1 . Beach Blvd . presently has 1/3 of all service stations in
Huntington Beach .
2 . Thy energy crises is anticipated to last another 3 years
which will cause the closing ofservice_ g stations that will
be a blight on the City .

Summary_ of Staff Report:
The subject .s i i:e ce ntains an abandoned building on vacant land
located on t4i;- soufl west corner of Beach Blvd. and Talbert Ave .
in the C4 Disl.rict . Property to the north across Talbert Ave .
is developed with retail and professional office uses . Prop -
erty to the east across Beach Blvd . is developed with general
commercial uses and . land to the south and west is undeveloped.
All of the above mentioned properties are located in the C4
flighway Commercial District . No se:vico station sites exist
on the four corners of Beach Blvd . and Talbert Avenue . The
subject property was zoned C4 in 1971 . Prior to this time the
property was located in the R.A Residential Agricultural- District .

Additional Information
Mr . Leroy Tomlin spoke in favor of the zone change , and requested
a decision .
It was noted by the Commission that a zone change is a discretion-
ary act on the part of the Planning Commission and the applicant
has no right to c change of zone .
A motion was made by Geiger and seconded by Bazil to approve 'Lone
Case No. 73 - 16 for the following reasons :
1 . The location does comply with all criteria for the location
of a service station suffix and with the staff' s recommenda-
tions :
a . The proposed zoning conforms with the zoning character-
istics in the immediate vicinity.
b . The proposed zoning is in substantial conformance with
the master plan .
C . All criteria for ''SS" zoning as required in Article 948
have been complied with .
The motion failed .
A motion was made by Wallin and seconded by Kerins to deny Zone
Case No . 73- 16 for the following reason :
1 . Under Article 948 , Intents and Purposes ; a service station
would not be in the best interest of the City at this location .
This motion failed .
ON MOTION BY PORTER �N D SECONDED BY WALLIN THE COMMISSION MOVED
TO RECONSIDER THE PRr"VIOUS MOTION .
A new motion was made by Geiger and seconded by Porter to deny
Zone Case No . 73- 16 . The motion was withdrawn by Geiger as he
did not agree with the reasons which were stated for denial . A
motion was mado by Wallin and seconded by Porter and Zone Case
No . 73 - 16 was denied with reasons being restated as follows :
1 . Beach Blvd. presently has 1/ 3 of all service stations in
Huntington Beach .
Z . The energy crises is anticipated to last another 3 years which
will cause the closing of service stations that will bo a
blight on the City .
Minority Report
Commissioner Dazil and Geiger stated that this location meets all
criteria for service station suffixes and that the other 3 corners
are already developed so there 3s no danger of a second service
station being built at this intersection , Mr . Bazil further state'i
that there are no other service stations in Huntington Beach on
Talbert Avenue , and that two major oft companies have gone on
record to state that they expect no fuel shortage . Coninissioner
Geiger stated that he changed his vote to allow the applicant an
opportunity to ap-
pea] this item to the City Council .

for the purpose of constructing a 24 hour self-service service
otat on , pursuant to S . 3481 , requiring (SS) suffix zoning for
new service station sites ,
PRESENT LAND USE AND ZONING :
The subject site contains an abandoned building on vacant land
located on the southwest cor.ier of Beach Bou1,.:vard and Talbert �
Avenue in a C4 highway Commercial District .
Property to the north across Talbert Avenue is developed with
retail and profossioral office uses and is located in a C4
District . Property to the east across Beach Boulevard is developed
with general commercial uses , also located in a C4 District . Land
to the south and west is undeveloped and is zoned C4 .
No sei,vice station sites exist on the four corners of Beach Boule -
vard and 'Talbert ^venue at this time . (Sec attached land use

MASTER PLAN :
Master flan Study Area "ll" adopted 2/22/72 indicates the subject
area as commercial retail .
ENVIRONMIINTAL STATUS:
On June S , 1973 the hnvironmental Review Board instructed their
secretary to post Exemption Declaration Nc . 73 - 30 for public
comment . Tho Board will considor the request for nn exemption
declaration on ,Jung 19 , 1973.

Declaration on July 31 , 1973 , based upon the following findings :

Approved by Planning Commission on June 5 , 1973 . Transmitted

Planning Commission Request:
The Planning Co=issiori respectfully requests that Zone

In the review of proposals received to prepare an Environmental •
Impact Report on the above , the Boe.rd discussed :
- 'The proximity of the project area to the SCE generating
station and the question otthe air quality in that
vicinit (as indicated in the final EIR on the SCE ex-
pansion
- The possibility that 'Newland will be widened to four lanes ,
and that the further increase in traffic would cause fur
them deterioration of the air quality .
The Board therefore requests that the Planning Commission re-
evaluate its prior action . That tir-tion was taken partly to bring
the zo;lin into compliance with the Master Plan ; the planning
Commission may wish to consider changing the Master Plan instead ,
thereby retaining the existing industrial zoning and not allowing
more residential development in that area .

Zone Case No . 73-13 is a change of zone on approximately 4 acres
of land located on the west side of Newland Street approximately
7001 north of Pacific. Coast Highway from Ml-A-O Restricted
Manufacturing District Combined With Oil Production to MH Mobile
Home District . The City Council considered the matter at the
July 16 , 1973 meeting and continued action .for 60 days to
September 17 , 1973, so th at .an Environmental Impact Report could
be prepared for consideration by the City Council prior to
taking any action on the matter.
The Request For Proposal for the preparation of an Environmental
Impact Report was dratted five weeks ago but was held pending a
final decision regarding undertaking the work in-house . or contract-
iag with a consultant . It is our feeling that Environmental
Impact Reports will be prepared in-house ,. however9 we will not
be undertaking this type of assignment until the State Guidelines
have been reviewed , ordinances rewritten , and resolutions adopted
to streamline the operation. Until then , we .find it necessary to
have specific projects prepared by a consultant .
It is our feeling; that the time involved in preparing. an Environ-
mental Impact Report and to allow for the public hearing procedure
will flake approximately four months .
Recommendation :
I would like to recommend that the City Council continue action
on Zone Chse No . 73- 13 to January 21 , 1974 to allow time for the
Environmental Impact Report on this matter to be prepared in final
form.

adequate depth for industrial development and is located in

Summary of Staff Reeort

The subject property is adjacent to the Orange County Flood
Control. Channel , an existing mobile home park and the Edison
Company generating plant . The property is vacant and owned
by Mills Land and Water Company who is the recorded owner of
abutting property to the south and east on which the existing
mobilehome park is located .

Additional Information
State law requires that conflicts between zoning and master
plan designations be brought into compliance by June 1 , 1973 .
The staff has identified a number of existing conflicts .
These have been reviewed with the Planning Commission and
certain changes , either in the master plan designation or
the zoning , have been initiated .
This proposed zone change resolves on-e of the conflicts .
The change of zone to MN Mobile Home District conforms to
the existing master plan designation and conforms to the
use of adjacent property which is under the same ownership .
There was no one present at the public hearing who spoke
either for or against the proposed none change .

The subject property consists of approkimately 4 acres and is
adjacent to Orange County Flood Control Channel , an existing Mobile -
home Park and the Edison Company Generating Plant . The property
is zoned M1-A-0 and is Master Planned Mobilehome Residential . The

If approval has been recomtmanded, thn City Council will be required to
hold a public hearing on this matter. Although there is a 10 day appeal
period, we suggest that the matter be net for the earliest possible City
Council meeting, because the purpose of any appeal is to have a hearing
before the City Council and this iu already being accomplished. We
further suggest that you not accept any appeal , as it will serve no purpose.
If approval has been recommended other then as requested, the City Council
will be required to hold a public hearing of this matter. However, there
is a possibility that the Planning Commission' s decision will be appealed:
therefore, we suggest that publication be hold off until the 10 day

AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY AMENDING SECTION 9061 THEREOF TO PROVIDE
FOR CHANGE OF ZONING ON REAL PROPERTY LOCATED
ON THE WEST SIDE OF NEWLAND STREET, NORTH OF
PACIFIC COAST HIGHWAY ( ZONE CASE NO . 73-13 )
WHEREAS , pursuant to the state Planning and Zoning Law ,
the Huntington Beach Planning Commission and Huntington Beach
City Council have had separate public hearings relative to Zone
Case No . ?3-13 wherein both bodies have carefully considered
all information presented at said hearings , and after due con-
sideration of the findings and recommend•itions of the Planning
Commiss' ors and all evidence presented to sre:id City Council , the
City Council finds that such -,one change is proper,
NOW, THEREFORE , the Cite Council of the City of Huntington
Beach does ordain as follows :
SECTION 1 . The following described real property , located
on the west side of Newland Street , approximately 700 feet north
of Pacific Coast Highway , is hereby changed from MI-A-O, "Re-
stricted Manufacturing, District , " combined with oil production ,
to MH , "Mobilehome District : "
Located in the southwest quarter of Sectional
District Man 13-6-11, City of Huntington Beach ,
County of Orange , State of California; beginning
at a point on the center line of Newland Street ,
located 710 . 64 feet north of the north line of the
Pacific Coast Highway 101A ; thence north 55024 ' 30"
west 193 . 12 feet ; thence north 2017 ' 36" east 842 . 09
feet to the south line of the Orange County Flood
Control District D1 channel ; thence continuing
along the south line of said channel south 87° 4212411
east 220 feet + to the center line of Newland Street ;
thence southerly along said center line 1005 feet ,,
morn or less , to the true point of beginning .

SECTION 2 . The Planning Director of the City of
Huntington Beach is hereby directed to change District Map 14
( Sectional District Map 13-6-11 ) tc, inco,nn orate the zone change
described in Section 1 hereof , and as said district map shall
have been amended , the same shall remain in full force and
effect and be a part of the Huntington Beach Ordinance Code . A
copy of said district map , as amended hereby , is available for
inspection in the office of the City Clerk .
SECTION 3 . Section 9061 , District Map 14 thereof, is
hereby amended by 'Lone Case No . 73-13 , effective ,
1973 .
SECTION 4 . This ordinance shall take effect thirty days
after its adoption . The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days after adoption in the Huntington Beach News , a weekly news-
paper of general circulation, printed and published in Huntington
Beach, California .
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the
