This application Is a request to rezone approximately Ll .^..^S'eR =f land from RA Residential Agricultural to C4 Highway Commercial. The property is located at the southwest corner of Talbert Avenue and E-�r:ch Boulevard. 2. This Ar-&4 is a portion of approximately 20 acres of land that has been subdivided into lots that are 25 feet by 50 feet in size. The applicant has been successful in acquiring approximately 11 acres of these lots and proposes to develope them into a Farmer' s Market type of retail outlet. 3. The plans submitted by the applicant has included 4 lots which have not been included in the legal description accompanying the application nor are they shown on the latest adopted Tax Roll as being owned by either of the applicants. Three of the lots are located in the extreme northwest corner of the parcel having 50 feet of frontage and 75 feet of depth. The fourth lot is located within the building complex. This matter should be discussed with the applicant before a decision is made on the ?one change. 4. The area is master planned for medium (tensity and high density residential development. However, the master plait is presently being reviewed and this property Is tentatively designated for commercial use along Beach Boulevard to a depth approximr-tely 600 feet. The land u3e for the remainder of the Property has not been determined. 5. Property to the south is zoned C4 to a depth of 660 feet. 6. The zoning and land use of the property in the surrounding area is shown on the attached mar. 7. Based on the previous studies conducted by the Planning Department there appears to be sufficient commercial zoning in this area with an excessive amount of commercial zoning along Beach Boulevard. Most of the zoning along Beach Boulevard is presently vacant; however, the size of the parcals are such that they would not be able to accoirmdate it facility such ao that proposed by the applicant. 1 r Staff Report Zone Case No. 71-14 Page 2 B. The configuration of the -property in question is such that a 200 ft. wide strip of land will extend westerly of the established boundary to the south foc a distance of approximately 540 ft. This configuration could result in problems With surrounding land use. 9. It is the consensus of the Staff that the westerly boundary of the commercial zoning should align as close as possible with the com- mercial zoning, to the south, and that the portion extending westerly of that boundaryshould be deleted from the zone change at this n8 time. If at some future date the applicant is able to acquire or enter into an agreement the property owners to the north for development of this property a cut=ercial zone could then be applied to the entire area if a need was demonstrated. In view of the above information, the Staff recommends approval of Zone Case No. 71-14 excepting therefrom the westerly 540 .feet. Rather, our objection is that tho proposed rezoning will render it impossible to proceed with present development plans Viich are feasible and desirable , and :-,hich would rc- sult in a residential development which would be, an asset to the City of Huntington Beach. This request is consistent with the Counci.l ' s I recent action concerning property located at Newland and Atlanta. There the 'ouncil retained R• 2 zoning on pro- perty that is less suitable for townhouse development than the Property at Magnolia and iltlimta. !.Iagnolia i.s a pri- mary street, while Newland is orily a secondary. Miller in connection with the proposed re-zoning of a parcel of real property located within the City of Huntington B--a, h. The subject property is presently zoned R3 and, as part of Zone Case No. 71-13 , a change of zone to R2 has been proposed . A Resolution of Intent recommending said zone change was approved , over our client ' s objec- tions, by the City Planning Commission on June 15 , 1971 . The chairman of the Planning Commission, after approval of said Resolution of Intent in Case No. 71.-13 , orally announced that any parties desiring to appeal said decision of the Planning Commission must file an appeal within ten days „ however , in telephone conversations with Willis Mevis , Huntington Beach Deputy City Attorney, on June 18, 1971, lie indicated that no formal appeal was necessary because any zone change must be -considered and approved by the City Council . A reading of Huntington Beach City Ordinance No . S . 9880, requiring appeal from "any decision, determination or requirements of the Planning Commission, " leaves some doubt in our minds as to the required procedure to be followed to protect our client ' s interests . Our client intends to present his objections to said proposed zone change to the Huntington Beach City Council and, to the extent that an appeal is necessary to preserve his right to do so, this letter is intended to and shall constitute such a notice of appeal . A raquest for a reasonable continuance of said meeting to enable our client ;:o substantiate and document his objec- tions to the proposed change of zoning was denied . By this letter , we respectfully request that this office , as counsel for the aforesaid interested party, be given adequate: and reasonable advance notice of the date Zone Casa No . 71-13 is scheduled for public hearing before the Huntington Beach City Council . We Further request that , pursuant to ordinance S . 9882 a copy of the written report submitted to the City Council by the Planning Commission be forwarded to this office . In a telephone conversation on June 21 , 1971, Mrs . Wentworth of the City Clerk ' s Office advised us that such report will not be available until one week prior to the City Council hearing . Obviously, this does not afford our client sufficient opportunity to study said report and prepare a meaningful response in opposition thereto . We widerstand that the Council for the City of Huntington Beach will consider. Zone Case Number 71-13 at its regular meeting of July 19 , 1971 . Our clients are the owners of approximately thirty (30) acres within Study Area A, located at the intersection of Magnolia Street and Atlanta Avenue (the "Property" ) . Recently our clients entered into an agreement for the sale of the Property to Presley Development: Company ( "Prosley" ) , and development plans have been formulated for the construction of residential townhouses can the Property. The present zoning of the Property is R-2 which permits the eonstructi.oa of townhouses 'as contemplated by Presley. Under the amended Master Plan, the Property would be rezoned to R-1 which does not permit the proposed Presley development. The purpose of this letter is to set forth the reasons we believe the proposed change is inadvisable and inappropriate with respect to the subject Property, and to request your consideration of this matter as a separate agenda item at your meeting of July 19 , 1971 . Throughout Southern California, and all other areas of the nation marked by high population growth , there is an increasingly strong demand for residential communities #2 - The Honorable George McCracken - 7/14/71 suited to the needs of: the young married and the retired segments of our population. In 1960, the average Ameri- can was 33 years old; by 1970, the average American wan- under 25 years old. During the same period, an increas- ing number of Americans were able to take advantage of retirement plans. Many of these healthy and active re- tirees, their families now gro;,m , have gravitated toward the desirable climates of the Southeast and West , parts-- culavly Southern California. Concurrent with this explosive demand for middle income residences, there has been a minor revolution in the design and construction of residential, units . Increased environmental awareness has resulted in attempts to design and construct residential units which maximize open green space and which provide coamiunity amenities such as recrea- tion centers , swimming pools , tennis courts, gymnasiums , and exercise rooms. increases in land costs construction costs , financing and interest rates have made it extremely difficult: for a large segment of our population to purchase a single family residence. Yet many responsible mombers of that segment of our population desire to own their own residences for financial and social reasons , and they de- sire to he contributing members of the community. In the opinion of many real estate developers , including Presley, a well-designed and constructed townhouse development will provide one answer to this significant market demand. A number of studies have demonstrated that, townhouses of the nature proposed by Presley not only pay their own way in taxes to the community, but in an overwhelming number of cases, contribute monies above and beyond what it costs the local conununity to service the development. The property in qu6stion is presently used; for oil production, and there are eight wells on the property . 'these wells are quite old and represent an aesthetic blight in the area. The terms of the sale of the property to Presley require that a substantial sum of money be paid to the operator of the oil wells on the Property in order to terminate the drilling, and remove the existing derricks , pumps and pipe lines. Only the economics of a townhouse development Justify the large cost of terminating the oil lease and paying for the removal of the equipment. A single family residential development will not provide an investment return suf ficiont to bear this cost. Since the immediately adjacent property consists of a City park, Edi - son High School and a proposed new elomentary school, it • #3 - Tho Honorable George McCrac}:en - 7/14/71 is obvious that continued oil production is not compatible with these: improvements . Furthermore, the property is perfectly suited for townhouse development. It is situated on two primary streets, both of which are master planned for. 100 foot right--of-way. One corner of the intersection has already been developed as a coiitmun.ity shopping center and one other corner is presently zoned for commercial uses. From the view of appropriate and desirable urban planning, a townhouse development is an excellent land use to provide a buffer zone between this high intensity land use and the surrounding single-family residential development . tie recognize that, in the final analysis , the desirability of the proposed development by Presley can only be deter- mined by a review of the development plans. Unlike every other property owner who was heard at the Planning Com- mission meeting of June 15th, our clients have already spent significant sums in contemplation of the :Unmediate development of the Property. Our objection is not based upon a speculative loss of value caused by the rezoning . Rather, our objection is that the: proposed rezoning will render it iinpossible to proceed with present development plans which are feasible and desirable , and which would re- sult in a residential development which would be an asset to the City of Huntington Beach. This request is consistent with the Council ' s recent action concerning property located at Newland and Atlanta. There the Council retained R-2 zoning on pro- perty that is less suitable for townhouse .development than the Property at Magnolia and Atlanta. Magnolia is a pri- mary street, while Newland is only a secondary. further the Newland property is surrounded by single--family houses , while the Property is bordered by commercial and other high intensity uses. At the July 19 Council meeting and prior to the 4 to , l vote approving said Resolution , the Hunt- ington Beach City Attorney, Don P. Bonf.a, Esq. , orally advised the Council that its only alternatives in considering said zone case were to approve, reject or modify said Resolution and, if modified , the entire matter would have to be resubmitted to the Plann g Commission . It was our impression that Mr . Bonfa advised the Council that it could not modify a portion of said Resolution and approve the remainder. We respectfully disagree with that legal conclusion and believe that it was on the basis of said opinion that the Council , over Mayor McCracken ' s dissenting vote , denied our request that the R--3 Parcel owned by our client be excluded from the Resolution so that it might receive further study taking into consideration several unique factors attributable to that particular parcel . Mr . Willis Mevis of the City Attorney ' s Office, has advised us that the City Attorney prepared , at the request of the City Council , a Memorandum of Law as a result of the confusion that arose at the July 19 , 1971 City Council meeting . We have not , of course, seen that Memorandum but we respectfully call SLAVITT, EDELMAN , WEISER, AND BRADY -2- August 10, 1971 A LAW CORPORATION the Council 's attention to the following statutory law and case authority which bears directly on the question at issue: 1 . Government Code Section 65857 , with respect to modification or sapproval of recommenda- tions of the Planning Commission , provides as follows : "The legislative body may approve , modify or dis;..rprove the recommenda- tion of the ;planning commission ; provided that any ,nodifieation of the proposed urdi.nance or amendment by the legislative body shall first be referred to the planning commission for report and reconunendation, but the planning commission shall not be required to hold a public hearing thereon . Failure of the planning commission to report within forty (40) days after the reference, or such longer period as may be designated by the Legislative body, shall be deemed to be approval of the proposed modification . " 2 . Millbrae Ass ' n for Residential Survival v . Cityof Millbrae, 25 C.A• d 222 , 69 Ca1 .Rptr .251 1968 the Court interpreted the foregoing statutory provision by holding as follows : "In the instant case . the planning Commission approved the rezoning of eight separi%'tely designated sections , each containing specific acreage , from R-1 to PD. These rezonings were submitted by the Planning Commission to the City Council with a recor:_nendati.on that they be adopted but the Council saw fit: to rezone only one of the sections ., Accordingly, since the Council. could have rezoned all eight of the sections the ordinance rezoning section A (Ordinance No . 182 ) was merely an ordinance of lesser scope than that which it might have enacted. (See Bailey v. County of Los Angeles, 46 Cal . 2d 132 , 138-139, 293P . 2d 449. ) The SLAVIT1; EDELMAN , WEISER AND BRADY -- 3- August 10 , 1971 A LAW C0RPORA71O140 ICouncil, therefore , did not make any change with respect to the recommended rezoning of Section A but adopted the rezoning of that section as recommended by the Planning Commission . In our view, the failure of the Council to rezone the other seven sections as recommended by the Planning Commission did not amount to a "change" in the Commission ' s recommendations since each parcel was the subject of separate rezoning. Therefore, since no change was made by the City Council with respect to the recommended rezoning of Section A a referral to the planning Commission pursuant to former section 65655 was not required . " We believe that the City .Council , had it chosen to do so, had the clear legal riqht to exclude our client ' s parcel of property and approve the zone changes recommended by the balance of the planning commission Resolution . No law would have been violated and no party would have suffered any prejudice by such a result . Our purpose in writing this 'letter is to set forth our position that we believe the Council. acted in the midst of a somewhat confusing Lituation at the July 19 , 1971 meeting and to ask for a reconsideration of the merits of our appeal . We have: been advised that the first reacting of Ordinance No. 161�54 took place on August 2 , 1971 and that it is scheduled for adoption before the City Council on August 16 , 1971 . We respectfully request that prior to adoption of said Ordinance , due consider- ation be given to our request that our appeal be reopened for further hearing . The city has been divided into several study areas. Study Area "A" is that portion of the City generally south of Garfield Avenue and east of Beach Boulevard. Study Area "B" is north of Coast Freeway and east of Edwards Street. Study Area "C" is northeast of Coast Freeway and west of Edwards Street„ Boundaries of the remaining study areas have not been determined. The subject zone change proposes to rezone several parcels within Study Area "A", to confo m to the proposed Master Plan of Land Use. The master plan was reviewed by the Planning Commission at several study sessions. It was agreed that zone changes would be initiated by the Planning Commission to conform with the proposed plan, rather than adopt the master plan with inconsistent zoning.
