'T%e Planning Commission otigina►lly heard the matter at their August 5, 1969, meeting. At that time, the Planning Commission continued action on Zone Came No. 69-22 to February 3, 1970, and approved a portion of the conditional exception. The Action to approve the conditional exception was appealed to the City Council and was ultimately denied . No further action was taken on Zone Case No. 69-22 because of the continuance to the February 3,:d meeting. 3 . in Their denial of the conditional exception, the City Cotti ci.l indicated that. this was rot a proper utth of the property* . 4. Later on the agenda, the Planning Commission will consider Use Permit No . 69-69, which was referred to the Commission by the Board of Zviing Adjustments . Oct6ber 7., 1969 This case was continued from the Septmber 16 , 1969, meting to allow time for a study of the zoning and land -use potential -of the area to be conducted. This study was presented to the Planning Comoaission ,at their September 23 , 1969, Study Session. At that time, the Staff outlined major land use features in the area as well as the problems of zoning. The disposition of the rotary mud dump was also discussed by the Stuff. It was pointed out that the Edison Company was contacted to determine whether or not they would be agreeable to allow rotary mud, from the rotary crud dump to be spread up over their property and mixed with fill, thereby making the rotary mud dump available for future dev- elopment. The parcel is located at the southwest corner of Magnolias St. and Heil Ave. Megaolia St. is a prirary arterial hi& ay. Heil Ave. between Magnolia St. and Newland Ave. has been dropped as an arterial highway; however, its its extension east of Magnolia and west of Newland it is classified as a secondary arterial. highway. The property consists of approximately four acres of land. It is zoned R1 and master planned for low-denr:ity resi- dential . 2. The San Diego Freeway abuts this parc*1 on the south which vir- tually isolate' s it from the remainder of the City. The property to the north is in the City of Westminster at�i the property to the oast: is in the City of Fountain Valley. There is a awll neighborhood shopping :acil.i.ty at the northwest corner of Hail Ave . and Magnolia St. and the ramaining property on the north side of Heil Ave. is used for singla-family residential purposes . Property at the northeast: corner of Heil. The neighborhood shopping center at the northeast corner of Heil Ave. .and Magnolia St . adequately serves the surround- ing area and there is no real need for additional shopping .faellities . The introduction of a new shopping facility at this location would tend to serve as a detriment rather than . ! `W an asset to the ecmmerical property to the north. Also , Sail Ave.., at this location., is not an arterial highwV, therefore, the property would be fronting on a local street as well as an arterial highway with primary es:nosure being to a local atreet. 2* The appli.oant has indicated that this property was the subjeot of a land exchange with the City- of Westminster at which time the Oity of Westminster indicated that a commercial zone for this property was appropriite. A contact with the City of Weatminster Indicates that no normal application was submitted; however , the property owmer was not discouraged from filing a request for commercial. Although the property does not have ideal access from th3 freeway, it does front on MuSnolla St• which is su arterial highway therefore exposure would be sufficient. Also, this facility could. aupplement the uses not available in the shopping facility to the north. In view of this information, the Staff recommende approval of the multiple family portion of tbe request and does not have a recommendation as to the disposition of the commerical. portion of the request.
