Rowlands , City Administrator RE: Zone Case No. 74-3 Applicant: Huntington Beach Planning Commission Location: The three (3) oil islands within the 'boundaries of the Seacliff Golf Course located at the west end of Palm Avenue approximately 2 , 000 feet west of. Golden- west Street. Request: A change of zone on the three oil islands from R4--01 , High Density Residential combined with oil production, to ROS--01, Recreational Open Space combined with oil production. Planning Commission Action: L!pproyed: March 5 , 3.974 Vote : 9YES : Kerins, Wallin, Boyle , Porter , Geiger, Pazil NOES : None ABSENT: None ABSTAIN: Higgins Summary. of Staff Report On October 21 19731 the Planning Commission designated the Seacliff Golf Course and existing oil islands, as one of the appropriate areas to be rezoned to Recreational Open Space . The existing use is anticipated to be incorporated with the golf course as one of the major active open space areas within the City. The proposed Change of zone w-111 promote conservation of land for open space purposes. It is the consensus of the staff that the existing uses meet the intent and definition of the Planned Community Concept. Additional Information At the February 20 , 1974 meeting the Planning Commission approved a portion of Zone Change 73- 31 , the R1-0 portions of the Seacliff Golf Course to ROB-0. The remaining portions of the zone change, the three interior oil islands R1-01 to ROS-01 and the four adjacent islands to the east R4-01 to R1-01 were: advertised incorrectly. The Planning Commission directed that these be roadvertised and ,set for public hearing. 1 PAGE 2 The oil islands were given a new zone change number, 74-3 and were to be submitted to the Environmental Review Board for an environ- mental essessment to determine if the Exemption Declaration (ED 73-248) for Zone Case 73-31 was valid for Zone Case 74-3 . At that time it was found that the four oil islands , R4-01 to Rl-01 had been added to Zone Change 73-31 without proper consideration from the Environmental Review Board. The Board determined that a new Exemption Declaration would have to be filed. Therefore the four adjacent oil islands were deleted from the present zone change . During the public hearing Mr . Jack Wallace of the Huntington Beach Company spoke in opposition to the proposed change of zone . The Commission approved the change for the following masons : 1 . The Proposed change of zone will comply with the Land Use Element designation of planned Community as required by State law. 2. The zone change will not be detrimental to the health, safety, and general welfare of adjacent people and property. 3. The proposed change of zone will promote a more compatible future use of this land within the land uses surrounding them. Environmental Status The Environmental Review Board, at ita meeting of March S , 1974 , found that Exemption Declaration No . 73--248 was valid for the proposal . J STAFF REPORT PAGE 2 The Lnvironmental Review Board heard Exemption Declaration 7 4-- 3 0 on February 26 , 1974 and did not .,%c t on the Exemption Declaration requesting more information on the P4-01 to RI-01 portion of the zone change . With this action taken by the Lnvirozunental Review Board staff felt that the Zone Change 74- 3 request merited reconsideration . Staff feels that the R1--01 to ROS--01 zone change on the oil islands within the golf course is of more immediate concern than the R4-01 to R1-01 zone change on the islands adjacent to the course and that the Planning Commission .should take action on the oil islands within the golf course at the March 5 , 1974 meeting. Staff feels that this would be within the original Exemption Declaration (73--248 ) granted by the Environmental Review Board . The Environmental Review Board will be making an environmental assessment at the l-larch 5 , 1974 meeting and transmitting their findings to the Planning Commission that evening . If the Planning Cormnission approves this zone change it can be transmitted to City Council to be heard concurrently with the other ROS zone changes of February 20 , 1974 . RECOMMENDED ACTION : Approve Zone Change 73-4 deleting khe proposed changes from R4--01 to Rl--01 on the four oil islands adjacent to the Seaclif.f Golf Course. The +tennis courts were approved in August of 1972 under Use Permit. No . 72-43 . On October 21 1973 , the Planning Commission dae.44.ynated the Seacliff Golf :'ourse , which includes the clubhouse, - tennis courts, parking lots and existing oil islands , as one of the appropriate areas to be rezoned to Recreational Open Space . At time meeting of Novemober 20 , 1973 , the Seacliff Golf Course was desigriated as ane of four top priority areas for the ROS zoning. PRESENT LAND USE, ZONI14G AND LAND USE DESIGNATION: There are two (2) land uses utilizing the land involved in this zone change . T'no major portion of this land is utilized by a golf course and Supporting facilit::Les , i. e . , clubhouse, tenr is court.4 , and parking lot. The remaining portion of this land is utili7.d by productive oil wells . The golf course and facilities encompass approximately 137 . 5 acres , the oil islands utilize approximately 14 . 4 acres . The islands are divided into two (2) categoriev The islands within the boundaries of the golf course comprise 5 . : acres , the islands outside of the boundaries comprise 8 . 7 acres . There are two (2 ) existing zoning categories for the subject property . The Land Use Element adopted December 11 , 1973 designates the golf course and facilities as Recreational Facilities/Golf Course . All of the oil islands are de-signated as Planned Community . Box -10 tuntington leach, California Honorable Mayor and City Council: As the landowner of the properties affected by the subject zone case, we wish to go on record in opposition to the proposed c;hmige of zone. We believe this change of zont2 to be inappropriate For the following reasons: 1. These Islands have been zoned for residential use since 1965, and have been shown as such on the city 's master plan. The proposed zoning would be inconsistent with the land use element of the master plan. The Huntington Seacliff master plan and the city 's own planning forecasts have always envisioned these areas for residential use. Streets , utilities, drainage, golf course layout, access and many other factors have been designed for t';lat eventual use. To now designate these lands as open space Jamages the entire planning and economic concept of the Huntington Seacliff Planned Community. 2. Although these parcels are exceptio.ially well suited to residential use, containing sites that would be unique in the city; they have no practical use if zoned ROS as propost d. The golf course, 3.g presently structuLed, has more than ample space for an outstandinG 18 holes and all ancillary facilities. The only possible golf course usu of these Islands would be to add, perhaps, two more holes. BuL a 20-hole golf cour►1e makes little sense. None of the other permitted uses in the RCS zone (Arboretum, archer range$ athletic fields, bird sanctuary, boating, fishing ponds, picnic grounaa, tennis clubs, recreation centers, swimming clubs, visL:al arts festival ground, water skiing, or zoo, ) appear to be practical considerations for these parcels. In fact, no practical ROS use has been suggested for these Islands by any of the agencies implementing this zone change. We can only conclude that the end result of this portion of the zone change would be for the land to remain vacant and unused when its present use is terminated. • City Council Page 2 March 14, 1974 3 . The City Council, and many citizen groups, have recommended that it be the policy of the city to encourage the development and maintenance of private open space within the city. The adopted Policy Plan developed by the Citizen Goals and Objectives Committee recommends that such tangible items as tax incentives be utilized as bonuses for developing such private open space. The rezoning of parcels planned for years as residential to canpletely non-productive uses runs absolutely counter to the idea of incentives to develop and maintain private, open space. 4 . A number of irregularities have occurred in the procedures and the processing of this portion of the zone change. a. The Exemptioi Declaration processed to avoid preparation of P-n EIR on this zone change contains several material errors of fact. It states that there will be only a trivial economic effect upon the area; when in fact , the change is from extremely valuable residential land to almost worthless land. Further, it states there are no alternatives to the rezone, when in fact there are many such alternatives. b. As stated previously, the existing lard use element of the city's master plan shows this area as residential, not open space. The master plan should be amended before, a rezoning net in conformance is adopted. c. The ROS ordinance states that it is to be applied to parcels of five acres or larger. None of these three parcels is as large as five acres. Technically, this can probably be circumvented by considering them as part:, of the ?arger golf course; but they are not a part of the golf course and have never been intended to be part of the golf course. d. The implementing agencies have never initiated discussions or consultations with the landowner on hoar this rezoning might: affect his plans for the property or for his surrounding property. The parcels covered by this zona case are an integral part of a 700 acre master plan, and each parcel should not be considered in a vacuum, ignoring its effect on ot:acr surrounding parcels. Based on the above facts, we respectfully urge the, City Council to deny this Eruposed zone change. P P Y This matter was the principal item of business at our general meeting of April 17, 1974, attended by over 75 members of our Association. Representatives of both the City Planning Department and the landowner attended this meeting and made excellent presentations of their views all this zone case. They also participated in an exter:six?e question and answer session in order to fully explore the matter with our members. Following their departure, this matter was further discussed, and a vote of our members taken. The vote of our membership waa 96% in favor of the CitXCourcil denying this zone change and that the subject islands remain designated for residential use. The fact that the vote was almost unanimous to oppose this zone change indicated that wo feel there is a clear preference of the homeowners most affected, and we urge you to ccnsider carefully this preference in your deliberations. � ! AIM "FRIENDSHIP AND UNITY DUILDS OUR COMMUNITY" HUNTINOTON BEACLdfrR HOMEOWNERS AMMIATION Page 2 Two major factors were involved in our conclusions on this matter, and since they may have some applicability to future actions of the Planning Commission and City Council, we would like to convey these to you. First, and most important, is the face that most of us purchased our horr;es in the Seacliff community, not only because of the individual home and immediate neighborhood; hilt because we liked the entire concept o` iiis master planned community oriented toward major recreational facil ties. We felt that such a plan , if responsibly followed, would result in a long-term continuing improvement in the entire area that would prb'rect and enhance our investments in our homes. We recognized that a plan with as broad a scope as the Seacliff master plan involved numerous trade-offs between amenities, economics, densities continuing oil operations in the area, etc. We assumed that both the City and the landowner had carefully considered these trade-offs, and had agreed that the resultant plan was acc,-ptable to both the public and the private sectors . We like the development thus far, which is why we purchased homes here; we are generally in accord with the projects now in the pin.rtning stage; and we are very concerned that the ultimate plan: be carried out in approximately its present conception. It appears to us that the Huntington Beach Company, as landowner, remains committed to the development r^ the area as originally conceived; and we believe that its long-term realization requires that the City also honor its commitment to the plan. Any s Vostartial changes , such as t!iis zone case, that materially affects the overall economics of the plan can only lead to further modifications in order to attempt to regain the losses. All of the residents would be very disappointed to see this procese begin. The second major consideration in our opposition to the zone change is the somewhat casual way in which it appears to have been initiated and processed. It is our understanding that the zone case was .initiated by the Planning Commission as a result of the adoption of a new zoning classification; Recreational Open Space. Apparently, the reasoning was that if you have a new zone available, you have to use it. We feel that these also should be considered as they are presently zoned R• 4 and one island is z►:)ned R-5. We feel that these 5 zones uhould be re;,oned to R-1 as that is the zoning of the developed areas that they abut. We also feel that one island in the golf course area between the first and nintz fairways and the one that is the closest to presently developed area should be iezoned R-1 now. The two islands that are adjoining the undeveloped areas should -emain in R-4 zoning until such time that the adjoining areas are developed and then they can be rezoned if necessary to coincide with the adjoining developments. We were informed by the P:tanning Department representatives that no considera- tion was given to what possible uses would be allowed in these rezoned RO5 areas, and we could find no acceptable uses ourselves. This , we feel, is poor planning on the part of the Planning Commission. They did not discuss with the landowner nor residents of the area what effect this rezoning would have on the master plan of this area and of what possible benefit this rezoning would have to the area and the community at large except trying to keep down density. We ourselves would like to see as little density as possible but this has to be economically possible to the developer and, he has already demonstrated that he is willing to reduce density from the original master plan and we feel that his already demonstrated good faith should not be ;abused by the city. If the Planning Conunission had some recommendations for the possible use of these 3 areas it might have made some difference but just because they had a new zone and they wanted to apply it does not seem reasonable to us . DISCUSSION- -QUES TION 2 : The recreational open space district permits a number of uses including arboretums , archery ranges , athletic fields , fishing ponds, boating facilities , golf courses ( including country clubs and pro shops ) , picnic grounds , racquet and tennis clubs , rec- reation centers , swimming pools and clubs , and several other enumerated' uses . Zoning of the property to ROS is compatible with the surrounding use of the property , which is a golr course, and further the ROS is combined with an 1101" oil district . The 01 oil district allows use of the. property for, oil production, the only use to which the property is being, utilized . Therefore, the property owner is not being deprl ved of any present use of his property . If the oil operation nhould eventually be phased out at somF time in the future , becau:! e it becomes uneconomical to , produee oil in view of a diminishing production, then the property owner always has a right to veyuest a rezone of the property at that time . The intersection of Atlanta and Beach merits all the critaria and planning rationale set forth in the Land Use Element for a community commercial • arca (refer to Section 4. 3. 2 Land Use Element, attached, Figure 3-1) . The applicants justification for this requefit is that the area is oversaturated with commercial zoning and that the projected population would r .t generate a demand for that amount of commercial zoning. To support his contention he has presented an �conomic survey of the subject property . To evaluate this request the Planning Department staff. re-analyzed the population potential and ciurrently zoned and planned commercial acreage within the McConnell Study area and also the service area of the commercial node at the intersection of Atlanta and Beach (refer to attached map and table Figure 3-2 & 3--3) . The analysis found that within the McConnell survey area a retail commercial zoning acreage,,of 6:..2 acres par 1 ,000 population prevailed and within Lhe freeway service area a ratio of 4 . 6 acres per 1,000 population exi►3ted. This substantiates the applicants contention that these areas are oversaturated with commercial zoning. This suggests that a reduction of commercially zoned land would be desirable within the service area. A policy of the City (refer to Policy Plan, Development Section, Commercial Development and Tourism, Principle 4) is to "control general commercial shopping centers, through zoning reduction" . Also the Planning Commission has expressed a desire to reduce the amount of strip commercial zoning on Beach Boulevard . 'thus , in analyzing the commercial zoning pattern within the primary service area (refer to Figure 3--4) the most logical areas to reduce excess commercial acreage would be the commercial strips along Beach Boulevard sough of Atlanta Avenue and create a commercial node at the intersection of Atlanta and Beach . It should be painted out that the proposed zone change request would leave an island of commercial land between the proposed PRD and the single family homes to the north. 4. 3.2 Commercial - 1. Vie southwest corner of Atlanta and Beach is in the VTN study area and is an unknown at Lhis time . For purposes of this analysis the planning staff assumed the basic philosophy of the Top of the Pier development plan would prevail in this area . Sec. 4 .0 CONCLUSIONS AND RECOMMENDATIONSs The Planning staff feels that the intersection of Atlanta and Beach' is valid as a community commercial area node and that the Land Use Element to the General Plan and zoning pattern should reflect this concept. Furthermore, staff feels that rezoning the subject property would create an undesirable zoning pattern by leaving an island of commercial land to the north of the subject rezoning. Therefore staff recommends that Zone Case 74-•1 be denied for the following reasons: 1. The request is in conflict with the Land Use Element to the General Flan which was shown to be valid through a staff re-analysis. 2 . Although the 'area is predently: overzoned for commercial use and some commercial land should be rezoned to another use, this is not the proper location to initiate such rezoning. Sec. 5 . 0 SUGGESTED ACTION: PurE�uant to the California Environmental �Quality Act squid the Huntington Beach Ordinance Code the Planning Commission crust find the Environmental Tmpact Report complete and %ccQ 'table prior to taking action on the zone change request.
