Al f cia Wentworth City Clerk Gentlemen: We herewith appeal to the City Council the 4enial, pursuant to Huntington Beach Code Section 9877, by the Huntington Beach Planning Commission of Master Plan Amendment No. 72-7 and Zone Case No. 72-39. Application for this zone change: was filed on October 20, 197L' , a public hearing on this zone change was held December. 1.9, 1972, but no final action by the Planning Commission on this matter was taken at that time or since such tine.. Pursuant to Code Section 9887, this zone change would be considered denied 1f no final action was taker by January 25, 1973, that is, 95 uayn subsequent to the filing of the application. This period can be extended by mutual agreement.On January 16, 1973 ve agreed to an extension which was subsequently further extended to May 1, 1973, in order for the Planning Staff to respond to various requests of the Commission and to allc-a time for an Environmental Impact Report to be prepared and processed. By May 1, 1973, they EIR report had been made, reviewed and an addendum thereto prepared in response to quesrionj raised. At the May i, 1973 Planning Commission meeting, the City EIR Board recommended approval of this Zone Change 72-39. The Planning Department Staff Report also recommended approval. However, the action of the Commission was (1) to continue this Zane Change to July 3, 1973 to further study the Master Plan for this area and (2) to refer back the Environmental Impact Report to the Environmental Review Board For additional documentation on alterna- tives, commitment of resources and funding, traffic circulation and student impact on the educational facilities. r ,I r 1 i 1 • City of Huntington Beach Page 2 May 11, 1973 The applicant did not concur with the further continuance of thin matter beyond May 1, 1973 and pursuant to Code Section 9887, this Zone Change became autometi- cally denied. By this lerter we herewith appeal to the City Council the denial of this ratter. For the ^ouncil's benefit in reviewing this matter, we note that this Zone Change is a request to change R-G, R--.3 and R-1 zoned lands, totaling 90 acres, to R-2-PD. Basically, the same eventual development will occur• as under the present zoning except thnt the R--2-•PD zoning will allow greater flexibility of planning to achieve a better residential environment and will temilt in a reduction of. 30% in the allowed number of units. The San Diego Freeway is located immediately north of the subject site (see attached land use and zoning map) . The applicant recently requested the Planning Commissio n to initiate zone change proceedings to change the existing RA zoning to commercial zoning pursuant to the Master Plan . He explained that the zoning is necessary to obtain financing commitment and futtire tennants . The Planning Commission concurred that the request had merit but that the property owner should initiate the request . HISTORY : The proposed zone change encompasses an area which was originally zoned Ml , night Industrial , on the western portion of the property and R1 Low Density Residential on the remaining portion of land to the east . An application for a change of zone (Z .C . 70-9) on the western portion of the subject site from M1 Lights Industrial to R3 Medium-High Density Residential was denied by the Planning Commission on April 28 , 1970 . The reasons for denial indicated because of freeway expostire the property is beast suited for industrial or commercial development , It was also stated that this property had a good possibility to be utilized for secondary commercial uses . On December 21 , 1971 , the Planning Commission approved It change of zone (Z .C . 71-48) of the subject property frain M1 Light Industiial and R1 Low L:ensity Re.•Adentia.l to Rik Residential Agricultural District . The intent of the mono change was to place the property in a holding zone . V,ij Planning Commission stated they would require submittal of a development plan for any future use of this property bo- cause of its proximity to Huntington Center and the San + Diego Freeway . Center Drive is currently under construction and extendE► east from Gothard Street eventually turning south end tying in with Huntington Center (see attached map) . The precise plan indicates a street to extend north from Center Drive to McFadden Avenue . The developer of the subject site would be required to fully improve this propoiied street . CONCLUSION: This request for a charge of zone is from Ra Residential Agricultural to C4 Highway Commercial District . The master plan designation of this area as commercial-retail is generally consistent with the proposal . The staff concurs that C4 zoning , which requires a use permit application before the Board of Zoning Adjustments f.)r retail commercial urges , would be the most desirous designation of this property . C4 would allow highway related uses , such as hotel , and would also allow uses established in other commercial zones subject to approval of a use permit before the Board of Zoning Adjustments . Chairmen Porter expressed concern about the appearance of property fronting, on Goldenwest Street in the proximity of Central City Park . The 11011 suffix was discussed . The Acting Secretary explained that to delete the 110" suffix would allow existing oil operations to continue , but would prohibit new oil operations . Zone Case No . 72-36 is a proposal to rezone approximately 1 . 8 acres of land located on the east aide of Goldenwest Street , 155 feet north of Garfield Avenue from RA-0 Residential Agricultural District combined with oil production to M1-0 Light Industrial District combined with oil production . 2 . This application has been filed to permit construction of an industrial building per the attached plan . 3 . This property is a part of the Central Industrial Study and has been tentatively designated for industrial use . However , the staff and Planning Commission have been concerned with the appearance of Goldenwest Street in this area because it serves as a main entrance to the Huntington Central Park located approximately one fourth mile to the north . Preliminary plans call for the property to be zoned MI-A which provides for extensive landscaping and setback requirements or to establish a landscape and setback requirement along Goldenwest Street in addition to that set forth in the M1 District . It appears that the M1-A District would be the best vehicle to accomplish this . 4 . A map showing showing , the surrounding zoning is attached for your review. There are oil operations in the area , however, the property is primarily vacant . Aerial photographs of the property will be shown at the Planning Commission meeting . 5 . The staff has reviewed the plan and determined that the use would be permitted in both the M1 and MI-A Districts . 6 . Thisrequest will involve carrying the "0" designation along with the MI designation of the base district. It should be noted that the "0" District permits existing oil operations to continue and to be maintained in its present state . This requirement for all intents and puxposen classifies an oil operation in the "0" District as a► non- conforming use . It is the consensus of the staff that the "O"designation should not bo carried forward with the new zone designation. 1.
