This zone case has been pending by the City Council for quite some time , therefore , the following is a brief overview of past events . The application was originally heard by the Planning Commission on October 3 , 1972 . It was denied for the following reasons : 1 . This zone case , if approved, would create spot zoning . 2 . The determination of how the property to the ncrth and south of subject property will develop is unknown . J p P Y P 3 . A commercial use would create traffic and safety hazards . The Planning Commission' s decision was appealed by the applicant and was heard by the City Council on November 11 , 1972 . After public comment , the hearing was closed. Action was continued to December 18 , 19729 to allow representatives of Sanitation District No . 11 to consult with the Sanitation Board regarding the possibility of the District purchasing subject property . When the matter was brought before the City Council on December 18 , 1972 , it was determined that an Environmental Impact Report would be required and the Council , therefore , continued action to February 5 , 1973 . On February 5 , 1973 , the City Council continued the action on the application once again to March 19 , 1973 , because the appli- cant had not submitted a 'Request for Exemption Declaration or an Environmental Impact Report . At the March 5 , 1973 meeting , Councilwoman Gibbs reported that the Executive Board of the Sanitation District took no action to acquire subject property because the City was mile to control. the use of the property through zoning ; however , the District would reconsider the matter if the situation changed . It was decided not to reschedule this matter for Council considera- tion until an Exemption Declaration or Environmental Impact Report had been prepared . i Zone Case 72- 31 July 12 , 1973 The Environmental Review Board approved Exemption Declaration 73-13 on July 3 , 1973 .
