Gentlemen: j Transmitted herewith is a copy of Resolution No 418 , a resolution of the City Planning Caamission recommending denial of Zone Case 418. This case proposes- to changge the zone on SO acres of land situated at the northwest corner of Coldenwest' Street and Heil Avenue from A-I-X General- Agri. ultural District as adopted by interim Ordinance No 668 to R-2 Two Family. Residence District. This case was continued from the February 18, 1964, meeting of the Planning Commission. at the request of the applicant. The City Planning Commission held a continued public hearing on the matter on May 19 , 1964, at which time one person spdka in opposition to this request and the applicant explained his plans for the property. By unaninious - vote of the City Planning Commission, Zone Case 418 was denied and recommended to your Honorable Body for denial.. The protests were aimed at the requested R-3 Zone across - a channel from the single family homes . By majority vote of the City Planning Commission, Zone Case 419 Leis recommended to your Honorable Body for adoption of a C-4 Zone rather than the requested C-3, and denial is recommended on the portion .requested for R-'3. Thr L the findings of the Plannin{�O Commission of b the City of Huntington Beach are erroneous , are not supported by any evidence, and are against the weight of evidence adduced be- fore the Commission, and are against the recommendation of the Planning Staff of the City of Huntington Beach.. 2 . That the City Council has previously zoned to R-3 large tracts of land lying immediately westerly and easterly of the parcels owxied by the undersigned, and that the result of the action of the Commission in denying undersigneds ' petit-ion will result in an island of industrial property surrounded to the west, north, east and southeast by R-3 limited multiple family residence districts . 3 . That the claimed increase in school costs as a re- suit of the use of the undersigneds ' property for limited multiple family residence purposes will be negligible as compared with in- creased elementary school population occasioned by the recent re- zoning to R-3 of the parcels owned by the Deane brothers immedi- ately to the west and immediately to the east of the parcels covered by zoning case No. 423 . 4. Although the subject property has been zoned for light industrial use combined wit'r oil production for many years , the oil production has almost completely stopped on petitioners ' lard and in the adjacent area to the north. Although both of the undersigned have- diligently attempted to induce light industry to come in, no interest has been secured and there are no pros- pective industrial tenants or users of the property„ Denial of 1 the change of zone requested results in petitioners being unable ! to use their property for any beneficial purpose and results in deprivation of their property without just cause or excuse and without due process of law. 5 . At the hearing before the planning Commission, no opposition of any ad j Lining rroperty owners occurred, and the sole opposition came from the Elementary School. Board artd from a rep- resentative of the. Independent Oil Producers Association who merely requested that in any change of zone the oil production usage be retained . 6 . It is respectfully submitted that the subject pro- perty will produce far more tax revenues for the City of Hunting- ton Beach if petitioners are permitted to use their property, and no use other than R-3 limited multiple family residence dis- trict uses will result in any improvements being placed on the property.
