silva on this Study Committee.
