( 100 ' x 16311 parcel from C3-0 General. Business District combined with oil production to R4 High Density Residential District. The applicant wants to construct a 17 unit apartment complex. Location: &plicant : North side of Ocean Avenue Bell Oil Corp. , Ltd. 50 ft . west of 13th Street. 305 17th Street Huntington Beach, Calif . Planning Commission Action: DENIAL - September 19 , 1972 for the following reasons : 1 . This zone change , if approved , would create spot zoning. 2 . There is sufficient R4 property in the vicinity that could meet the developer' s needs . Vote : AYES: Wallin , Boyle , Porter , Higgins , Kerins NOES : None ABSENT: None ABSTAIN: Slates , Bazil Comissioner' s Comments : Chairman Porter is not opposed to 1.14 , but feels the parcel is too small ; the request should cover the entire block. The Commission concurred and discussed the Town Lot Study , Ili Rise Ordinance and the Goals and Objectives Committee report. It was the consensus of the Commission that these studies should be completed prior to a change of zone . Mr. Don Eggleston, Vice President of the Home Council opposed the request , stating that it would create overcrowding and the proposed project provided no amenities . Commissioners Slates and Baz4461 abstained because of a conflict of interest. Summary of Staff Recommendation: The request has merit �MY+.I�I��YdIiM 41 .Ir��.Y and is a step toward implementing the expren sed desire of the Commission. This application is a request to rezone a 100 ft . x 163 ft . parcel, of land located on the north side of Pacific Coast Highway 50 ft . wc-st of 13th Street from C? Ceneral Business District to R4 High Denstty Residential . 2 . A crap showing the surrounding zoning is attached for your review. 3. Land use in the area consists of a surf shop located within a remodeled residential structure immediately east of subject request , an apartment complex located to the north across the alley fronting on 13th Street and scattered all operations within the general area. 4. The applicant proposes to construct 17 apartment units within a 3• store! structure . 5 . The future land use of the property fronting on the inland side of Pacific Coast Highway has been the subject of discussion I ; for many years . There have been proposals for high-rise condominiumsi high-rise hotels , service stations , fast food operations , and low rise apartment developments . 6 . All of the property frontingg on Pacific Coast Highway within the cownlot area is zoned C3 . The Commission has previously discussed the possibility of zoning that portion between 7th Street and 23rd Street to conform to the zoning of the adjacent property- which is R4 . This matter was most recently discussed when the Planning Commission initiated a zone change ' on 17th Street from M2-0 to R2 , R3, and R4 to conform to the zoning of the adjacent property. 7. It is the consensus of the staff that this zone change has merit and is a step toward Implementing the expressed desire of the Commission. However , it would be preferable to have this entire block rezoned AS The staff feels that the Planning �i Commission has several alternatives in this regard : as Initiate a zone change to rezone the remaining property on this block and any other property fronting on Pacific Coast Highway the Commission deems should be rezoned from C3 to R4. This application is a request to change the zone on a 3 . 38 acre parcel of land Located 315 ft. east of Beach Boulevard on the south side of Terry Drive from C4 Highway Commercial .)istrict to R1 Single Family Residence District . 2 . The tentative tract has been submitted proposing to subdivide this property into 16 sin ;1e family residential. lots . This map was con- side-red by the Planning Corm fission at the Julyy 18 , 1972 meeting. Action was continued to the July 25th Study Session because there was no one present to represent the applicant at the hearing. At the July 25th Study Session , the Planning Commission continued action on the Tentative Tract to September 61:h and instructed the staff to initiate a Master Plan Amendment to reflect a low density residential use on this property. "the. Master Plan Amendment will be heard at the August 15th meeting. 3. This property and the property to the west was previously held under one oarners3hi.p . As a result of a division of land separating the property into " two arcel& , subject property is required to obtain access from Terry Drive , a local street . The division of land was previously discussed with the Planning Commission at which time the Commission enpressed concern over the type of use that could be located on this property. 4. It is the feeling of: the staff that the existing commercial zone will not result in the highest and best use of the property because it will, require access from a local street ; also , the configuration of the parcel is such that any use located at the rear of the property will probably be of a sel:ondary commercial nature . The alterna`tive uses to commercial are professional and residential„ The configuration of the property, access , and the type of surrounding uses are such that this property is better suited for residential U-se . When considering residential use , the policy of the City to reduce densities wherever possible , is a primary consideration; therefore , it appears that a low density residential use is the best use for the! property in question. Lewis and Mrs. Sheridan Gilbert Beebe, Executrix of the I�state of Mnrgaret If. Gilbert, deceased, the owners of the property involved in the abov '. 1 earing on application for n change of zoning. Previously the Huntington Beach City Phanning Commission denied an application in the above platter and an appeal is now scheduled to be heard on the evening of September 18. Unfortunately, the writer will not he able to be present on that evening because of a commitment previously made at which Governor Reagan will. be present and the writer will be asked to introduce him. Therefore, I would like to submit this letter on behalf of the application. Mrs. Lewis and her deceased sister, Mrs. Gilbert, inherited this property from their parents, Mr. and Mrs. T. G. I•iarriman, several years ago. Mr. Harrinlan bought the property about 1917 and it has been owned continuously since that time by the Harriman family. During all of this period taxes have been paid and the property has never produced Income sufficient to carry it, At various times oil and gas leases have been entered on the property, but no Oil or gas was ever discovered or produced from it. The Estate of Margaret H. Gilbert is in great need of funds for payment of inheritance taxes and estate takes on this property, as well as on some other real estate and considerable effort has been made in the last two years to find a purch,aHer for the property. All of these efforts have. been unsuccessful in finding anyone having any interest whatsoever In the manufacturing or industrial development of tliv property. Many industrial parka nearby have been developed which have offered tenants very attractive leases and provided fine facilities for tenants. As a result of these industrial areas, which are far from full, there is no immediate need for another area such as the land owned by Mrs. Lewis and the Gilbert hstnte at this time for manufacturing or industrial use. At the same time, several land developers have indicated an interest to acquire property for various kinds of residential development. Three previous offers have been lost because of the refusal of the Planning Commission to approve a change of classification. The: only reason given by the Planning Commission is that Huntington peach should have more manufacturing, but that is not logical nor supportable in the abs6nce of a market. Since much of the nearby area is now zoned for residential development and since the area is 'r',rell suited to such developmen and dostrable, we believe that the City Council should in fairness to the property owners, as well as in good long-range planning, change the zoning and permit the construction of residential property. We are informed that other persons present will submit data and evidence to support this application and another one affecting adjoining land, and the undersigned respectfully requests that the application be granted, and the decision of the Planning Commission reversed. Zone Case No. 72-22 Gentlemen; On August 1, 1972 the above referenced case was acted upon by the Huntington Beach Planning Commission and our request was did approved. At this time acting on behalf of the Owners of the property in question we hereby submit our appeal for the following reasons : ( a) Property in question is Adjacent to an Elementary School. site. School site was taken by condemnation From the Owner of subject property. School adjacent to I'M" zoned property does not appear very feasible . (b) Land to the east of property in question is presently zoned "RA" which will soon be developed. (c) Property in question has never been developed and been held in ownership by the same owners for 57 years . The 1971-72 taxes were in the amount of $5, 046 . 10 . It is apparent the Owner has never been able to utilize or develop the property under its existing Zoning, and again I point out the Owners have been paying taxes on unusable land under present zoning for 57 years . (d) It further appears that ingress and egress to the proposed regional park from Beach Boulevard would be via Talbert Avenue . (e) There is presently an application for rezone on 10 acres adjacent to and immediately south of subject property. It is our understanding that the City of Huntington Beach has approximately 1800 acres zoned "M" with only 800 acres presently developed. l .
