'Present zone: R5 Office-Professional District and R2 Two Family Residence District . 'Reasons given by the applicant : (In Brief) Construction of new automobile sales agency. Property is located direc�ly across from two major auto agencies . High traffic area. Additional Information : A representative of the applicant spoke in favor of the request . Four adjacent property owners spoke in opposition for the following reasons : insufficient parking in the area , .lights , noise , and an unattractive use in a residential area . A petition signed by 55 persons opposing the request was submitted to the Planning Commission. Respectfully ubmitted , K . A. Reynolds , Secretary STAFF REPORT ZONE CASE NO. 71-7 Applicant - James B. Beauchamp DATE; April 20 , 1971 The Staff has reviewed Zone Came No. 71-7 and offers the following information fav your consideration: 1 . This application proposes to rezone approximately 2. 24 acres of land situated on the east side. of Beach Boulevard approximately 800 feet north of Ellis Avenue from R5 Office Professional. District and R2 two Family Residence District to C4 Highway Commercial District. 2 . Property to the north and east fa zoned R1 and developed with single family homes. Property to the south is zoned RAC R2 and R5 ara is vacant. Property to the west across Beach Boulevard is zoned C2 and is developed commercially. 3. This parcei is one of several parcels of .land that were included in a lot consolidation program attempted by the City to facilitate coordinated development of the parcels involved. The lot con- solidation program was unsuccessful . However, the City did rezone the property to create a compatible relationship with surrounding land use . This rezoning resulted in the parcel in question being zoned along with the adjacent residential property and the R5 parcel was to provide a buffer between the commercial activities to the south and the single family residential development to the north. 4. It is the consensus of the Staff that this is not the proper location for this type of facility. This observation is based on similar situations in ttia city where automobile agencies are located edJacent to low density residential developments. In these casres, the noise from the outside speakers and from the service and repair areas have a disruptive affect on the residential. neighborhood. 5. It is the consensus of the Staff that the existing R5 and R2 zones are appropriate for this location. This; ! rt itself:, 1., particularly offensive due to our experiences with the two atuto- r.t)hile dealerships which are already located in the immediate vicinity, i.e . Groth Chevrolet and W11son Ford. Some of the problems that we as neighbors have experienced with these two businesses are: I . High-intensity lighting on the lot which carries over into the private residence yards all night long. is Outside lours speaker paging systems which are in operation un'cil 10:00 CM, and are heard throughout the neighborhood . J . Salesmen and customers using residential streets for parking their cars, which limits parking areas on puhlic streets for other uses . The excessive number of cars parked on the streets often prevents the street sweeper front being able to clean the streets, 4. Mechanics and repairmen test-driving vehicles on city streets within the adjacent area:;, such as break testing by locking; all four Wheels and skidding, rust accellerations leaving marks in streets and making excessive noise, etc. Tt has also come to our attention, and can be verified through police ret;Ords, as could most of the above listed complaints, that the owners of the automobile dealerships have not maintained adequate off-street parking for their c;tlitomers and employeees, but have put that land to use by the storing of more vehicles for ;ale . We feel that another car lot or automobile dealership in this area will niultiply the above stated problems 'to the extent that it will be unbearable . This would result: in the majority of the home owners in this area to petition for, a''zone thange of our property from R-1 to C-4 so that we, too, could take advantage of the incrcased property values of such a zoning. If our property remains R-1, Single Family Residence, And the subject property is rezoned to C -4, theca our property will continually decrease. cr , { • � 02- �r • It is our belief, and we have heard the expression many tiaw s, that Htjhway 39 Is getting to look more like a "car ,junk ysird and hamberger heaven" than Firestone 3oulevard in Los Angeles County. Box 190 Huntington Beach, California Re: Communication of Mely 7 , 1971 Dear Mayor; Through the years the City of Huntington Beach and the Huntington Beach City School District have cooperated together for the best interest of those we serve . We mention ma:Iter planning and development of school sites and adjoining city parks as a good I?xample of joint cooperation. The school district has considered possible school sites within the area mentioned in Zone Case 71»6 . When residential development first started in this particular area , the school staff cooperated with the city planning department staff in the consideration of schools and parks in this area . As development continued, the school district has reconsidered the placement of a school s1te i.^. thlia area. Each time the Board of Education chose alternate sites . We call to your attention the master plan of school sites as prepared by the city planning department. The munter plan called for two schools in the quarter' section bounded by Indianapolis , Magnolia , Atlanta and Newland Streets , rallowing the City Council changing the land use within f.hin quarter section from Rl to a planned community, the Board of Education of the luntington Beach City School District directed the staff to attempt to move. site %4 on the master plan to the area of Atlanta and Newland which would be within Zone Case 71-6 . On March 9 , 1971 , the school board directed Mr. Palmor to attempt to negotiate a trade of site 6 (within the Newland tract) for a site within the area of Zone Case 71--6. Palmer attempted to reach an agreement with the property owners in regard to the school'diitrict acquiring a school site on their.property. During the April 20 achool board meeting , Mr. Palmerje ported to the school board that he,, was unable,to negotiate a reasonable price for the land in 'queation and that th. , school district should proceed with seeking a school site in another location. The a'chvol board concurred and directed the staff to negotiate. for an ,alternate sitar. -Mr. chd Mrs . Pike were in attendance at the open board meeting. At no time did the school board consider a use of Eminent Domain .in the proposed site acquisitii"n within Zone Cane 71-6 . At 'no time did Mr. Palmer advise any of the property owners not to sell their property or to withhold property from a prospective sale . Mr.. Palmer only followed the direction of the board of education to 'attempt to ,negotiate for the property, in quest ion. This application was heard by the planning CommI ssion at the April 6 , 1971 meeting at which time action was continued to the April 20th meeting to allow time for a meeting to be held with representatives of the applicant, Planning Commission, and properts, owners to discuSe plans for the development of the beach. An oral presentation of the results of this meeting will be presented to the Commission at the April 20th meeting. r STAFF REPORT ZONE CASE NO. 71-5 a Applicants Standard Oil Co. Date : April 6 , 1971 The Staff has reviewed Zone Case No. 71-5 and offers the following information for your conaiderations 1. This application is a proposal to establish four oil operation sites on the ocean side of Pacific Coast Highway between loth Street and a point approximately 4000 ; feet northwest of Goldenwest Street on Pacific Coast Highway. %,+ 2. The property is zoned CI-O Which permits the continued use of the existing oil operation but does not permit radrilling axiating Wells or drilling new Wells. 3. The parcels vary in depth from 50 ft. to approximately 100 ft. and will extend along the entire length of Coast Highway with the exception of three openings. The first opening occurs between 15th Street and 17th Street and extends for approximately 475 ft. The second opening is between 22nd Street and Goldenwest Street and extends for a distance of approximately 225 f t. The third opening in pp Y located approximately 1768 ft. north Goldenwest Street and extends for approx- I ma tely 400 ft. 4. This is a portion of the property which is presently the subject of pending litigation between the Oity of Huntington Beach and the Huntington pacific r' Corporation wherein the City is asking for ,judgment that the beach front northwest of the pier is a pert of a public recreational easement. S. The provisions of Article 968, the Oil Combining Diatrict, are such that all oil operation sites are required to be enclosed with a six foot high masonry wall to screen the operation from view. This would necessitate cunatruction of a wall along this entire strip with exception of those areas excluded from the zone change. 6. Each of the pr,.,juFjed oil operation sites are Within several hundredths of an acre of the maximum oil operation situ size of three acres. s STAFF REPORT µ Page 7 ZONE CASE N0. 71-5 7. The need for astablishinq 'ocoeer to the beach has been discussed With the property,, owner. It appears that establishment of the oil operation sites was done without regard to public access to the beech or to any future development of the property in question. 0. The excessive length of the area to be included in these oil operation sites appears to be contrary to thA provisions of Article 960, Oil Combining Districts, wherein, the intent of such district ie to phae.a out existing scattered oil * -. operations and cause consolidation of new oil operations to permit development of the property for some other purpose as specified in the bane district. In tnis cans, the majority of the property is being devoted to oil operations and not to the use permitted in the base district. 9. T", uses permitted in the present C1-0 zone classification are inappropriate for this property. However, it should be noted that When the property wee zoned Cl, the uses proposed by the property owner (hotels, rwetaurant3, eta.) were permitted in that district. Changes in the uses permitted in the C1 zone have made this zoning inappropriate. in. The property is within the scenic corridor wherein the City is attempting to preserve the view of the beach and ocean. The proposal as submitted is not in line with this expressed desire. 11. It is the consensus of the Stcff that the property owner should work in coopera- tion with the applicant and the City irl an attempt to devise a plan that would permit development of this property in s manner that will most the satisfactiol. of all parties concerned. 3.2. It is the consensus of the Staff that action on Zone Case Nc,. 71-5 should be continued for approximately 60 days to allow time for representatives of the Planning Commission• the property owner, oil leases, and staff to get togather to work out a p* ,Xaal for development of this property.
