NOTICE IS REREBY GIVEN that a public hearing will be held by the
City Council of the City of Huntington Beach, in the Council

Chamber of the Civic Center, Huntington Beach, at the hour of

If approval has been reccxmitnded, the City Council will be required to
hold a public hearing on this matter. Although there is a 10 day appeal
period, we suggest that the matter be set for the earliest passible City
Council meeting, because the purpose of cny appeal is to have 9 hearing
before the City Council and this is already being accomplished. We
further suggest that you noz accept any appeal, as it will serve no purpose.
If approval has been recommended other than as requested, the City Council
will be tequired to hold a public hearing on this matter. However, there
is a possibility that the Manning Commission's decision will be appealed;
therefore, we suggest that publication be held off until the 10 day
appeal period haft exrlred.
If denial has been recoamaended, the City Council may summarily deny the
request. However, we suggest that the matter not be scheduled on the
City Council agenda until the 10 day appeal period has expired.
A copy of the Planning Department legal notice, and a list %f owners of
property within 300 feet of the subject area will be submitted upon your
request.

recommended the City Council open the public hearing
on Codo Amendma,j,t No . 72-33 and continue action to
• a later date .
They Plannina Commission wishes to have Zone Case No . 72-35 ►
handled concurrently with the code amendment . Therefoire ,
we recommend that the City Council have the first reading
on Zone Case No . 72 -35 and withhold the second reading
until the Council act- on Code Amendment No . 72 -33 .

Plan ing�.C�ommission Action: APPROVED - December 12 , 1972
for the following reasons :
1 ,. The proposed zone change constitutes a feasible use of the
property.
2 . Allow:a an interim use of land .
VOTE: AYES: Bazil , Kerins , Porter, Wallin, Boyle
NOES: None
ABSENT: None
ABSTAIN: Higgins
Additional Information: Mr. Bill Wren, representing the applicant,
addressed the Commission and offered to
answer questions . There was no one present to speak in opposition.
SUMMAU of Staf f Regort: The request. was originally heard at the
November .th Co11 l s s i on meeting, however ,
the Coamd.ssion continued the hearing to November 21 , 1972 to allow
time for the applicant to modify the request to only include the
area tc, be used by a proposed wholesale nursery .

It appears that this request conforms to the expressed desire
of the Planning Conunission and City Council -o rezone areas
RA -where the futurr. use has not been detennis:::d ow where the
present zone is not compati.ble with the existing use of property .
Supporting Information: The Planning Commission :ontinued action
on 'Lone Case No. ?235 at theix November
21st meeting in order that a code amendment could be prepared re-
garding the requirement of right of way dedication and improvements
of all streets abutting agricultural uses. Such dedication and
improvement will to subject to review by the Board of 'Zoning Ad-
j justments and the Board shall consider the following : determ{ninS
said dedication. and impruvements , duration of use , vehicular access ,
development in the area and effect said use has on traffic .
EnvironmeiAtal. Review Board Action: On December 19 , 1972 , the En-
vironmental Review Board ten-
tatively approved Exemption Declaration No. 105 . The ten day
posting period for public input will end on December 31 , 1972 .
If there is no public input during the posting period , the City
Council may take action . The Planning Director will advise the
City Council of auy public input at the public hearing.

Persuant to your .request at the November 7, 1972, public hearing of
Zone Case No. 72-35 what follows is the legal description of _-he
area which is proposed to he used by the wholesale nursery :
Ilie northeast one quarter of the northeast one
quarter of the northeast one quarter of Sectioa
3, Township 6 south, 'Range 11 West .
Attached for your convenience is a plot plan of the 8. 26 net acre j
parcel located on the soutliwesterly corner of Coldenwest Street .and
Garfield Av,�nue . You will not^ that the property is heavily encumbered
with ncti.ve oil f,�cili ties which will preclude the permanent development
of this corner for many years. It should be noted that this same
condition exists or, the full 48 acres which we originally requested be
rezoned to PA-02 . With the realization that the entire 48 acres would
become developable at apprortmately the same time, via made application
to rezone the entire parcel so that it could be considered as a single
planning; unit at some >±utu"e date.

_Summary of Staff Report: The proposed :Waster plan
amendment for that portion of
;study Area "n" south of Ellis Avenue has shown the subject
property as medium density residential . This amendment to
the master plan will be set for public hearing as soon as
the Central Industrial Study is complete . The property Co
the east and west of the subject property is zoned commercial
and industrial , respectively . Property to the north and
south of the subject parcel is zoned R3 , but is developed
to R2 density .

the City Council , who desire a reduction in the density of
subject property.
2. The subject property is an 8 . 3 acre parcel of land located at the
southwest corner of Ellis Avenue and Delaware Street . 'rhe proposed
change of zone is from R3 Medium High Density Residential District
to R2 Medium Density Residentie t District ,
3. The proposed Master Plan amendment for the portion of Study Area
"B" south of Ellis Avenue shows the subject property as meditun
density residential . This amendment to the master plan will
probably be set for public hearing as soon as the Central Industrial
!I Study is complete .
4. Property to the east and wt-lst of, subject property is zoned
commercial and industrial respectively. Property north and south
of subject parcel is zoned R3 Medium High Density Residential

Zone Case No. 72-33 is a request for change of zone
on approximately 37 acres from R5 Office-Professional
District to M*i Mobilehome District . This application
was filed because the existing mobile home park was
classified as -a non-conforming use when the MH District
was adopted in September 1970 .

the property is 30 to 40 feet lower than property to the north.
Summary of Staff Report: When the use permits for the existing
mobilehome parr were approved by the
Planning Commission, mobilehome parks were permitted uses in the
R5 District. It was noted that the Planning Commission ' s policy,
when reviewing master plan amendments within Study Areas A, B
find C, is to rezone those areas currently developed as mobile-
home parks to the MH designation, where it is determined that
the property complies with criteria established within the MH
District. It is the consensus of the staff that the ro ert

STAFF REPORT
Zone Case No , 72-33
Applicant : Intrepido Development Co.
Date : October 17, 1972
1 . Zone Case No. 70-33 has been filed to rezone the existing
37 acre mobile home park located between Indianapolis Avenue
and a point approximately 600 feet north of Atlanta Avenue
on the west side of Beach Blvd . from R5 Office Professional
to MH Mobile Home District .
This application was filed because the mobile home park was
classified as a non-conforming u-4e when the MH district
was adopted in September 1970.
2 . When the use permits for the mobile home park were approved
by the Planning Commission they were permitted uses in the
RS district, however , when the Commission was reviewing
Phase II (Use Permit No. 70-6) the new mobile home park
ordinance was under consideration. The Commission
conditioned the approval of Use Permit No . 70-6 to re-
quire the park to be designed to the new standards with
reference to - street widths and treatment of the wall along
Delaware Street and Beach Blvd .
3. This request is inconsistent with the existing master plan
for the area as the current master plan designates this
property for office professional use . It is noted that the
Planning Commission' s policy when reviewing master plan
amendments within study areas A, B and C was to rezone those
areas currently developed as mobile home parks to the MH
designation.where it was determined that the property complied
with the criteria established within the MH district .
4. It is the consensus of the staff that the Commission may
wish to withhold initiating a master plan amendment -on this
property until study area D has been reviewed so the entire
study area may be amended at one time .
5 . Any action by the Planning Commission to withhold amending
the mastei plan will not effect the mobile home park as the
application was only filed so that the applicant may provide
additional kitchen facilities in one of the recreation
buildings . Although this addition appears to be insignificant
the code does not permit any modification of this nature to a
non-conforming use.
6. It is the consensus of the staff that the property should be
rezoned MH Mobile Home District to facilitate enforcing the
various provisions of the code and to permit the property
owner to amend their plan as the need arises .
7 . In view of the above information the staff recommends
approval of Zone Case No . 72-33 .
