Since your Honorable Bony has more or less e-tablished u policy of not setting bearings on zone cases which have been recommended for denial, I had cet for hearing only items 1 , 2, j and 5. 1 should have ploced item 4 on the Agenda with the recommendation of denim from the Planning Commission to be Dcted upon separately, but I Failed to do +hi.s. A V.er discussing the matter with the City Attorney, I tam includ- inn on this meeting's Agenda, the recGm mendution of denial on item It A4 of Zone Case 66-51 for your consideration. Under previous Councils , who set public hearings on all Zone Cases transmitted to them with either a recommendation of approval or of denial , they interpreted that an applicant who had a recommendation of denial given them= by the Planning Commission , had as much right to a public hearing on his matter as an applicant who received a recommendation- of approval. However , the Subdivision Code only requires that public hearings by the Council be held cn those Zone Cages recommended by the Planning Commission for approval ; and does not require that a public hearing mu.-it he set on a. Zone Case on j which the Planning Commission has recommended denial-, (stating, I believe , that the Council may summarily deny the Zone Case in such circumstance without- holding 'a public hearing. ) The present Council indicated early in the ,year that , since procedure for appeal to the City Council to any recom3nendation of the Plan- ninp; Commission- on a Zones Case is set forth in the Ii.B . Ordinance Code , they felt that the setting of a public hearing on a Planning Commission recommendation of denial should be accomplished through the filing by the applicant or other interested party of an appeal in the manner prescribed: Recently the Council , through adoption of Ordinance No. 1231 , authorized the City Clerk to set all public hearings , and I have continued- -to use the foregoing procedure to justify the need for such hearing I believe this is proper- procedure. Howover if the Council directs any ge chap ' in the handling of Zone Cases it will be followed to the letter.
