STAFF REPORT ZONE CASE NO. 70-9 Applicant : Westloar Co. Date : April 21 , 1970 The Staff has reviewed Zone Case No. 70--9 and offers the following informa-I. ion for your consideration. 1 . The property is situated on the south side of McFadden Ave . , approximately �00 ft. east of Gothard St. It consists of 15. 62 acres of land which is zoned M1 and Master Planned for light industrial . It is situated north of the Huntington Center east of the railroad right-of-way. me a g gy. 2., 'Due to the severe traffic congestion in the vicinity of the ffi,%tingtou Center, it is the opinion of. the City Staff that a secondary means of nace©s to the Huntington Canter is required; therefore, access through this parcel is necessary. The applicant has submitted a plan which was reviewed by the Staff indicating a proposed street to connect McFadden Ave. with the rear entrance of the Huntington Carter. 3. Tho applicant has indicated that the surrounding community and acroage is zoned residential and couimerctal. which tends to indicate that the existing M1 zone is misplaced and that the ;parcel in question lends itsQl.f to residential income devalopmont because of it) - immediate location in respect to the Huntington Center, Golden West Collage and the San Diego Freeway. 4. It is possible that the M1 mane is out of context with the surrounding uses, however, it is the consensus of the Staff that prior to rezoning this property for any purpose , the Plann{ng Commission should be convinced that the propertj cannot be developed for industrial or commercial purposes. It in the understanding of the Staff that the property immediately to the east, which was owned 'by -the stake Division of Highways t was sold and the new property owner anticipates construction of one or two movie theatres . The applicant has indicated that the planued residential income community would. &leo produce an excellent window of oxposure for the Huntington Beach area due to the elevation and traffic pattern of the San Diego Freeway. It was the feeling of the Board that it is in the beet interest of all of the people within our community to do everything we can to preserve our tax base. Please !�e advised that this office represents the Westlear Company . We are advised that on June 1 , 1970 zone cage 70-9 was open for public hearing . At that time either the Clerk or the Mayor indicated that the applicant Westlear Company by and through Mr , Owen M . Powell , Vice President, explained to the City Council the reason for the request for an exten- sion of time to June 15 , 1970 . We have further been informed that Mr . Powell addressed the Council with respect to the continuance only . We have also been advised that at nr time during the hearing did the Honorable Mayor and the City Council request from the floor any discussion with respect to the pro ,and eons of this appeal , nor did the Council take an), action on the request for the extension of time. Although the undersigned has not been able to review the minutes of the June 1 , 1970 meeting of the City Council , it would appear that from the information furnished me , if such is the case , than the appeal applicant was not given due process of law in that he was not allowed nor requested to speak on the merits of, the case nor was his letter of May 26 , 1970 requesting a continuance , acted uyon . Although there was substantial discussion regnrdinL, the Southerly 267 ' of the frontage, we were, in the final analysis of the Planning Commission ' s ,judgment, denied commercial zoning . We have studied all of the property extensively . It is one of the most difficult nrope.rtics that we have ever contemplated , Twenty- two (22 ) test hole; that we have studied all show substantial amounts of peat . The rear of the prop.-,--y , as analized by Soils j Reports made available to your Public Works Department and Flenning Staff, prove that no ether use for the rear of the property is con- ceivable. The Planning; Commission agrees with us on that fact . We respectfully invite ,your attention to the fact that we are faced with improvement costs of the Mobile Home Park which are so excess- ive that we must generate a higher value on all of the frontage. The economics of the development are such that all or none of it be developed. If we took the position that we m.us'; have all cinmerci.al on the front- age, or that we would give the property back to the Seller then, in the event you agreed with the Planning Commission, none of the prop- erty would be developed . The zone cast pro- poses to change the zone on the property located on ; the west side of Brookhurst St . , 800 ft , south of Garfield Ave . , from C2 Community Business District and RA Residential Agricultural District to R5 Office-Professional Dist-rict and C2 Community Business District with a 50 ft . setback from the ultimate right-of-way line . The property is located on the west side of Brookhurst Street approximately 800 ft. mouth of Garfield Ave. and consists of approximately 14 acres of land. 2 . This application was originally heard by the Planning Commission at their March 17 , 1970 meeting at which time the Commission also considered a conditional ex- ception to establish a mobilehome park on subject property .
