Porter Absent: Boyle Park Site of 2 . 9 acres Vote : Ayes : Geiger, Bazil, Kerins , Wallin Noes : Higgins , Porter Absent: Boyle Summary of Staff Report: Staff recommended that existing residential area on the north side of Taylor Drive be rezoned from Residential Agricultural to Low Density Residential , the designated width of 15 ft. be retained for the buffer zone , and that the park site be that of 2 . 9 acres . Additional Information : The City Council referred the items back to the Planning Commission for reconsideration . The issues the Planning Commission were to review were the size of the mark (2. 9 acres vs . 5 . 0 acres ) ; alternatives on buffering ; and a review of zoning designation for existing housing on the north side of Taylor Drive just west of commercial properties . A motion was made by Higgins and seconded by Porter to approve a 15 ft . wide buffer strip which would include 5 ft. parkway with no sidewalk with maintenance to be by the City. Vote : Ayes : Geiger, Higgins , Wallin, Porter Noes : Bazil , Kerins Absent: Boyle Th? MOTION PASSED. A motion was made by Kerins and seconded by Geiger to modify the buffer strip to 10 ft . with no sidewalk and maintenance by the City . Vote : Ayes : Bazil , Kerins, Higgins Noes : Geiger , Wallin, Porter• Absent: Boyle THE MOTION FAILED. Zone Change No . 73-21 December 10 , 1973 Specific Plan No . 73-1 Page 3 A motion was made by Bazil dnd seconded by Kerins to modify the buffer strip to 10 f t with sidewalk. Vote : Ayes : Bazil , Kerins, Higgins Noes : Geiger, Wallin, Porter Absent: Moyle THE MOTION FAILED . The Commission then discussed zoning. A motion was made by Wallin and seconded by Kerins that property indicated as low density be returned to original zoning as industrial land for reason that present property owners do have access to and will maintain access to Taylor Drive. Vote : Ayes : Wallin , Kerins, Geiger Noes : Porter, Bazil, Higgins Absent: Boyle THE MOTION FAILED . A motion was made and jailed for lack of a second to accept alternate plan indicating low density. A motion was made by Higgins to reconsider Commissioner Wallin ' s first motion that property indicated as low density be returned to original zone as industrial land for the reason that present property owners do have access to and will maintain access to Taylor Drive . Vote : Ayes : Higgins , Kerins , Wallin , Geiger Noes : Basil , Porter Absent: Boyle THE MOTION PASSED . Minority Report: Commissioner Bazil stated that if the property that is indicated low density is zoned for industrial use the City would have to prov;de access for said use to Taylor Drive since these parcels already front on Taylor Drive. Present owners could not make extensive repairs to their homes if needed because they would be non-conform- Ing uses . Industrial zoning would encourage the present owners to resort to bpckyard industrial operations . He stated that he felt it would be much better to leave property in single family residential zoning . Discussion followed as to the size of the park site . Mr. Norm Worthy , representing the Recreation and Parks Commission, addressed the Commission and spoke in behalf of increasing the size of the park to 5 acres . lie stated that an approximate 1200 sq. ft. building had been donated for use in the park and presented a layout of park in two different sizes . Mr. Ronald Russell , of the Five Points Homeowners Association, addressed the Commission and spoke in favor of a 5 acre park site as opposed to 2. 9 acre as recommended by the Commission . Minority Report: Commissioner Porter submitted the following minority report on Specific Plan No . 73-1 : 1 . If the school site hail _emained, the residents south of Taylor Avenue would have had more than 5 acres of recreational area . A 2 . 5 or 2 . 9 acre park will deprive them of a neighborhood recrea•;ional area comparable to other residential areas where schools are located. 2 . This area has been promisee a park for many years and has anticipated a recreational area of the size indicated above. To reduce that would be unfair. The funds are available to provide the larger site . 3 . Our adopted park standard is 5 acres per 1000 . It should be adhered to . Environmental Status : Exemption. This is t.hcc first attempt by the Planning Commission to use the Specific Plan provisions of the State Planning Act t:o ` take a small area of the City that has a number of problems and attempt to solve them on a comprehensive basis . The Specific Plan report transmitted herewith i is the culmination of that effort. Additional Information: Public Hearing: _ At the October 2, 1973 public hearing, Mr. Ronald Russell , President of Five Points Homeowners Association, stated ` that the majority of the homeowners do riot wish M1--A s zoning. Mr. Russell stated that if approved, it would : be their request that the City buffer away from the industrial tract to avoid any nuisance of interference with the tract, that they favored the closing of Taylor ' Drive and the opening of Huntington Street into Ellis. lie further stated that the Association approves the plan with one exception which is the size of the park . Mr. Russell stated that they would prefer a 5 acre park because it would accommodate the area, providing rest ' rooms and drinking fountains whereas a 2. 5 acre park site would not. He presented to the Commission, a petition from the Crest Homeowners Association to this effect. A mction was made and seconded to adopt Resolution No. 1127 and Specific Plan No. 73-1 . Commissioner Porter suggested that the motion be amended to change the area of the park site from 2. 5 acres to 5 acres . The previous motion was withdrawn. Although the Recreation and. Park Commission was firmly -ommit,ted to a 5 . 0 acre part site , the Planning Commission adopted the 2 . 5 acrc site as indicated in the Specific Plan. Essentially the difference of opinion between the two Co%-nissions was as follows : i Recreation and Parks Commission : The Recreation and Parks Commission recommeded 5 acres i for the following reasons : 1 . With the removal of the school site , the potential recreational area is reduced by .1.0 acres . 2 . The service area of the park includes 10 } acres of undeveloped R2 and 2 acres of undevel-- opeO R3 south of Ellis which in the future will generate a greater need for the park than now exists . 3 . In order to include into the design of the park open turf areas -suitable for running team i , games such as softball , football and hockey without the benefit of school play areas will � require a 5 acre site. 4 . The 5 acre park will provide a bet-ter buffer zone than 2 . 5 acres between the residential and industrial uses . 5 . The Ocean View School District is receptive to a joint-powers agreement to develop a neighborhood park at Robinwood which would fi a allcuated fends for Robinwood acquisition in the 1973-74 budget to apply at the Taylor site. Pl� anning Commission : The Planning Commission recommended the 2. 5 acres for the following reason3 : 1. The park service area is really those residential areas bounded by Talbert, Beach, Ellis , and the Southern Pacific Railroad. Based on the Master Plan and present trend po :ula}ion projection the ulti;nate population served would be 2538 with 509 children . Closure of 'I'a for D Is$ tabx ishment of buffer zone: - - fronting 'Taylor Dr . t GENERAL INFOMIATION ; On October 29 , 1973 these iteris and the Planninc, Cormnissions ' recemriendation were transmitted to the Cite Council as ado,?ted October 2 , 1973 . The City Council discussed the item considerably with special emphasis on the Taylor Drive part: site, existing res.identi.al dwellings and the buffer zone . The Council felt that the size and configuration of the park site and the buffer zone an well as alternatives to acc:onnoda•te existing dwelling units needed additional study . Thus, the City Council refer Specific Plan No . 73-1 and Zone Change No . 73-21 back to the Planning Commission . EXISTING RESIDENTIAL U14ITS An alternative to the proposed industrial desiqnation on the existing residential area on the north side of Taylor Drive is to designate it as Lour Density residential. This would also necessitate a rezoning of subject property from Residential Agricultural (RA) District to Low Density ;temidential (11 ) District . As a result of this alternative a condition of noncomp atible land uses will exist between the Late Density Residential District and the remaining 141-A Districts. gpecific Plan No . 73-1 Zone Case No. 73-21 However, the residential designation of the Master Plan anal Zoning Map will assure residents that the subject residential area will remain intact. This designation will be implemented in the adoption of Specific Plan No. 73-1 and Zone Change No . 73-1-1 . The staff feels that the residential designation should only encompass the existing housing area fronting approximately 495 ft. along Taylor Drive and extending back from the property line approximately 330 ft. The total residential area would account for approximately 6 . 25 acres , HOUSING RECOMMENDATION: The staff recommends that the subject residential area be designated as Low Density Residential in Specific Plan No . 7.3-1 and be designated Rl in Zone Change No. 73--21 . DUFFER ZONE: The proposed 15 ft . width of the buffer zone is based on the possible use that may occur between the buffer zone and the required building setback of 45 ft . For .instance, a developer may want to use the setback area for parking or open storage . If used for parking , a 20 ft . through driveway with a 10 ft. parallel parking area may be constructed within the remaining 30 ft. width between the buffer and building setback . Thus , the buffer zone width of 15 feet was designated as a result of this analysis . BUFFER ZONE WIDTH RECOMMENDATION : The staff recommends that the designated width of 15 ft. be retained . TAYLOR DRIVE PARK SITE: Due to the pending issue regarding the size ar.d configuration of the park site before the Administration, the staff can only restate its earlier recommendation of a 2. 9 acre park site at this time . Additional information and graphics will be presented by the Recreation and Parks Department and the Planning Depart- ment staffs at the December 4 , 1973 meeting. This is the first attempt by the Planning Commission to use the Specific Plan provisions of the state Planning Act to take a small hrea of the City that has a number of problems and attempt to solve them on a comprehensive basis . The Specific Plan report transwitted herewith is the culmination of that effort. Additional Information: I Public Hearing: At the October 21 1973 public hearing, Mr. Ronald P;ussell , President of Five Points Homeowners Association, stated that the majority of the homeowners do not wish MI.A zoning . Mr. Russell stated that if approved, it would be their request that the City buffer away from the industrial tract to avoid any nuisance of interference with the tract, that they favored the closing of Taylor Drive and the opening of Huntington Street into Ellin . He further stated that the Association approves the plan with one exception which is the size of the park . Mr. Russell stated that they would prefer a 5 acre park because it would accommodate the area, providing ::est rooms and drinking fountains whereas a 2 . 5 acre perk site would not. He presented to the Commission a petition from the Crest Homeowners Association to this effect. A motion was made and seconded to adopt Resolution No. 1127 anu Specific Plan No. 73-1 . Commissioner Porter suggested that the motion be amended to change the area of the park site from 2 . 5 acres to 5 acres . The previous motion was withdrawn . A new motion was made and seconded to amend the size of the park site from 2 . 5 acres to 5 acres . Roll Call Vote : Ayes : Porter, Boyle Noes : Geiger, Bazil , Higgins , Kerins , Wallin Absent: None The Motion Failed . Specific Plan No. 73-1 Zone Case No. 73-21. Page 3 A new motion was made by Geiger and seconded by Wallin to adopt Resolution No. 1127 and Specific Plan No. 73--1 as amended and including addendum submitted on October 2, 1973 by the staff. Poll Call Vote : Ayes : Geiger, Bazil, Higgins, Kerins, Wallin, Boyle Noes : Porter Absent: None Commissioner Bazil stated that he would like to have recorded in the Minutes that while he voted for approval of the Specific Plan and Resolution No. 1127 , he was not in favor of the property immediately in back of the Chevrolet Agency being zoned MI-A due to the small size of the parcels . On motion by Boyle and seconded by Geiger zone Case No . 73-21 was approved by the following vote : Ayes : Geiger, Bazil , Higgins , Kerins, Wallin, Boyle Noes : Porter. Absent: None Minority Reports Commissioner Porter stated that he voted against Specific Plan No. 73-10 Resolution No . 1127 and Zone Case No. 73-21 solely on the basis of the size of park site . Mr. Porter stated that this site was recommended by the Recreation and Parks Commission for 5 acres , and that it is noted that a 2 .5 acre park not adjacent to a school site is both inconsistent witH- the present City standard of 5 acres per thousand population and also inadequate for the area proposed to by served. Environmental Status : Exemption Declaration No. 73-162 was granted on August 21, 1973 by the Environmental Review Board. Taylor Street Park Site: Although adopted in the specific: plan as a 2 . 5 acre park, the Taylor Street Park was still an item of disparity between the Planning Commission and Recreation and Parks Commission. During the course of the Specific Plan study this was the subject of numerous correspondence from the Recreation and Parks Commission to the Planning Commission. (Refer to memos in appendix of Specific Plan report . ) Specific Plan No. 73r-1 Zone Case No. 73-21 Page 4 At the October 2 , 1973 public hearing , the disparity was the size of the park site. Although the Recreation and Park Commission was firmly committed to a 5 . 0 Acre park site , the Planning Commission adopted the 2 . 5 acre site as indicated in the Specific- Plan. Essentially ,the difference of opinion between the two Commissions was as follows: Recreation and Parks Commission: The Recreation and Parks Commission recommeded 5 acres for the following reasons : 1 . The service area of the park includes 10 acres of undeveloped R2 and 2 acres of undevel- oped R3 south of Ellis which in the future will generate a greater need for the park than now exj sts . 3. In order to include into the design of the park open turf areas suitable for running team games such as softball , football and hockey without the benefit of school play areas will require a 5 acre site . 4 . The 5 acre park will provide a better buffer zone than 2 . 5 acres between the residential and industrial uses . 5. The Ocean View School District is receptive to a joint-powers agreement to develop a . neighborhood park at Robinwood which would free allocate: funds for Robinwood ar ,isition in the 1973--74 budget to apply at thy: Taylor site . Planning Commission: The Planning Commission reconmiended the 2 . 5 acres for the following reasons : 1. The park service area is really those residential areas bounded by Talbert, Beach, Ellis , and the Southern Pacific Railroad . Based on the Master Plan and present trend population projection the ultimate population served would be 1539 with 509 children. Present population is approximately 979 with 355 children. Specific Plan No . 73-1 Zone Case No. 73-21 Page 5 2 . The park site should be large enuugh to provide basic recreatici: and park needs to serve this neighborhood. Although the provision of more acreage would be: nice, given present conditions , it is felt that other areas of the City are & so it need of park facilities and they should take priority over a larger park at Taylor Street. 3 , Upon completion of Ellis Avenue, this neighbor- hood would be within h mile of the Huntington Central Park which , although it is of a passive nature, does provide significant open space benefits which are readilY. accessible . Since the issue was not resolved between the two Commissions , subsequent to the October 2 , 1973. public hearing the staff of the Recreation and Parks Department, Planning Depart- ment, and City Administrator' s Office attempted to resolver the ark site size issue b schematically designing the p Y Y 9 g park according to need requirements rather than a predeter- mined size. Two alternatives were developed - one at 5 . 0 acres and one at 2 . 9 acres . The difference between the two alternates was that the 5. 0 acre schematic provided 2 softball fields instead of one and an extra . 9 acre of open space that could be put -to some other recreational use . On October 26 , 1973 a meeting was held between the afore- mentioned staff and it was determined that the 2 . 9 + net acre park site would beat serve the interests of both the adjacent neighborhood and the City at large . Recommended Action: Planning Commission Recommendation: That the City Council adopt Specific Plan No . 73-1 by revolution as stated in Article 9 Section 65503 of the State Planning Act regarding the prncedure for adoption of Specific Plans and regulations . The Planning Commission also recommends that the City Attorney be directed to prepare an ordinance for Zone Case No. 73-71 . Staff Recommendation: pur3uant to the meeting where the 2 . 9 acre park site was determinL-d to be in the best interest of the neighborhood and City at large, staff recommends that the City Council consider amending the Specific Flan document to reflect a 2 . 9 acre park site instead of the 2 . 5 . If the City Council does amend the Specific Plan, it will have to refer the amendment to the Planning Commission for a report within 40 days as provided in Article 9 Section 66504 of the State Planning Act.
