The Environmental Review Board at: its meeting of January 21 ,
1975 , granted the above exemptio,, declaration , having found
that the proposed project will nut have a significant adverse
effect upon the physical environment .
No environmental impact report has been rrepared for this pro-
ject , and the Negative Declaration issued for the project has
been properly posted in the office of the City Clerk .

1 . This Zone Change may lead to economic effects beneficial
to the City .
2 . If the Zone Change application is successful , no further
environmental documents need be prepared for the subsequent
Use Permit required by the 0-1 district

BACKGROUND INFORMATION :
Tentative Tract 8687 , a. proposed 79 unit condominium development
located on the southeast corner of Ellis Avenue and Chapel Lame ,
was filed with the Planning Department in June , 1974 . After re- �
viewing the proposal, it was determined that a. Conditional Exception
to allow the averaging of densities over the total site wo:ild have
to be filed. The Conditional Exception was considered and denied
by the Planning Commission at its meeting of September 4 , 1974 .
The applicant appealed the Planning Commission ' s decision to the
City Council .
The City Council , at itr meeting of October. 21 , 1974 , approved
Conditional Exception No. 74-02 . In its approval action, the City �
Council rz^ommended that the applicant initiate a change of zone
from R1 (Low Density Residential) and R3 (Medium High Density
Residential) to R2-PD-8 (Medium Density Residential-Planned Develop-
ment - Eight units per acre . )
Zone Change No . 74-21 was filed by -he applicant on October 30 , 1974
as recommended ., The Planning Commission, at its meeting of December
17 , 1974 , denied the petition by the following action :

designation of the General Plan and thus recommended approval .
ENVIRONMENTAL STATUS :
Exemption Declaration No. 74-94 was granted by the . Envirutunental

The City Council at its meeting of October 211 1974 approved
Conditional Exception No. 74-02 on property located on the
southeast corner of Ellis Avenue and Chapel Lane . The Con-
ditional Exception allows the averaging of densities on a
79 unit condominium project.
In Its approval action, the Council recommended that the ap-
plicant initiate a change of zone from R1 (Low Density Resi-
dential) and R3 (Medium High Density Residential) to R2-PD-8
(Medium Density Residential - Planned Development - Eight
units per acre) . The applicant verbally agreed to pursue
such a request.
On October 30 , 1974 , the applicant, Lo•.:is Graziadio, filed a
petition for the change of zone as recommended . The Planning
Commission at its meeting of December 17 , 1974 denied the re-
quest. In order for the City Council to consider the recommended
zone change, the petition has been set as a public hearing item
for the January 20 , 3.975 City Council meeting .

The Planning Department artment wishes to have Z . C . 74-21 set for
City Council Public Hearing on January 20 , 1975 .
The City Council requested that the appI..icant petition for the
aforementioned Zane Change . The petition for the Zone Change
was denied by the Planning Commission with the intention to
refer it to the City Council . Although the minutes and tape
of the Planning Commission are not precise on this muter; it
is this Department' s interpretation that the petition was denied
with the intention of transmitting the Commission' s action to

The Planning Staff recommended the following action on Zone Change No.
74-20 :
Parcel #1
That the request from C4 to R4 be denied for the following reason :
The request Is not in conformance with the General Plan and the ap-
plicant has not presented sufficient justification to warrant changing
the Land Use Element and zoning to high density residential and R4 .
Parcel #2
That the request for R1 to C4 be approved for the following reason :
The request is not in conflict with the General Plan and is the most
suitable zoning designation for the parcel .
The staff further offered an alternative cotirse of action had the
Planning Commission been in(I.Aned to approve the applicant' s request.
Since the residentiai portion of the request is in conflict with the
General Plan , the LLnd Use Element must be amended to permL t the zone
change. Rather than applying the standard residential and commercial
zoning districts to the property, the Staff would recommend that the
Applicant prepare a specific plan study for the property which would
contain an environmental and economic analysis and phased development
program. This study could then be used as the basis for an amendment
to the Land Use Element and a specific plan ordinance .

SUMMARY OF STAFF REPORT:
Zone Change 74-20 is a request for a two pert change of zone within
the 32 acre area between the Huntington Center and the San Diego
Freeway (Refer to Figure 1 of the staff report) . A change from C4
to R4 is requested for parcel # 1 (7� acres) and Rl to C4 for parcel
#2 ( 3 acres) . Each request was analyzed separately as the issues
involved are substantially different.
Parcel #1
in analyzing the request for parcel # 1 , which is in conflict with the
Land Use Element of the City ' s General Plan , the staff found three
significant planning issues involved :
1 . Preliminary information from the City ' s noise consultant indicates
that a portion of the parcel may be within the "normally unacceptable"
noise level zone because of the proximity of the parcel to the freeway.
However, there could be attenuation techniques that would bring the
noise levels within acceptable ranges .
2 . The City has submitted for federal funds for acquisition and con-
struction of a multi--modal transportation center in this area .
Additionally OCTD has proposed a park and ride facility in the
vicinity of this parcel . The subject parcel appears to be the
most desirable land among the limited number of undeveloped parcels j
within the Huntington Beach City limits for this use .
3 . The applicant has contended that parcel #1 is not presently market-
able as commercial land . The staff feels, although there is not
extensive economic data to substantiate this conclusion , that the
Huntington Center area possesses the qualities necessary to develop
into a viable regional commercial node .
Based on the preceding analyslop staff has concluded that parcel #1 ie
more suited for commercial use and therefore should remain C4 .
Parcel #2
The present Rl zoning designation was automatic upon annexation as the
City did not prezone or request any other zoning designation . When
considering the adjacent land use , zoning and the adopted Land Use
Element, Staff feels that low density residential developmei-st is

not feasible for the property and has concluded that the proper land
use designation is retail commercial . The applicant' s request for
C4 zoning is in conformance with this conclusion, although the area
should be modified and the subject area properly identified .
ENVIRONMENTAL STATUS :
The Environmental Review Board at its meeting of November 12 , 1974
granted Negative Declaration No. 74-160 having found that the proposes
project will not have a significant adverse affect upon the physical.
environment.
RECOMMENDATION :
'The Planning Commission recommends approval of thy-, request for parcel
#2 , a change from R1 to C4 , and denial of the regviest for parcel #1,
a change from C4 to R4 .

1 . 0 GEtIERAL INFORMATION :
The applicant is requen ing a two part change of zone within the
32 acre area between Hun-tington Center and the San Dingo Freeway
(Refer to Figure 1) . A change from C4 to Ito is requested for
Parcel #1 (7 1/2 acres) and R1 to C4 for parcel 02 (3 acres) . The
request for parcel " 1 is not in conformance with the General Plan .
Each request will be analyzed separately as the issues involved are
substantially different .
2 . 0 APPLICANT' S STATI.AENT :
"Parcel # 2 -- This parcel is zoned residential as it was just annexed
to the City and normally comes into the City with that zone . The
parcel was zoned C4 prior to annexation . All the zoned property su .•roundin
this parcel is C4 and clearly that is the appropriate zone . Parcel 41
Our master plan of development: For the entire 3Z acres parcel includes a
hotel , offica building , multi-unit cinema and a restaurant and specialty
center of approximately 155 , 000 square feet . Between this project and
the Huntington Center there iv, additional need for commercial uses.
There is , however, a substantial need for multi-family zoned properties.
There is a need for housing the tenants and employees of the retail
centers along with additional usoru . The property is ideally located
for apartment use because of its accessibility to the freeway and
retail shopping facilities , city streets etc . will he minima ' ly taxed
because of this accessibtl ify . "

3 . 0 ANALYSIS OF REQUEST :
3 . 1 EXISTING LAND USE, ZONING, AND GENERAL PLAN:
Graphically depicted in figures 2, 3 , and 4 for the vicinity or the
zone change request and adjacent quarter sections within the City of
Huntington Beach are existing land use, zoning and the band Use
Element to the General Plan .
3 . 2 PARCEL 1-C4 to R4 :
A change of zone from C4 to R4 on Parcel #1 is in conflict with the
Land Use Element of the City ' s General Plan. If the Commission were
to take action to approve the zone change request, the Land Use Element
would have to be amended prior to final action on the zone change .
In analyzing the request Lor this parcel. , Staff found three significant
planning issues involved: the proximity of the parcel to freeway
noise, the proposed multi-modal. transportation center for thi3 area ,
and the viability of the Huntington Center area as a regional.
commercial area.
3 . 2 . 1 NOISE:
Preliminary information from Wiley Laboratories , the C ity ` s consultant
for the Noise Element , indicates that. a portion of the parcel may
be within the "normally unacceptable" noise level zone for high
density residential development, with much of the parcel falling in
the Ldn65 and over sound level (refer to Figure 5) . While the map
contours cannot be interpreted as absolute locations of these
contours , they do dive an indication of the noise conditions that
exist on the parcel. Also, there are attenuation techniques that
can be used for the site and residential s!:ructures to bring the
noise levels within acceptable ranges .
3 . 2. 2 MULTI-MODAL TRANSPORTATION CENTER:
The City has submitted an application for federal aid urban "D" funds
for acquisition and construction of a multi-modal transportation
center in this area. Along with this effort, OCTD has proposed a
park and ride facility in the vicinity of the San Diego Freoway and
Beach Blvd. as part of its park and ride/freeway bus program study.
Atypical facility of this nature would encompass about S acres .
Considering these proposals and the fact that the OCTD MRS, corridor
along the P. E. Railroad is adjacent to the property, it appears to
be the most desirable land among the limited number of undeveloped
parcels within the Huntington Beach corporate limits for this use.
However , it should .be pointed our: that these proposals are either prelim-
inary or are in the long range . j

3 . 2 . 3 REGIONAL COMMERCIAL VIABILITY :
The applicant' s basic contention is that the 7 arse parcel is not
presently marketable as commercial land . Here, as in a previous
zone case (LC 74- 1) , the Planning Staff feels the issue must be
viewed in a long range context and not on short term marketability .
Beyond this contention , he has not submitted any economic data
to substantiate this conclusion for the long range .
The issue is the viability of the Huntington Center area as a
regional commercial node . Although there is not extensive economic
data and analysis to substantiate this conclusion , the Staff feels
that. the Huntington Center area possesses the qualities necessary
to develop into a viable regional commercial node . This not only
includes development of undeveloped parcels but further intensifi-
cation of existing commercial development .
It can be argued that _1 .ir thi,3 type of commercial area to
develop there is a supporting need for higher density residential
development . However , the band Use Element and zoning designates
approximately 26 acres in the area for medium and medium high density
residential development .
3 . 2 . 4 CONCLUSION PARCEL # 1 :
Through the preceding analysis Staff has concluded that Parcel # 1
is more suited for commercial use as part of the tuntington Center
commercial area than high density residential and , therefore, should
remain C4 .
3 . 3 PARCEL 02 R1 to C4 :
Recently annexed to Huntington Beach, Parcel # 2 has no designation
on the Land Use Element as it was previously outside the City ' s
planning area . The R1 zoning designation was automatic upon
annexation as the City did not prezone or requ-.st any other zoning
designation.
Considering the adjacent land use, zoning and the adopted hand Use
Element, Staff feels that low density residential development is not
feasible for the property and has concluded that the proper land
use designation is retail commercial . The applicant' s request for
C4 zoning is in conformance with this conclusion.
Even though the parcel presently has no designation on the Land Use
Element, the Staff does not feel that approving th,- zone change
request to C4 would be in conflict with the General Plan. However,
as part of tha next amendment to the Land Use Element, the planning
area should be modified and the subject area properly identified.

4 . 0 STPFF RECOMMENDATION:
The Planning Staff recommends the following action on Zone hang.

justification to warrant changing the Land Use
Element and zoning to high density residential and R4 .

parcel .
5. 0 ALTERNATIVE COMMISSION ACTION :
If the Planning Commission is inclined to approve the applicant ' s
request, the Staff offers -an alternative course of action . Since-,
the resi.dertial portion of the re-quest is in conflict with the
General. Plan , the Land Use Element must be amended to permit the
zone change . Rather than applying the standard residential and
commercial zoning CAstricts to the property , the Staff would
recommend that the applicant prei)are a specific plan study for the
property which wovid contain an environmental and economic analysis.
