the City Planning Commission, recommending approval of Zone Case 270 .
This case proposes to- amend--the Huntington Beach Ordinance Code to
not prohibit certain structures in tbe setback' of commercial or
indus"trial developments thus allowing such structures as pump islands ,
signs; and " attached- canopies to" be erected within the setback area
under' the provisions` of- their respective zones .
The City Planning ,Commission held a public hearing on the matter on

7 WHEREAS, The Ulty Planning Caau aesion of the City of

9 compliance «izb the Statas Government Code in order to consider
10 and review Zone Case 270 A Kesclution of Intent of the City
11 Planning Commission to not prohibit certain structures in the
12 Setback area of cav=ercial. and industrial developments , and
2.3 WHEREAS, The City Planning Commission has determined that
14 this addition to the Huntington Beach Ordinance Code is necessr
15 to preserve the morale of the developers of these commercial
16 and industrial developments and still provide the City with the
17
necessary setbacks for the main structures on the lots to in-
sure the prosperity snd growth of the City.
19 NOW THEREFORE BE IT RESOLVED,

to R-3 Limited 'multiple Family Residence District and C-4 Highway Cor:: .
mereial District with setback provisions ,
The City Planning Commission held a pubI.�c hearing on the matter
on September 18, 1962 , ' at which time two people spoke in favor of the
proposed zone change and displayed various sketches of the proposed
development . Ei�ght people spoke against the proposed zone change . Al
so
presented was a petition signed by over 300 property ovmers protesting
the change .
By unanimous vote of the City Planning Commission, Zone Case 273
was denied and recommended to your Honorable Body for denial .
If the City Council concurs with the Planning Commission' s recom-
mendation, the Code provides that the petition may be denied by the
Council without holding a public hearing .

Transmitted herewith is a copy of Resolution No 274, a resolution
of the City Planning Commission, recommending denial of Zone Case 274.
This case proposes to change the zone on property situated at the
^outhwest corner of Main Street and Delaware Street from R-5 Professional
District to C-2 Community Business District with setback provisions .
The City Planning Commission held a public hearing on the matter
on September 18 , 1952, at which time one person spolce in favor of the
proposed zone change ; one person spoke against the proposed zone change ;
and one person read a letter opposing the zone change .

Please be advised that the applicant does hereby appeal the decision of
the Planning Commission and request chat said City Council set the
matter for a public hearing consistent with the municipal ordinances of
the City of Huntington Beach and the state laws applicable thereto.
This appeal is made on the grounds that there was no evidence to support
the decision of the Planning Commission; that no findings were made in
connection with the- decision in denying said zone change; that all property
owners affected by this zone change were in favor t}1ereof; that there were
