RE : RESOLUTION N0 418, a resolution of the City Planning Commission
recommending denial of Zone Case 418 .

Transmitted herewith is a copy of Resolution No 418 , a resolution of the
City Planning Caamission recommending denial of Zone Case 418.
This case proposes- to changge the zone on SO acres of land situated at
the northwest corner of Coldenwest' Street and Heil Avenue from A-I-X
General- Agri. ultural District as adopted by interim Ordinance No 668
to R-2 Two Family. Residence District.
This case was continued from the February 18, 1964, meeting of the
Planning Commission. at the request of the applicant.
The City Planning Commission held a continued public hearing on the
matter on May 19 , 1964, at which time one person spdka in opposition
to this request and the applicant explained his plans for the property.
By unaninious - vote of the City Planning Commission, Zone Case 418 was
denied and recommended to your Honorable Body for denial..
The Code provides that a public hearin sjiall be held on the matter
after which an ordinance may be adopted effecting the change or it may
be denied:

This case proposes to change the zone on approximately 37 .7 acres of
land from- R-1 Single Family, Residence District to R-'3 Limited Mul"-iple
Family_ Residence District"` and C-3 General Business Distract with
setback provisions-"in the vicinity of Lhe Huntington Harbour sales
of f ice
This case was continued from the meeting of February 18 , 1964, in
order to give the , property- owners in the area time to discuss the
matter with �he applicant, Huntington Harbour.
The City Planning Commission held a continued public hearing on the
matter on March 17 , 1964, at which time a letter from the applicant
was read evnl.aiytingg t'r�e propona1. A representative of the applicant
and one other- gentleman were in favor of the request , A p`t:.tion was
read opposing' the request and several homeowners in the development
i were present °to protest. The protests were aimed at the requested
R-3 Zone across - a channel from the single family homes .
By majority vote of the City Planning Commission, Zone Case 419 Leis
recommended to your Honorable Body for adoption of a C-4 Zone rather
than the requested C-3, and denial is recommended on the portion
.requested for R-'3.
The Code provides that a public hearing shall be held on the matter
alter which an ordinance may be adoptsd effecting the change .

Transmitted herewith is a copy of Resolution No 420, a resolution
of the City Planning Commission recommending approval of Zone Case 420 .
This case proposes to change the zone on 19 acres of land situated
660 feet south of Hamilton Avenue on the west side of Brookhurst
Street from 1-1-1-A Restricted Manufacturing District to R-3 Limited
Multiple Family Residence District .
The CityPlanningg Commission held a P ublic hearin on the matter on
Februar

It was the consensus that since a condominium type development was
planned for the property, it could better be considered as a variance .
The City Planning Commission held a public hearing on the matter on
March 3, 1964, at which time two gentlemen opposed the request ; one
I� gentleman asked for c larif:.cat ion; and a representative of the
` applicant explained the request .
By unanimous vote of the City Planning Commission, Zone Case 422 was
denied and recommended to your Honorable Body for denial .

Gentlemen:
Transmitted herewith is a copy of Resolution No 423 , a resolution of
the City Planning Commission recommending denial of Zone Case 423 _
This case: proposes to change the zone on approximately 15 acres of
land situated 660 feet north of Hamilton Street extending west from
Newland Street from M-1-0 Light Industrial District combined with oil
production to R-3 Limited Multiple Family Residence District .
The City Planning Commission held a public hearing on the matter on
Marcie 3, 1964, at which time the applicant and one person were in
favor of the proposer. ; a representative of. the Huntington Beach
Elementary School District was against increasing the density of the
area; and a gentleman representing the oil prcducers association asked
that the "oil" designation be retained .
By unanimous vote of the City Planning Commission_. "Zone Case 423 was
denied and recommended to your Honorable Body for denial .
The Code provides thcat a public hearing shall. be held on the matter
after which an ordinance may be adopted effecting the chlange or it
may be denied .

owners respectively of Lot 11 Tract No. 811, and Lots No . 1
through 30, inclusive , in Block C, Tract No . 876 , all in the
City of Huntington Bach, County of Orange, State of California,
beir_g persons aggrieved 'by the action of the Pi a-Ining Commission
of the City of Huntington Beach in de..y"i:ng their Petition for
Change of Zone from M-1-0 Light Industrial District combined with
oil production to R-3 Limited Multiple Family Residence District
at a hearing of said Planning Commission held on Tuesday, March
3, 1964 . It is respectfully requested that the Honorable City
Council hear the Appeal of the undersigned, that a time and place
be set for a public hearing on their Appeal, and that proper
notice be given by the Clerk of the City of Huntington Beach
and by the City Council thereof of the time and place of such
public hearing.
In, support of their Appeal, the undersigned urge the
following grounds in support thereof:
1 . Thr L the findings of the Plannin{�O Commission of
b
the City of Huntington Beach are erroneous , are not supported by
any evidence, and are against the weight of evidence adduced be-
fore the Commission, and are against the recommendation of the
Planning Staff of the City of Huntington Beach..
2 . That the City Council has previously zoned to R-3
large tracts of land lying immediately westerly and easterly of
the parcels owxied by the undersigned, and that the result of the
action of the Commission in denying undersigneds ' petit-ion will
result in an island of industrial property surrounded to the west,
north, east and southeast by R-3 limited multiple family residence
districts .
3 . That the claimed increase in school costs as a re-
suit of the use of the undersigneds ' property for limited multiple
family residence purposes will be negligible as compared with in-
creased elementary school population occasioned by the recent re-
zoning to R-3 of the parcels owned by the Deane brothers immedi-
ately to the west and immediately to the east of the parcels
covered by zoning case No. 423 .
4. Although the subject property has been zoned for
light industrial use combined wit'r oil production for many years ,
the oil production has almost completely stopped on petitioners '
lard and in the adjacent area to the north. Although both of
the undersigned have- diligently attempted to induce light industry
to come in, no interest has been secured and there are no pros-
pective industrial tenants or users of the property„ Denial of 1
the change of zone requested results in petitioners being unable !
to use their property for any beneficial purpose and results in
deprivation of their property without just cause or excuse and
without due process of law.
5 . At the hearing before the planning Commission, no
opposition of any ad j Lining rroperty owners occurred, and the sole
opposition came from the Elementary School. Board artd from a rep-
resentative of the. Independent Oil Producers Association who merely
requested that in any change of zone the oil production usage be
retained .
6 . It is respectfully submitted that the subject pro-
perty will produce far more tax revenues for the City of Hunting-
ton Beach if petitioners are permitted to use their property,
and no use other than R-3 limited multiple family residence dis-
trict uses will result in any improvements being placed on the
property.

Honorable City Council of the City of Huntington Beach set a time
and place for the hearing of this Appeal and that at such hearing
the City Counr-;.1 reverse the action of the Planning Commission and
grant the Petition of the undersigned for a change of zone from

This case proposes to Change the Zone on approximately 50 acres of
land situated at the southeast corner of Adams Avenue and Brookhurst
Street from A-1-Y General Agricultural District as adopted by Interim
Ordinance No 672 to R-2 Two Family Residence District , The yurpose
of the request is for construction of 106 four-plexes on a portion
of a tract originally proposed for single family homes .
The City Planning Commission Feld a public hearing on the matter on
March 3, 1964, at which time the developer and his agent spoke in
favor of the petition and a representative of the Huntington Beach
Elementary School District spoke against increasing the density in
this area. The school District pointed out that the school site now
being purchased from the applicant would be obsolete and inadequate
if the additional uni 4s are permitted .
By unanimous vote of the City Planning Commission, Zone Case 424 was
denied and recommended to your Honorable Body for denial .

The Commission noted that most of the request is in compliance with
the adopted Master Plan for the area . It was the consensus, however,
