It consists of 15 . 78 acres of land that is zoned Rp and master planned for medium density residen- tial development . 2 , The property is within the proposed alignment for the Coast Freeway. 3 . Algonquin St . , a proposed secondary arterial high- way, wi11 parallel the freeway to the southwest and be routed through the suh,;ect property. 4 . Property t.:: the north is developed as a mobile- home park. Property to the east is zoned R2 and is vacant . Property to the south across Heil Ave . is developed as A school site and a future park site ,. Property to the west is developed as a medium density residenti&l development . 5. The criteria for approving an appl Lcat i on for A Mobileho-ne Zone is as follows : A ) Thp relationship of the Proposed mobilr:- home park to surrounding lAnd use . b) Soil conditions . c ) Access to the area under consideration . ( It is ppreferred that such area abst an arterial higl:wriy from which the primary means of access shju Cd be obi.A ined . ) d) The minimum site area shall not be less than ten ( 10 ) acres . With regard to criteria (a ) , it should be noted that a mo•bi1ehome park is adjacent to the north boundary of the subject property. The property is situated on the northeast corner of Holland Dr. and Beach Blvd. It consists of 5 . 60 acres of land and is zoned C4 Highway Commercial . 2 . The property is abutting single family homes to the east and north, Beach Blvd . to the west and vacant commercial property to the south across Holland Dr. 3 . Holland Dr. is a 60 ft. wide collector street serv- ing the single family subdivision to the east . 4. The parcel in question, with the exception of the no,. :...- -� y 264 ft . was master planned for high den- sity residential but changed to highway commercial by Muster plan Anandment No . 66-2 . This action was taken to have the Master plan reflect existing zon- ing patterns . The parcel it question was allowed to remain in the C4 classification because if was held under one ownership and it was the consensus that a better project would result if allowed to develop as one parcel . 5 . This application has been filed because the appli- cant proposes to construct a 144 unit apartment com- plex. 6 . Applications to permit an apartment complex on this property have been before the Planning Commission on three different once.sions . The first .request, Zone Case No. 68- 53 , proposed to rezone this property, with the exception of the northerly 264 ft . , and th,B 3 . 59 acre parcel. on the south side of Holland Ave . , to R3 Limited NbItiple Family Residence District . The staff re;ommended approval of the R3 sore except for the east 100 ft . which was recommended for an R2 zone . The Planning Commission denied the request and gave the following reasons for their action: 1 . The' use will result in a traffic problem on Holland Dr . and within the subdivision to the east . 2 . There is no traffic signal located on Holland Dr . and Beach Blvd . The second application, Zone Case No . 69-40 was heard by the Planning Commission on January 6 , 1970, and essen- tially proposed the same request as Zone Case No. 66-53 . The Planning Staff informed; the Courission of their de- cision on Zone Case No. 68-53 and that their decision was unanimously upheld by the City Council . The staff further pointed out that conditions in the area did not substantially change since the matter was originally heard by the Planning Commission and City Council , and , therefore , recommended denial. of Zone Case No. 69-40 . The Planning Ccxmaission denied Zone Case No. 69-40 and gave the following reasons for their action: 1 . The use will result in a traffic problem on Holland Dr. 2 . There is no traffic signal located at Holland Dr . and Beach Blvd . 3 . The property is master planned for commercial . The third application pertaining to this property was Conditional Exception No . 70-27 . This application ex- cluded the 3. 59 acres on the south side of Holland Dr. and included additional property to the north. Conditional Exception No. 70-27 proposed the construction of 144 apartment units in the C4 zone . ?.lie matter was to have been considered by the Planning Commission at their May l9, 1970, meeting; however, it was noted that the Planning Commission could not take action because one year hnd not passed from the time the Planning Commission and tEe City Council denied Zone Case No . 69-40; therefore, the matter was taken off the agenda. 'rhis action was taken pursuant to the provisions of the Mintirgton Beach Ordinance Code requiring a one-year time lapse between the date of a decision to deny a torte change application and the time a new application for condi- tional exception is filed . With respect to the application presently before the Planning Commission, Zone Case No. 70- 11 0 it is the consensus of the staff that conditions have not sub- stantially changed . We now wish to appeal -the decision of the planning commission and present our stand to the City Council . We acree to a meeting on the 8th of September, 1970. Our reasons for appealing this decision rest primarily on the fact that ours is a clear case of proper zoning on a property that has very little commercial value.
