Re : Area "D" Zeno Case 71-20
Dear Mayor McCracken :
Mrs . Sterling and I own one acre (five lots , each '1401x601 )
in Area "D" fronting on Warner Avenue between Lynn and Hoskins
Streets , one: and one--half blocks from active commercial properties
and large scale apartments .
Our property frontage ( two of the five lots ) will be reduced
to a width of only 30 ' when Warner Avenue is widened , and further,
part of our property has already been designated by the State as
fronting on the approved "On Ramp" of the Coast Freeway (See Map
in your files ) .
Mrs . Sterling and I, as well as other owners of undeveloped
lots lying within Area "D" were shocked to learn of the "Resolution
of Intent " on the part of your Planning Commission to rezone our
properties downward , thereby destroying their existing value . Our
investigation shows that as little as thirty-two ( 32 ) acres out
of the total Area "D" would be devalued including our lots . Numerous
R-3 and R-2 structures now exist in the area, while many spot zoned
commercial properties are in clone proximity.
Mrs . Sterling and I , with other concerned lot owners , attended
the August 3rd meeting of your Planning Commission , regarding their
proposed Resolution of Intent to rezone our property downward from
R-3 Multiples to R-1 Single Residence because realtors in the area
advised that our property values would be reduced by as much as.
one-third to one--half their present value .
L
Page Two
Our total investment in our five lots is $59; 855 . 25 . We
have owned most of the l o t s since 1963 and one lot since 1955 .
We purchased these lots for, investment purposes , leased on the
existing multiple development of the area and the proposed ac-
quisition by your, City and ito raster Plan ,
On December lot , 1964 , we appeared in Zone Case No . 494
before your Planning Commission requesting a rezoning from R-4
County to C--2 , because of the close proximity of business and
multiple construction in the neiChborhood . The Commission recom-
mended denial of our :application and ,your honorable City Council
on December 21st , 1964 concurred , the reasons being :
111 . The existing Master plan of Land Use and
a recent zone study of the area depicts
the subject property for high density
zoning; and
2 . Approval of this request would constitute
spot zoning. " (Please examine your files . )
SUNc4ARY: We respectfully request that you authorize that
a furt er examination and study be made of "Area D" under Zone
Case No . 71 -20 for the following reasons :
1 . Area "D" appears to be the only hardship
area involved . Eight or ten voiced their
strong objections at the Planning Commission
Hearing, others filed letters of objection
and still others on vacation had no chance
to be heard .
2 . The proposal to zone downward , if approved
by the Hunorable City Council will result
in irreparable loss to all prc2erty owners
in Area "D" who have not heretofor con-
structed multiple structures on their property .
3 . The proposed action , as noted by one member
of your own Planning Commission is immoral as
it affects such property owners as myself who
have heretofore relied on your Master Plan
( 1964) and paid taxes based on high density
use and high evaluation of their properties
by your City agencies over a long period of
time .
4 . If enacted , the zone change would constitute ,
"spot zoning" , as many multiple buildings

already exist in Area "D" , and we would tie
deprived of our future inultiple construction .
5 . The proposed zone change from R-3 to K--1 is
not only iruinoral, it: is unconscionable and
unnecessary . Only a very- nominal 6ensity re-
duction would be achieved on behalf of your
City.
6 . The proposed zone change from R-3 to R--1 is
clearly confiscatory and discriminatory , and
as such would be illegal .
Would you kindly give this matter your early attention and
acknowledge receipt of this letter. .
Yours very truly ,

GAntlemen: RE: HEARING OF ZONE CASE 171-20
We aro the owners of Lot 9 in Block .8 of 'Tract J349 au per map recorded in
Book 15, Page 17 of ttscellaneous Maps records of Orange County.
This letter is sent in protest to the proposed change of zoning from the
present scorning to Rl.
We feel this chango in zoning would 'it the value of thoso 'lots 50%. Vie
also feel the change would be a discrimination as most of the other districts
in this area are zoned for multiple use*
