Date : January 5, 1970 The staff has reviewed Zone Case No, 70-26 and Conditional Exception No. 70-65 and offers the Following information ` for your consideration: 1 . Both requests pertain to the same parcel of land and will be heard concurrently at the Janu,-,.c , 5th meeting; therefore , one report has been prepared to cover both items . 2, The zone change application is a request to rezone approximately 3 .09 acres of land from RA Residential Agricultural to C4 Highway Commercial . The condi- tional exception application is a request to permit the construction of a medical-dental complex and c small convenience- type shopping center on the same property. 1 . The property is situated on the northwest corner of Yorktown Ave . and Brookhurst St. and is master planned for low density residential development. i 4 . Zoning and land use of adjacent property is as follows : North - ?,one - RA - Use , Mobilehome Park East Across Brookhurst St. - Zone - R1 ; Use - Single Family homes South across Yorktown Ave, - Zone , R1 ; Use - Single family homes West - Zone - R1 ; Use - Vacant 5. An application for the same use was approved by the City in January 1967 and again in June 1969, When the Planning Commission first heard the request, it was pointed out that sail conditions were such that pilings were required to support all stxuctuves, The fallowing reasons were given by the Planning Cornmis,Aon for their action: a) Soil problems exist on tha subject property, b) The proposed construction will back up to an existing trailer park. c) the parcel is not suitable for R1 construction because of its size. Upon approval of the application, pilings were installed ; however, the applicant did not proceed with the project. The application therefore became null and void . In 1969, a new application was sub- mitted can the property to permit the same use. A building permit was obtained; however, due to economic considerations the proje^w was again de- layed and the appW.ation became null and void . The applicant has once again requested permission to proceed with the project in the form of Conditional Exception No. 70-65 and Zone Case No. 70-26 . (The zone change was Filed upon advice of the staff to have the zoning conform to the use. ) The applicant has ' indicated that this time they will be proceeding with the project as planned. Reasons given by the Planning Commission for approv- ing the conditional exception in 1969 are as follows: a) A hardship has been proven on the subject property. b) Soil conditions in the area are such that pilings are required to support all structures and said pilings are In place. c) An application for the same use was previously approved by the City . 6. It is the consensus of the staff that the applicant has deomorstrated sufficient hardship to justify • 0 ill , the granting of Conditional Exception No . 70-65; therefore , the staff recommends approval of Conditional Exception No. 70-65 upon t;i following condition: 1. John Anderson, stated that he is concerned with the proposal , because the area is already crowded with multiple development. Mr. Anderson stated that he would like to see what the developer is proposing. Chairman Slates informed Mr. Anderson that the Commission cannot consider plans at this time , because it is a zone change application, but that a use permit application would have to be approved for the apartment development and residents in the area would be informed when the application is heard. Taube DaLp : December 1 , 1970 The staff has reviewed Zone Case No. 70-25 and offers the following information for your consideration : 1 . The properties included in this request are situated on the south side of Hamilton Ave. , approximately 500 .Et . east of Dushard St . 2 . This request involves rezoning two separate par- cels of land: Parcel no . 1 is a 52 . 34 x 151 . 59 ft . lot containing . 18 acres of land . It is presently zoned C4. The applicant proposes to rezone this parcel R2 . Parcel nc: 2 is a 95 ft . by 197 ft . lot containing . 42 aucr.es of land fronting on Hamilton Ave . It is presently zoned R2 . The ap- plicant proposes to rezone this parcel C4 . 3 . When this corner was first zoned commercial , the Commission expressed concern over rezoning that portion of the property designated "parcel 1 " because of its relationship to adjacent property and because it would be isolated from the main portion of the parcel . It was pointed out by the applicant that this part of the property would be used for parking purposes and would tie in with a church parking lot that was proposers to the east ( the church is no longer interested in the property and an apartment project is proposed) . It appears that the applicant proposes a land exchange to provide for the easterly extension of the commercial zoning resultirg in a more orderly development of both the commercial pro- perty and the R2 property . i i i I 4 . We have seen the taxes increase constantly on a basis of commercial value yet are unable re, sell to a business venture. The council should be asked if they would desire to have their residence located on that parcel. We would like to.know the source of Mr. Duke' s information as we have never had the opportunity of rebuffing an offer from a nursery school. Any and all offers are a matter of record with the R. D. Slates Realty Company as they have been our sole agents for the property, and each offer has been rescinded due to denial of zoning. We. are enclosing a copy of a letter written in 1964 to the Planning Coanlis lion stating facts regarding the property. The zoning request accompanying this letter was denied. We would hope that if the council again denies the zoning request that they attempt to lower our taxes in order that we can Mold the property and ke p it weed free as we will never have any use for it. Ayers & Son) DATE: December 1 , 1970 The staff has reviewed Zone Case No. 70-23 and offers the following information for your consideration: 1 . The property is located at the northwest corner of Brookhurst St . and Atlanta Ave. It is zoned RA-0 and master planned for low density residential development. The parcel has approximately 120 ft . of frontage on Atlanta Ave. and approximately 180 ft. of frontage on Brookhurst St. 2 . This application has been requested because the appli- cant desires to relocate their offices along with Niguel Interiors , a carpet store for their customers ot. this corner. 3 . Tentative Tract No, 7019 has been approved on this 40 acre parcel . The subdivision as approved in- cludes this area as future single family lots . 4 . This property is located at the intersection of a major arterial highway (Brookhurst St . ) and a pri- mary arterial highway (Atlanta Ave . ) . Usually the cornerc at this type of intersection are zoned for commercial purposes . However, this policy was not carried through at this intersection because of the general land use pattern in the area . Approximately 10 acres of lard located at the southeast corner of Atlanta Ave . And Brookhurst St . was originally master planned for commercial development . However, approximately 9 acres were rezoned for single family development leaving a 1 . 19 acre parcel of land for commercial use, at the corner of Atlanta Ave . and Brookhurst St. and approximately 1 . 26 acres of land are zoned for commercial purposes on the northeast corner of this intersection. The staff has opposed rezoning small parcels of land for commercial purposes 5 . Approval of an R5 zone at this intersection will result in two of the corners being zoned for commercial use , one corner being zoned for pro- fessional use and the fourth corner being zoned Rl Single Family Residence District . The Planning Commission considered an application to reaone the southeast corner to CZ and R5 in March of 196E. The application was denied. 6. It ie the consensus of the staff that this corner can be developed in a manner that will be compatible with the surrounding uses . However, the major difficulty is that this parcel also has frontage on a local residential street. In order to be assured that the layout on this parcel will be compatible with the single family residences, the plot plan should be reviewed by the Acard of Zoning Adjustments . This presents a difficulty in that the R5 zone does not require an Administrative Review prior to issuance of building permits and the applicant may obtain a building permit without such review.
