This zone change was initiated by the Planning Com- mission and heard at their August 10 , 1971 meeting . Location: 200 fL . south of Warner Avenue , approximately 420 ft . east of 13olsa Chica Street . Original Zone Case as Initiated by the P?annina Commission A change of zone from R2 Two Family Residence District and R3 Limited Multiple Family Residencr District to R1 SingT.e Family Residence District . Original TIanning G:mmiss;on Recommendation Approval of an R2 zone for the following reasons : 1 . This zone change will imp1cment amendments to the proposed Mauter Plan of Land Use . 2 . Topographical problems exist on the property . Modification considered That the southwestern 1 .8 acre remain R3 and the balance be zoned n2 . See attached map. Planning Commission Action After Reconsideration on January 25 1972 That the entire property remain R2 . Rem given by the Planning Commission for their action The R2 zone allows 14.5 units per acre , which may be increased to Lb units per acre if developed as a residentialdevelopment ; thus , permitting greater f�lanned exibility . On Octoger 19 , 1971 , the Planning Co=iission reconsidered said none change and recommended that the City CounsIl act on Zone Case No. 71-20 Area IIL" for an R2 zone as recommended . Ceorge Kachickas, owner of the property under cons aeration, stated that he would prefer an R3 zoning on the 1 . 8 acre portion of the property , because it is not feasible to develop the total site R2 . Kachickas Dates October 199 1971 The staff has reviewed Conditional Exception No. 71-72 and Use Permit No, 71-41 and offers the following information for your considerations 1. Conditional Exception No. 71-72 and Use Permit No. 71-41 are before the Planting Commission btcause the Board of Zoning Adjustments referred both items up for final action. This ens dame pursuant to the Commission's request, at the time Zone :ase No. 71-20 was approved, that no final decision be wade an any development within Area "L" of Zone Cace No. 71-20 until a street pattern had been studied. 2. lihen Zone Case No. 71-20 Area "L" was heard by the City Council, they referred the proposal back to the Planning Comissiom to be heard in conjunction with the use permit application. 3. These two applications (Use Permit Vo. 71-41. and Conditional Exception No. 71-72) have been filed to allow the construction of a 150 unit apartment complex on a 6.7 acre parcel of land in the R3 Limited Multiple Family Residenc ^ District and R2 Two Family Residence Diutrict. The conditional exception was filed to allow the construction of carports at zero "0" setback on the property lime. 4. Properties to the east. uarthq and vast are all toned R1 and are mostly vacant with a few single family homes in the area. The property to the southeast is zoned Rl and developed with single family homes. The property to the south is zoned R2 and R3 and has an apartment complex under construction on the westerly portion of said property fronting on dolma Chica Street. SOX 190 CALIFORNIA 9264d November 15 , 1971 TO : HONORABLE MAYOR AND CITY COUNCIL FROM : Planning Commission It : Zone Case No . 71 - 20 , Area "L" Resolution of Intent ATTN : Brander Castle , Acting City Administrator Paul Jones , rity Clerk Gentlemen : Pursuant to the City Council ' s request , the Planning Commission reconsidered their decision on Zone Case No . 71- 20 Area "L" which proposes to change the zone on property located 200 ft . south of Warner Avenue and approximately 920 ft . east of Bulsa Chic a Street from R2 Two Family Residence District and R3 Limited Multiple Family Residence District to R2 Two Family Residence District . 'Phis mutter was heard by the City Council at the September 23 , 1971 meeting at which time one of the property owners addressed the City Council and use permit application pending indicated they had a s p pp p g before the Planning Commission to permit development of an apartment complex and asked that the zone change be amended to permit his project to proceed . It was the consensus of the City Council that the matter should be referred back to the Planning Commission for reconsideration along with the use permit application . At the October 19 , 1971 meeting , the Planning Commission considered the use permit application and ` one Case No . 71- 20 Area "L". It was the determination of the Planning Commission that thr. R2 zoning as previously recommended should remain and that the applicant should revise the plan to conform with the R2 zone and the new Apartment Standards . In view of the above information , the Planning Commission recommends that the City Council act on Zone Case No . 71 - 20 Area "L" as originallyrecommended by the Planning Commission for an R2 zone . Additional Information : The Commission requested that tie applicant for a se Permit resubmit revised plot plans and elevations which Cake the topographic features of the area into consideration and provide additional setbacks Along the existing R1 devulopinont . McCracken Post Office Box 190 City of Huntington Beach Huntington Beach , California 92648 Re : Area "D" Zeno Case 71-20 Dear Mayor McCracken : Mrs . Sterling and I own one acre (five lots , each '1401x601 ) in Area "D" fronting on Warner Avenue between Lynn and Hoskins Streets , one: and one--half blocks from active commercial properties and large scale apartments . Our property frontage ( two of the five lots ) will be reduced to a width of only 30 ' when Warner Avenue is widened , and further, part of our property has already been designated by the State as fronting on the approved "On Ramp" of the Coast Freeway (See Map in your files ) . Mrs . Sterling and I, as well as other owners of undeveloped lots lying within Area "D" were shocked to learn of the "Resolution of Intent " on the part of your Planning Commission to rezone our properties downward , thereby destroying their existing value . Our investigation shows that as little as thirty-two ( 32 ) acres out of the total Area "D" would be devalued including our lots . Numerous R-3 and R-2 structures now exist in the area, while many spot zoned commercial properties are in clone proximity. Mrs .
