Mayor Moulton-Patterson called the adjourned regular meetings of the City Council and the Redevelopment Agency of the City of Huntington Beach to order at 5:00 p.m. CITY COUNCIUREDEVELOPMENT AGENCY ROLL CALL PRESENT: Silva, Bauer, Moulton-Patterson, Winchell, Leipzig, Sullivan ABSENT: Robitaille (City Council) PUBLIC HEARING -ZONE CHANGE NO. 94-2 - ENVIRONMENTAL ASSESSMENT NO. 91-32 - CHANGE NAMES:VARIOUS ZONING DISTRICTS TO CONFORM TO PROPOSED ZONING AND SUBDIVISION ORDINANCE - DELETE COMMERCIAL DISTRICT SETBACK LINES FROM ARTERIALS - INTRODUCTION OF ORDINANCE NO. 3258 (450.20) The Mayor announced that this was the day and hour set for a public hearing to consider the following: APPLICATION NUMBER: Zone Change No. 94-2 APPLICANT: City of Huntington Beach LOCATION: City Wide REQUEST: To change the names of the various zoning districts to conform to the Proposed Zoning and Subdivision Ordinance which has been approved by the Planning Commission and the City Council and to delete commercial district setback lines from arterials as shown on sectional district maps. ENVIRONMENTAL STATUS: Covered by Environmental Assessment No. 91-32 COASTAL STATUS: An amendment to the Huntington Beach Local Coastal Program Implementing Ordinances will be filed with the California Coastal Commission following adoption by the City Council. The Community Development Director presented a staff report. Mayor Leipzig declared the public hearing open. t ~1+ Page 2 - Statement of Action There being no one present to speak on the matter and there being no further protests filed, either oral or written, the hearing was closed by the Mayor. A motion was made by Leipzig, seconded by Winchell, to approve Environmental Assessment No. 92-32, Zone Change No. 94-2 with findings for approval as outlined below, and approve introduction of Ordinance No. 3258 -"AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY CHANGING THE NAMES OF VARIOUS ZONING DISTRICTS AND DELETING THE COMMERCIAL DISTRICT SETBACK LINES FROM ARTERIAL HIGHWAYS AS SHOWN ON SECTIONAL DISTRICT MAPS (ZONE CHANGE NO. 94-2)." Findings for Approval -Zone Change No. 94-2 1. The proposed renaming of R1, R2, R3, R4, and MH to RL, RM, RMH, RH, and RMP, respectively conform with the Land Use Element of the General Plan because the density allowed within each district continues to comply with the goals and policies of the Land Use Element. 2. The proposed renaming of Oldtown District One and Two and Townlot Specific Plan Area One Sections A and B to RMH-A reflects the existing development pattern and is consistent with the proposed General Plan Update. 3. The proposed renaming of C1, C2, C4, and Sp-2 to CG; OP to CO; and VSC to CV conform with the Land Use Element of the General Plan because they represent the three commercial categories of commercial addressed in the General Plan. 4. The proposed renaming of M1-A to IL and M1 and M2 to IG conforms with the General Industry category of the Land Use Element of the General Plan. 5. The proposed renaming of ROS, S1, CC, and WR to Open Space subdistricts conforms with the Open Space categories of the Land Use Element of the General Plan. 6. The proposed renaming of zoning designations for properties used for public- semipublic purposes to Public-Semipublic is consistent with the Public, Quasi-Public, and Institutional category of the Land Use Element of the General Plan. 7. Deletion of-MHF suffix eliminates a conflict with the State Law which precludes a City requiring a zone change prior to allowing a manufactured home as a single family residence subject to specific criteria established by the State. 8. Deletion of-PD and -SR suffix will allow planned developments and senior developments in any residential district subject to compliance with the base district provisions. 9. Renaming the various Specific Plan developments to substitute the plan name with a number which is representative of the order of adoption results in a more efficient and less cumbersome method of identification on the zoning map. The Zone Change will change the names of the various zoning districts to conform with the new zoning district names in the new Zoning and Subdivision Ordinance, which has been approved by the Planning Commission and by the City Council, and it will remove all commercial district setback lines from arterials as shown on sectional district maps. The zone change will reduce the number of base districts from 22 to 13 with subdistricts for different densities or geographic subareas. Suffix designations will become overlay districts as stipulated in the new Zoning and Subdivision Ordinance. RECOMMENDATION: Motion to: A. "Approve Zone Change No. 94-2 with findings for approval;" and B. "Adopt Ordinance No. 3 a? The base zoning districts fall into six (6) categories: residential, commercial, industrial, open space, public- semipublic, and specific plan. A. A base zoning district designation, indicating the principal land uses permitted or conditionally permitted in each zoning district. For example, RL (Residential Low Density). B. A subdistrict designation, indicating a geographic area of the city where specific zoning provisions and development standards apply. For example, -WR(Water). C. Overlay district designations will be added to a base district zoning district if the provisions of one or more overlay districts are applicable to a site. Base district designations will include an R for all residential districts, C for all commercial districts, I for all industrial districts, OS for all open space districts, PS for public-semipublic district, and SP for specific plan districts. The zoning designations will be abbreviations of the district, subdistrict, and overlay district names. For example, a lot currently zoned Townlot Specific Plan-Area One-Section `A' combined with oil (TL-A-O) will be renamed to Medium High Residential District small lot with Oil Overlay (RMH-A-O). The Low Density Residential District (RI), also cited in Section 9060 of the Zoning Ordinance as Single Family Residential District, will be officially changed to RL Low Density Residential. Currently the existing development pattern and allowable density in the Oldtown and Townlot areas is consistent with the density allowed in the Medium High Residential District; therefore, these districts will become subdistricts of the Medium High Residential district. Properties zoned Mobilehome (MH) and developed as mobilehome parks will be renamed Manufactured Home Park which is consistent with the term used by the State of California. Residential district designations will be abbreviations of the district names, RL, RM, RMH, RH and RMP. Because the Zoning Ordinance does not include these suffixes, -SR, Senior Residential, -MFH, Manufactured Home, -CD, Civic District, and -PD, Planned Development, they will be deleted. Lastly, the zone change will remove all commercial district setback lines from arterials as depicted on the sectional district maps. Zoning setbacks will be regulated in the zoning ordinance, not on the zoning map. General Plan Conformance Renaming of the zoning districts will be in conformance with the General Plan Land Use Element. It is the intent of the zone change to make all densities consistent with their General Plan designation. Environmental Status: Negative Declaration No. 91-32 was approved by the City Council on September 20, 1994, in conjunction with Code Amendment No. 91-20, Zoning and Subdivision Ordinance. Coastal Status: An amendment to the Huntington Beach Local Coastal Program Implementing Ordinances will be filed with the California Coastal Commission following adoption of the proposed Zoning and Subdivision Ordinance by the City Council. SUMMARY: • Renaming and consolidating zoning districts reduces the number of zoning districts. • Renaming the zoning districts eliminates the misunderstanding as to the number of residential units that may be constructed or permitted on a residential site or the intensity of development allowed in commercial or industrial districts. • Removal of the commercial setback lines from the sectional district maps eliminates the possibility of disseminating misinformation and allows the zoning ordinance to dictate the required zoning/development standards applicable to a site. All commercial district setback lines from arterials as depicted on sectional district maps are hereby deleted. The Director of Community Development is hereby directed to amend all sectional district maps of the Huntington Beach Ordinance Code so as to reflect the changes contained in this ordinance. The Director of Community Development is further directed to file the amended maps. A copy of such maps, as amended, shall be available in the office of the City Clerk. SECTION 2.
