I As perhaps ycu kncwr, the Peck family interests In the Huntington. Beach area go way back to the days of Anaheim Sugar Compa:iy . i,[hQn the sugar business was given up , decades , ago, much of its land was acquired by my deceased father-in-law., who had been a founder and prin- cipal shareholder. The properties we still own in the area go back to that date . Ply late husband, Aldrich Peck, and I retained these properties during the many intervening years , leas- ing them out for agricultural use . This produced a mini- mal return, cnuch below that whicb might have been d2r�.ved from other types of investment . We adjusted our standard of living to this situation. Tragically, my ht?sband ' s death occurred when Orange County was on the verge of an era of great change and development . r- After Mr . Peck ' s decease my cotrustee and I. with the help of real estate experts , Engineers end pro- f essior_al planners , determined to devote the largest ;parcel of the property to the deve:. opment of a beautiful industrial park, and to lease this park to many industrial tenants , thereby providing for my descendants a steady and reliable source of income while at the same time providing a substantial asset for the Huntington Beach area . - Toward this end we . on May 95 1958, caused the property to be annexed to the City of Huntington Beach #2 - The Honorable City Council - 3/30066 City of Huntington Beach because we believed ghat having the property included with- in the city limits of this progressive ; yell-administered city would be not oni.7 conducive to its development b'jt also of benefit to all proper,y ovmers in the area . We engaged Quinton Engineers to make a thorough study of the parcel, and to plan the introduction of util- ities , the lay-out of streets and railroad trackage , the i installation of drainage and sewer, and other related items . They advised that for various reasons the development, improvement and utilization of the property should begin at the north, and grow toward the south as demand should :Jar-- rant . We adopted and have followed this advice . 1 At all times since the industrial zoning was � granted , through R. A . Rowan & Company and others , we have j made every effort to procure substantial tenants for our industrial park. Our efforts were described in the testi- mony before t -e Huntington Beach Planning Commission . These efforts have resulted in the acquisition of one major and substantial tenant , Douglas Aircraft Company, but have otherwise so far been a failure . We believe that the failure to procure additional tenants is the result of two factors : The first factor is the very substantial compe- tition with respect to industrial sites in tre area, par- ticularly the Irvine Ranch . The existence of this competi- tion is of course completely beyond our control . The second factor discouraging additional indus- trial tenants is the fact that we determined not to offer industrial sites for sale but only for long-term leas: . It is important to note that even if we should be other- wise inclined to deviate from this policy, tax considera- tions absolutely preclude any such deviation. Should we enter into a program involving the sale of industrial tracts in -the normal course of business, the proceeds from sucl. sale would be subject to ordinary income taxes , rather than. capital gains taxes, with the result that most of what Mr . peck and I. and previously his father, have built up these many years would be lost . i ,F - The Honorable City Council - 3/3C,/66 City of Huntington Beach Our industrial park: now contains approximately 440 acres of undeveloped property . The southerly 165 acres of this property constitute the subject of our application for rezoning. According to the ad v ice we have received from authorities in the field of industrial development , there is no reasonable probability that these 165 acres will be developed for industrial use in the pre- dictable future . There is just tors much industrial proper- J ty available in the Orange County area at the present time , particularly in view of the fact that our property can be offered only for long-term lease . At the same time we are by no means pessimistic concerning the development of the remaining northerly 275 acres of our industrial tract . This northerly property is re aLively well-situated and is close to -the Douglas de- velopment . We believe with the continuation of our serious efforts to lease the property, coupled with our offer to construct the required facilities at our cost, we will relatively soon be able to effect substantial industrial development, in this northerly area . On the other hand , as stated , we are firmly con- vinced teat the southerly 165 acres will not be indus+rially developed within the foreseeable future . Under these cir- cumstances , it is possible for us to terminate our invest- ment in these 165 acres withouti adverse (vfhieh is to say, ordinary income ) tax consequences if, but only if, the entire acreage is sold in :one piece . F We are certainly aware of the fact that the tax base of the City of Huntington Beach would be improved_ if this property were to be sold to an industrial user . This would also certainly be a p.ef Arable course from our stand- point . Please be assured than we have thoroughly investi- gated this possibility and that we are firmly convinced there i.s , and will be, no such industrial purchaser avail- able now or in the fore{ -cable future . The only possible Ftype of purchaser for this property at the present time is a developer who is able to subdivide the property . As you know, we have found such a purchaser in Doyle Development r Company . In reluctantly reaching our decision to abandon our plans for the industrial development of these 165 acres # - The Honorable City Council - 3/30/66 City of Huntington Beach we have considered, among others , the following facts : 1 . There are available in the fore- seeable future no industrial lessees, and no one industrial prrchaser, for the subject property. 2 . The subject property is virtually surrounded by residential property and is therefore appropriate for R-1 zoning. 3 . The development contemplated by Doyle Development Company involves homes in the middle-price bracket, attractive to Junior and middle executives . We feel that this will enhance our possibilities of industrially developing the northerly %75 i acres . 4 . Any increased burden on the Huntington Beach School System will be offset by an in- crease in the tax base . It seems to us com- pletely useless to compare tnis ' increase in the taf base and its effect upon the school situa- tion with the results of industrial development of the property . We are convinced that in the foreseeable future there is not going to be any industrial development of the property, and therefore the appropriate comparison is between residential property and bare land . 5 . We reed large amounts of cash if we are to continue to offer to construct, at our expense, industrial facilities for potential lessees of the remainder of the industrial park. In order to accommodate the Douglas Aircraft Company development, it has been necesoary for us to invest additional amounts of cash in excess of $1,000,OOC . We frankly need this sale to Doyle Development Company,`' to replenish our cash reserves . I have been very impressed over these many years vrith the spirit of cooperation which has prevailed between #5 - The Honorable City Council - 3/30/66 City of Huntington Beach us and the City of Huntington Beach . Although I am not a resident of your city, I own a great deal of property within your city limits and for that reason I tun as interested as you are in the orderly and successful development of Huntington Beach . The action taken by the Planning Commission was improper in that, through great and excessive speculation as to the "where" and "when" of a proposed new Huntington Beach Freeway, and what effect should be given to the � Master Plan of the City of Huntington Beach, the subject property did not receive a full, fair and lawful hearing on the merits . { It is therefore respectfully requested that a hearing be held at the earliest possible moment to permit the City Council to hear evidence in support of the proponents ' request and to allow the City Council an opportunity to reconsider the Planning Commission decision and rezone the property as requested .
