The proposed zone change encompasses the Beach Club, Yacht Club , tennis courts and parking lot . BACKGROUND INFORMATION: On May 22 , 1973, the Planning Commission directed the staff to initiate zone changes For apprci�riate areas , from existing zoning designations to Recreation Open Space (ROS) designation pursuant to the second reading by the City Council of the neiv ROS ordinance . At the October 2, 1973 meeting, t}ie Planning Commission identified tzhe Huntington Harbour Beach and Yacht Cl:lb as one of the appropriate areas to lie rezoned to Recreational Gpen Space. However , the staff reconanended a continuance to November 20 , 1973 pending adopting of revised Stage Guidelinis of the California Environmental Quality Act of 1970 . The new Guidelines would provide direction to e staff r de er inin he best method e on the t f for t rn t p g for obtaining environment clearance„ At the meeting of November. 20 , 1973, the Huntington Harbour Beach and Yacht Club was identified as one of the four f4 ) top priority areas for the ROS zoning. The staff at this time was directed by the Commission to initiate a zone change for the subject property. 'ite ,abject facilities were established under Use Variance SOS.. apprcrmd by the Planning Cm rdssion 2/5/63. PRESENT LAND USE, ZONING AND LAND USE DESIGNATION: j The subject pr:—lerty is presently being utilized an a beach and yacht club including tennis courts , clubhouse, restaurant, sales office and parking lot. The property is zoned Rl, Low Density Residential District. It is designated on the Land Use ""lament, adopted December 11, 197 3, as Institutional/Quasi-Public. The property to the east and north is both zoned and developed as low density reeidentialo The marina (waterway) adjacent to the subject property is presently coned CF-A (Ccsmmunity Facilities Recreational District) . The property to the west is zoned R1 . , 5. PC 2/&'0/74 A A Staff Report Zone Change No. 73-30 Page 2 but developed under a variance as medium denaiity residential . The Land Use Element designated the property to the Mast and north as low density and the property to the west as medium density residential. The property to the south, the Aolsa Chica Land Reserve, is neither zoned nor developed. The Land Use Element designates this area as a planning reserve. ENVIRONHIENTAL STATUS: On January 29 , 1974 , a request for exemption status (ED 73-247) was approved -by the Environmental Review Hoard. (Transmittal is attached to staff report . ) ANALYSYS: The proposed zone change of the beach and yacht club is consistent with the adopted Land Use Element (12-11-73 ) designation of Institutional/Quasi-public. The existing 13e in anticipated to be preserved as one of the City ' s active open space areas . The present use meets the intent and regulations of Article 969 - Recreational Open Space. (Article 969 is attached to staff report. ) CONCLUSION: The proposed zone change for the Huntington Harbour Beach Club, Yacht Club and supporting facilities will promote ccnservati.on of land j=or open space purposes. It is the coneonsus of the staff that the existing uses meet the intent and regulations of Article 969 - Recreational Open Space. In addition, the staff further feels that the adjacent Huntington Harbour Marina and all of the remaining waterways should be rezoned to ROS. The intent and purpose of the ROS zoning designation and the uses permitted on both publicly and privately owned property is applicable to the waterways. RECOMMENDATION: The staff recommends approval of Zane Change No . 73-30 for the following reasons : I . The proposed change of zone will comply with the Land Use Element designation of Inatitutional/Quasi-Publin. 2. The proposed zoning designates a zone classification which Is designed to accommcdarte facilities such as this one. 3. Tho proposed zone change for this facility will not be detrimental to the health, safety, or general welfare of adjacent people or property. As set forth herein, such proviaionu are directed toward encouraging development of open space recreational uses in keeping with the natural surroundings , and emphasizing the need to conserve resources as well as scenery. S . 9691 Definitions. All definitions shall conform to Article 970 . S . 9692 Uses Permitted. Box 190 Huntington Beach, California Honorable Mayor and City Council: As the landowner of the properties affected by the subject zone case, we �r ah to go oa record in opposition to the proposed change of zone. Our reasons for opposing this zone change are based, not on the proposed golf course use, but on the nature of the proposed zone itself, and on uncertain future events. Nonbtheless, in our opinion, we believe the following arguments are valid as to the inappropriateness of this zoning change. 1. There is no logical or justifiable need for such a • one as ROS, Raersational Open Space , or for the inclusion of z golf course within such a zone. Zcning is designed to group compatible uses together in a single zone, while allowing the landowner to choose w;rich of these compatible uses he elects to place on his property. Both of the major golf courses in the city are zoned R-1. until the WS zone was recently enacted, a golf course was a permitted use within an R-1 zone and logically so. The compatibility of a golf course with residential uses has been amply demonshrated i;-i Huntington Beach as well as in cou:-itless other arcem. So until very recently the city 's master plan which showed golf course uses; and the property'3 zoning, R-10 were in conformance for both golf courses. At approximately the same time as the ROS zone was enacted, an unclassified use ordinance was enacted to cover uses that are relatively paw and are compatible with many different zones. Uses permitted in ell zones by this ordinance includes churches, private clubs, golf driving ranges, miniature golf courses, amusoment cente_B, and other commercial recreation uses, except 18-hole ,golf courses (emphasis adiad) . � 0 i City Council Page 2 March 14, 1974 So there axe two valid reasons why an XjS zone is not required, 1) a golf course is a compatible use with A-1 and could remain as a permitted use in that zones and 2) galf courses could easily by Included with the other unclassified uses that are permitted in any zone through the use permit procedure. 2. The ROS zone includes such a narro=# range of permitted uses as to be axbitrary and unreasonable . Fourteen, permitted uses are specified in the zone (see previous section of this letter) ,, and only two - tennis clubs and golf courses - can be said to have even marginal economic value to the land. We respectfully su:,mit that a zone such as the ROS zone is not designed for the same purpose as other zones within the city, to group compatible uses together, and does not belong in our city 's ordinances. 3. If the ROS zone serves no useful zoning purpose in the city, and if the uses perm1.t:ted within this zone are only :hose of a quasi-public nature, any landowner must ask himself :ghat is the purpose of imposing this zone on his property; and how will it affect his property value. The obvious and immediate effect of zoning My property ROS is to lower its open market value by 50% to 90% . The permitted uses are such that a parcel of land with this designation is virtually worthless As to the city Is purpose, in driving the value of the land downward toward zero, we can oily speculate. Does the city seek to acquire the subject land for public use at a bargain price through rezoning? We do not believe there is a conscious intent of this Co%mcil to implement such a plan; but what of future Councils? If i.LAng taxes and hi.ghe?' operating costs should, in the future, force us to ccnsider converting this golf course to a private club as many surrounding homeowners have, requestedl would a future City Council exercise its power of eminent domain to acquire the golf course in order to continue its public operation? CerteUnly this would be considered. And if a zoning such as this, which excludes all economic alternative uses, were on the property, its value might be so low as to be an irresistible bargain to such a future Council. We submit that a situation such as envisioned here is a quite possible ,scenario for the future, And that should it occur, it would represent: a grave min-use of a zoning law in a way it wan never intended. city 0owicil Page 3 March 14, 1974 4. The fourth, and last, argument that we offer against zcming the subject property in the proposed manner is the practical one of .flexibility in planning. The Seaclitf golf course was designed and constructed as the focal point of a generalized land use plan. As detailed plans of adjacent areas were developed, we have made many modifrications to the physical layout of the course. We have lengthened some holes, re-oriented others, expanded a fairway to allow views from a future roadr contracted another to make a better circulation pattern in an adjoining development. Each of these nimy modifications have been reviewed by the city throuyh the use permit procedure, promptly and expeditiously. These modifications were possible because the zoning of the course was the same as for adjoining areas. if the subject zoning is enacted, this flexibility will be lost. Each adjustment to the extexior boundary of the course to better integrate the adjoining uses will require an amendrient to the la,.id use element of the master plan, a formal rezoning procedure wit'.i the attendent pubic hearings, and probably, a complete Enviroanental Impact Report. It is safe to say$ that under these conditions, there will be no future boundary adjustments to the golf course. Planning of the adjoining properties will have to conform precisely to the lines drawn on the zoning map. This is another of the unfortunate side effects of using a zoning law to accomplish a .purpose ;:hat it was not intended for. However , since the time period in which action must be taken had expired, it was necessary for the applicant to agree to the continuance, otherwise no action on the part of the Commission would result in an automatic recommendation for denial. Mr. Jim Chaffin, representative for the applicant, stated that he would not agree to a continuance for decision. Summary of Staff Report: The applicant proposes to subdivide the subject property into 79 R1 lots (6 , 000 square foot minimum) encompassing approximately 19 . 5 acres of land- The applicant recognizes the marginal soils condition of the property (sub-surface peat bed) and feels that due to a 24-month surcharge (compaction) the site is sufficiently stable for single family development. The existing MH zoning was approved by the Planning Commission on September 1 , 1970 , and by the City Council on September 28, 1970 . From adoption of the zone change by Council to date, no develop- ment has occurred on the subject property. Although the request is in conformance with the Land Use Element to the General Plan and would result in a reduction of population potential , the request does not allow for a flexible development that would be able to be designed around identified environmental resources and geologic conditions . Specifically, that bluff would not be able to receive proper treatment in an R1 developnent. In addition, the Bolsa-Fairview fault is considered active and when the City' s Seismic-Safety Element is completed this summer: one of the implementing recommendations will be that the criteria of the Alquist-Priolo Geologic Hazards Zones Act apply. One of the criteria, that all structures be placed 50 feet from the trace of an active fault, would make it extremely difficult to develop the property as an Rl subdivision. An alternative to Rl zoning is the Rl PD zone. A low density PRD would allow for design flexibility around the identified environmental and geologic conditions. The bluff and fault zone areas could be. incorporated into the open space areas of the PRD. Also, developing properties to the north have been providing trail links along the bluff and such a link here would be a natural extension of the trail . Staff recommends that the application for .R1 be denied and/or the applicant requested to modify the zone change request to RI-PD based upon the following findings : 1 . Rl-PD would be in conformance to the General Flan of the City of Huntington Beach. 2 . RI-PD would allow for special treatment of environmentally sensitive areas of the subject property. 3.
