The master plan for this area was reviewed in early lq7' at which time it was determined that: Lhe property is besL suited for industriaal use . A zone change application ( 'Lone case No . 7 t - 36 ) to rezone this property frotn M1 Light Industrial histri.cL to k2 Two Family Residence District , was heard by the Planning Cotmnission on October 19 , 1971 . The Commission reconmtended denial of the zone change because the land is master planned for industrial use . The City Council , at their November 15th meeting , sustained the decision of the Planning Commission and denied the zorce change. A miTIOrity report , submitted by Coami_ssioner Slates , stated that he Feels this property does not have the prercquisites for industrial land ;• also , freeway access from the subject property would be through the Central Park. The applicant has indicated that theyy propose to develop a Planned Unit Development on this parcel if the request is approved . The staff feels that the property should remain in an industrial c .assification to avoid further erosion of the industrial base. Provisions of the State Law and City Code Are such that if the zone change is approved , the Master flan must be amended to reflect a residential use before a tentative map can he approved on subject property . T1ie staff feels that there has not been a significant change in this tr-eri since the Master Plan was reviewed and , therefore , recommend.,; do-ii to 1 of Zone Case No . 72-22 . 'ITLis zone change is a proposal to rezone an 8 acre parcel of land located on the southwest corner of Ellis Avenue and HuntiUstrict. ton ' Street from H62 -0 and M2-01 to R1 Singlc Family Residence 2 . The property is presently master planned for industrial use and was the subject of a zone change previously considered by the Planninngg Cottaiiss ion (Zone Case No . 71-42 ) . Said zone change .roppoosed to rezone subject property from M2-0 and M2-01 to R2 Two emily Residence District. The applicant later agreed to accept R1 zoning on said property. Uie Planning Commission denied subject request at their February 1 , 1972 meeting for the following reasons : a. The topography prohibits development of this property for residential purposes . b . Subject property would be goad industrial pr-%perty if E11ILe Avenue in extended wes;-erly. c . This mould constitute Further erosion into industrial zone property. The Planning Commission reconsidered their action on February 15th at the request of the property owner. At that time , the Commission discussed replacing subject property with other property to be zoned industrial . This reconait .Zration was prompted by a request from a member of the Cot ission %•hat the applicant substitute industrial acreage that would be lost by rezoning this property for residential purposes. The Planning Commission reaffirmed their, original decision for denial and added, as a reason for their action, tt the property offered as trade is being considered for industrial use on the Master Plan. The Planning Commission' s decision to deny subject zone change was appealed to the City Council . The City Council. denied the appeal on May 1 , 1972 . 3 . The appplication states that this parcel is proppoosed to be developed as a Mlgle family residential project along wvi.th the ad ooning Mnue* cel known as Tentative Tract No . 7b01 located north of Ellis It also states that the site is unsuitable for developawl. as presently soured becauas the site is approximately 25 ft. below the railroad tracks and orients towards existing residential developmats . It was pointed out in the stuff report that the staff agrees that the difference in grade between the railroad tracks and the Adjacent property is a significant factor; however, this could also create an extremely undesirable situation with single family homes being constructed below a railroAd track. The staff feels that the method of treating this situation should be discussed in detail with the applicant . 4. It is the feeling of the staff that the conditions surrounding Zone Change No. 72-2C do not substantial) differ from the facts discussed when Zone Change ito . 71-4 was ennsidered.
