Additional Information : The Environmental Review Board feels that , although the Zone change itself will not substantially change the use of the property or the impacts therefrom , several problems would arise from the actual conversion . Therefore , the City Council might consider delaying the second reading of the Zone Case until after a Conditional Use Permit and a Tentative Tract map are filed . Partners 1345 Avenue of the Americas New York, New York 10019 Location : Northeast corner of Boardwalk Drive and Saybrook Lane Request: From R3 to R4-33 . 75--PD Reason: To permit the conversion of an existing 342 unit apartment complex to condominium units Planning Commission Action : Denied - November 20 , 1973 Reason: It does not meet either old or new PD criteria including (1) required parking , (2) building setb,.,.cks , and (3) diversification of dwelling unit type Vote : Ayes : Geiger, Bazil , Iiiggins , Kerins, Wallin, Boyle , Porter Noes : None Absent : None Summary of Staff Report: Findings on Zone Case No. 73-24* were based solely on the available information and maps of the subject property . This application does not meet all setback and off--street parking requirements . Therefore, based on the nature of zone change and the lack of fulfilling the major PRD requirements , the staff recommended denial. V Zone Case No . 73-24* December 3 , 1973 Page 2 Additional Information : The following information pertains to the subject site and surro..mdinc property. Use Permit No. 69-47 was approved on August 27, 1969 by the Board cf Zoning Adjustments to permit 342 units to be built on the subject site. On September 8, 1970 the City Council upheld the Planning Commission ' s denial of rezone to P3 on the west side: of the subject site. The Planning Commission initiated Zone Case No. 71-20, Study Area "Clot to keep the zone compatible with the R3 property adjacent to the subject site. The property east of trQ subject site was developed as Tentative Tract No. 7837, a controversial, subject between the Planning Commission and City Council. On May 160 1972 the Planning Commission denied the tentative tract and Use Permit No. 72-20 which were appealed to the City Council on June 20t 1972. The City Council ove:,ruled the Planning Commission and approved the applications and referred them back to the Manning Commission for appropriate conditions of approval . Final approval was given by the Planning Commission on July 18 , 1972 . On February 6, 1973 , the Planning Commission denied Zone Case No . 72-49 . This zone change request was for R3-PD-28 on the subject site in question. Zone Case No. 73--4 was initiated by the Planning -onmissiori to rezone the subject property from R3 to R4-PD. This case was withdrawn as applications for use permit, tentative tract and zone change were withdrawn. BACKGROUND INFORMATION: The short history that follows includes action taken on certain property adjacent to the proposed site within this request . The staff believes the action should be noted and is pertinent to this case . On August 27 , 1969 , the Board of ZoT:ing Adjustments approved Use Permit No . 69 -47 to permit Phase I 342 units of a 732 unit apart - ment complex to be built on the subject site . On September 8 , 1970 , a proposal , Zone Case No . 70 - 7 , to change the zoning of land located on the west side of Algonquin Street north of Boardwalk Drive from C4 !Highway Commercial District to R3 Medium High Res-.%dential District was denied by the City Council , thus upholding tho P i.arnir.g Commission ' s decision for denial based • on the concern that there ~could be too much multi -family zoning in tho area , The Planning Commission further requested that a study be prepared outlining the areas proposed for multi -family zoning . The proposal was to allow implementation of Phase II of the afore- mentioned 732 unit complex . On July 3 , 1972 Zone Case No . 71- 20 , Study Area "C" , was adopted by the City Council . Area "C" is the same area which Zone Case No . 70 - 7 Addressed itself to and was previously denied . Zone Case No . 71r20 was initiated by tho Planning Commission . The , N Zone Case No , 73 - 24* Page 2 following reasons for approval were given by the Planning Commission : 1 . The Zone Change will implement amendment to proposed Master Plan of Land Use . 2 . The proposed R3 zone is compatible with existing R3 property adjacent to this area . May 16 , 1972 On Jul-y-4-81-4-9-73 the Planning Commission denied Tentative Tract No . 7837 in conjunction with Use Permit No . 72 - 20 , a proposal to permit 119 town homes to be developed east of the subject site . The following reasons were given for denial : 1 . Request would be incompatible with the existing apartment: complex with respect to use , elevations , bulk of building , access , and open space . 2 . Phase I of the proposed development encroaches into the apart - ment complex and does not relate thereto . 3 . The City Council had indicated that the C4 parcel located on a portion of this property would be rezoned to R3 if the remaining property were developed as a Planned Residential Development ; howe-er , at That time the irregular shape of the subject property was not know , nor the problems that would be created by mixing existing apartment complexes with condominiums . The action by the Planning Commission on 'Tentative Tract No . 7837 and Use Permit No . 72 - 20 was appealed to the City Council on June 20 , 1972 . The City Council overruled the decision of the Planning Commission and approved Use Permit No . 72-20 with the stipulation that it be referred to the Planning Commission for reasonable conditions including traffic control and a compatible separation between the project and the adjacent apartment complex to the west . Planning CommizAion appno vat, gnanted on Jut y 1 B , 1972 . On February 6 , 1973 the Planning Commission denied Zone Case No . 72 - 49 . The applicant , Lincoln Property , requested a change of zone on subject property from R3 to R3-PD- 28 . The Zone Change request had been filed to facilitate conversion of the existing apartment complex to condominium units . The applicant 's request was denied for the reason that it did not meet the R3 PD density limit of 25 units per acre , However , the staff was directed 'to investigate the condition's surrounding the application and report its findings to the Commission . The Commission direction evolved as a resv.lt of the possibility of incorrect information given to the applicant . The staff was further directed to initiate the zone change under tho direction of the Planning Commission if the applicant was in fact misinformed . I I ' 41 Zone Cast: No . 73 - 241% Page 3 In January of 1973 the Planning Commission initiated Zone Case No . 73=4 , The request b; the Planning Commission was to properly rezone the subject property Arom R3 to R4 -PD . However , on February 22 , 1973 , the applicant withdrew his request far Use Permit , Tentative Tract , and Zone Change approval . PRESENT LAND USE , ZONING , AND MASTER PLAN : The subject property is developed with a 342 unit apartment complex in the R3 Medium High Density Residential District . The property to the north of the= subject site is developed with an elementary school in a CF-E Community Facilities Education District , and an existing park site is located immediately west of the elementary school . The property to the west is developed with single family residences in a Low Density Residential District- . The Boardwalk Shop;iing Center is located to the south of the subject site in a C4 Highway Commercial District . A 119 unit townhouse development is presently under construction east of the subject ,property . The subject property is presently duster planned for medium high residential use . The existing zoning of the subject property and surrounding; land uses are consisten` with the Master Plan designation. ENVIRONMENTAL REVIEW STATUS : The Environmental Review Board ut its regular meeting of October 30 , 1973 granted Exemption Declaration No . 73 - 203 . The ERB found that the zone change would not have an adverse impact on the environment . However , the ERB does feel that the conversion may present some problems in regard to fulfilling the requirements of a PD zone . Therefore , the ER-k recommends that the City Council consider delaying the second reading of the Zone Case until after a Conditional Use Permit and A Tentative: Tract clap are filed . In addition , an Environmental Impact Report will be required . ANALYSIS : Base6 6n an analysis of the site plan and the existing conditions of the apartment complex , the staff has found that the conversion from R3 to R4 -PD does not fulfill two major requirements : 1 , Setback from public street a , minimum r©quired ' 15 feet b . existing; - 10 feet 2 . Off street parking a . required - 795 b . existing - 562 Jn addition , the Planning Staff agrees with the ERB ' s conclusion that the conversion of apartment to condominium may create Froblems . For example, the increase in family unit size typically generated by condominium type dwelling units may present a future problem in terms Zono Case No . AS- 24* Pago 4 of the number of '-chool rage chi tdren that would have tri be accommodated by the local school facilities . ;n terms of revenues and expenditures by residential t pe , condo- mi.niirr s generally yie"W a higher net gain than apartments when the unit count is less than 20 units per acre . However , since the density conversion involves more than 30 units per acre , the revenue/ expenditure profile would remain somewhat the sarae . CONCLUSION: The staff findings are not based on a final tentative map . Efforts were made to evaluate_e the conversion based solely on the at as lablc information and maps of the subject property . This is not the staff' s normal procedure :ir. evaluating request for zone. changes . However , due to the nature of the zone change request , the need to take this apalytical approach is appropriate . While the conversion of R3 to R4 -PD would not be inconsistent with the existing lane' rise and master planning of the subject property , the issue of whether the existing apartment complex will indeed satisfy the PRD requirements is in question . Based solely on the site plan , it does not meet all setback and off street parking requirements . However , it more than fulfills the recreation leisure and open space requirements as well as the minimum distances b etwee,i buildings . The staff can only conclude , based on conversations with the applicant , that no mitigating measures would be ►aken by the applicant to resolve the unfavorable conditions . The applicant ' s desire is simply tn see if a zone change of. R3 to R4 -PD would be granted based on the existing conditions of the sub(*ect property . The staff further feels that the Iiarbor Lights Apartment conversion may set a greater trend of a number of similar requests that may come before the Planning Conmii.ssion in the future . The purpose of this zone change request was to permit the conversion of 342 existing apartment units to condominiums. The reasons for this appeal follow: 1. The Staff Report from the Planning Department to the Planning Commission dated November 20, 1973, contained a material error which prejudiced the request of the applicant, Lincoln Property Company. Specificnl.ly, page four stated, "based on conversations with the applicant, no mitigating measures would be taken by the applicant to resolve the unfavorable conditions." This statement is incorrect. No one at Lincoln Property made any such statement. In fact, the contrary is true. The applicant is willing to make every effort to mitigate any unfavorable conditions. 2. The for objection of the Planning Department was an off-street parking deficiency. At the Planning Commission meeting, the applicant proposed to increase the number of off-street parking spaces to the number required by code. This would be t.ccompl•ished by creating additional parking spacers on undeveloped land adjacent to the apartment complex. This undeveloped land is owned by the applicant. The Planning Commission was unwilling to weigh the merits of this proposal. The project will conform with the surrounding uses in the area . NEGATIVE EFFECTS FROM THE PROJECT : None THE PROJECT WOULD BE ENHANCED BY THE FOLLOWING : 1 . The full insulation of all exterior walls and ceilings to re- duce the burden on heating and cooling systems . 2 . The disposal of all building spoils , such as unusable lumber , wire , pipe , and other surplus or unusable material at an off- site facility equipped to handle them. 3 . ENVIRONMENTAL STATUS : On January 29 , 1974 , a request for exemption status (ED 73-141) was approved by the Environmental Review Board . ilk transmittal is attahced for your review. ANALYSIS : In order to comply with Assembly Bill i4o . 1301 (Compliance of Zoning to Master Plan) the proposed Zone Change is consistent with the adopted Land Use Element (12-11-73) designation of Recreation Facilities , The existing use is anticipated to be preserved as one of the major active open space areas within the City. The existing use meets the intent and regulations of Article: 969 - Recreational Open Space . RECOMMENDATION: The staff recommends approval of Zone Change No . 73-19 for the following reasons: 1 . The proposed change of zone will comply with the Land Use Element designation of Recreational Facilities . 2. The proposed zoning designates a zone classification which is ,designed to acconuncdate uses such as a golf courses 3. The Zone Change will not b-i detrimental to the health, safety and welfare of adjacent people and property.
