During recent Planning Commission hearings on this and other zone changes it has been pointed out by Mr. Ray Miller that the area con- cerned was validated for drilling activities by an initiative measure several years ago. Mr. Shibata has given the opinion that if this were true, it would take a vote of the people to effectuate validly any zone change restricting drilling rights. At the date of the passage of this zrne case, Mr. Shibata had not yet completed his research, so the question remained unsolved. I have recently found the date of this election. it was held Novernbe.^ 16, 1926 and it validated for drilling all areas then within the City except- ing only Fire Zone #1 and an area along `.::e beach. I urgently request that the first reading of the Ordinance concerning this be continued until the effect of the election of November 16, 1926 can be determined. I also again request that consideration be given to the Constitutional problems that this ordinance raises: 1 . It singles out and discriminates against one section of the oilfield without affecting other large areas of the oilfield. 2. It impairs the obligations of contracts. Here I would like to submit a rebuttal to Mr, Bush's suggestion that the Re- zoning does not, in fact, interfere with the contractual re- lation of Lessor and Lessee, I. 9.J that interference might only occur if the Lessee were not granted a variance to drill. I submit that the necessity and uncertainty of obtaining a variance alters the contractual arrangements in a very substantial way. In most cases, it was a part of the consideration for the lease that the Lessee had a right to drill, both presently and in the future, on the demised property.
