Deer Doyle : At the last council meeting the question of .one Case 286 was postponr.d for two weeks to determine the rights of the oil lessee who objected to this change . It is a welt' established rule that a municipal- ity has the right to regulate the business of operating oil wells within Its limits and to prohibit their oper- ation within delineated areas and districts. )3ut ordi- nances having that effect m»St be reasonable and must be for the purpose of protecting the public health , corn- fort, safety and. welfare. In light of the facts , as •wte have been able to determine , the change in question would be valid. It appears that the lessee acquired his interest over 15 years ago and has done little or nothing to develop the property. Also, the change seems to be consistent with the zoning program of the area. The ina,lor portion of the surrounding land is apparently also A-5. Mr. Fred Brown, the o•ner of the property, intends to be at the next council meeting to state his views In favor of the change.
