Directly south of the site is the large unincorporated "Bolsa Chica" area which is designated as a Planning Reserve on the General Plan and is currently used for oil extraction. The remaining surrounding properties to the north and northeast are predominantly zoned for and developed as single family residential units. 4. 0 ANALYSIS : The planning issue of . commercial versus residential land uses on the site has been succinctly discussed in the Amendment to the Phase I Land Use Element, adopted by the City Council in May of 1975 . The major concern to the staff was the relationship between the subject site and the remaining Bolsa Chica area and the fact that no master plan has been formulated which would allow an overall evaluation of the requested change. It was a particular concern, that deleting the commercial designation may be premature and an undesirable nodifi- cation of the City' s long range plans, especially when the potential revenues to the City from the retail uses were considered. However, it is the applicant' s contention that the site will not support commercial uses , and to support this contention had a market study prepared. The study concluded that the potential demand within the incorporated vicinity would not support a viable commercial center . Sufficient commercial demand would only result from development in the Bolsa Chica area, an occurrence that is not likely to happen for 15 4.--.0 20 years because of oil production limitations . At the Board of Zoning Adjustnents regular meeting of April 10 , 1974 the request for Division of Land No. 74-6 was approved. 2. 0 BACKGROUND INFORMATIOV The subject property has been zoned for commercial use wince 1962 . Prior to the C4 zoning, the property was zoned R4-X. In July of .1:963 , the Planning Commission initiated a proposal to rezone the easterly adjacent area located approximately 660 feet east of Beach Blvd. between'; Garfield and Ellis, Avenues . ( Refer to Zonq Case No. 368 map) The area, including the subject property, was confronted with street, sewer, water and drainage problems . It was the consensus of the Commission that a rezoning from R4-X and Rl to R3 would by a step towards establishing an improvement district. On August 6 , 1973, the Planning Commission adopted Resolution 368 recommending approval of Zone Case N7. 368 to the City Council with the further recommendation that the effecting ordinance not be adopted until a proposed improvement district is formed within the area . f , V� Staff Report Zone Case NO. 74-4 Page 2 XT. Robert R. Potter, the applicant, was at the August 61 1963 Planning Commisaion meeting. He has expressed to staff that it was his understanding that at the August 1963 meeting a general agreement was reached between the Commission and property owners regarding the above mentioned zone case. In essence, the applicant contends that property owners, west of the referred to zone case area , were assured that when the Assessment District was to be formed and street,, right-of-ways were to be dedicated these property�,owners would ,be furthered assured of an R3 zoning. Also, part of the general agreement was that the R3 zoning on the subject property and adjacent parcels would only be initiated when a division 'of properties was established. The applicant has indioated to staff that at that-time the Omatssion could not conceive of rezoning these properties fronting Beach Blvd. for residential use . Therefore , the intent being -that the division of properties would separate portions of said parcels for commercial use along Beach Blvd. and potential residential use fronting what now is precisely planned as Hoyt Lane . Shortly thereafter, in 1963 an assessment district identified as No. 6303 was proposed to improve the identified problem area. (Refer tc Assessment District No. 6303 map) The oubject property is located with the originally proposed assessment district . However, the project has not imprelemented due to problems of providing downstream drainage facilities . Consequently, Zane Case No. 36 R was tabled. In 1967, it was attempted again; ,to proceed with the Assessment District. However, when the Route 39 Huntington Beach Freeway proposed alignment was established, it was decided to postpone the proceedings due to the fact that the proposed alignment would pass through the assessment area. In between this short period, Zone Case No. 368 was again processed and adopted by the City Council in November of 1967. Thus , while the assessment district plans were withdrawn, the zone change was nonetheless implemented. More recently, a request for a change of zoning from C4 to R3 was submitted by Shardawn, Inc. in December of 1973. The Shardawn zone change ( ZC 73--27) was proposed for the same subject parcel and the parcel directly south of the subject property. However, the applicant withdrew his petition during the processing period of review by the Environmental Review Board. 1 1 Staff Report Zone Case No. 74-4 Page 3 3 .0 PRESENT LAND USE, ZONING AND GENERAL PLAN DESIGNATION The subject property is presently occupied by a horsestable facility and two glass houses (greenhouses) . Directly north of the subject property is an existing 8 unit apartment complex located on two C4 zoned parcels. The area east of the subject property is presently vacant and zoned R3 . A residential project (Classic Development, 'Inc. ) is presently under Construction and will ultimately encompass the vacant portion. Directly south and adjacent to the subject property is a vacant C4 zoned parcel. This parcel is located directly behind an existing commercial facility ;Sir Georges Restaurant) . West of the subject parcel is the applicant' s single family home and an existing commercial facility fronting Beach Blvd. In terms of the Land Use ,Element of the General Plan, the subject property and all the frontage property located approximately 660 , feet from the centerline of Beach Blvd. between Ellis and Constan- t:iner is designated for retail commercial use. 4 . 0 ANALYSIS In the analysis of ex'Isting land use conditions and proposed circulation, the potential for a commercial use on the subject property is unfavorable . Th,eprobab lity ,�that 't he subject parcel will -be developed for retail commercial is ,questionable. The fact that Hoyt, Lane is planned, to cul-de-sac .would present some circulation problems for a commercial use. In addition, a foreseeable problem with vehicular assessibility to the parcel as a commercial site would also hamper the, level of retail business, Any proposed na iercial structure would- be somewhat hidden and isolated from traffic generated along Beach Blvd. A residential zoning on the property offerer a good. alternative. However, ii , can be generally atated that as a result of residential development that (1) net gains in terms of cost and revenues would be less than retail commercial, (a) some population would be generated, (3) possible school age children would need to be facilitated. Nevertheleso, the underlying negative impacts as a result of residential development on the subject property would be minimal . Also, taken separately , a residential use on the subject property would not necessarily be a case of spot coning . 4(� As stated earlier, there presently exists an apartment complex directly north of the subbect property. Also, the alignment of Hoyt Lane would provide immediate access to the subject property as well as all the abutting parcels . Staff Report Zone Case No. 74-4 Page 4 Additionally, the proposed R3 zoning on the subject property would be compatible to the adjacent R3 residential district east of the subject property . 5. 0 CONCLUSION While , in fact, the proposed R3 zoning would riot be in conformance to the Land Use Element of the General Plan, the proposed residential zoning would provide a feasible alternative to some of the land use and circulation problems that may otherwise exist under its present commercial zoning. Based on an earlier request ( ZC 73-27) , the issue as to whether the R3 zone change should expand to include the south parcel fronting Constantine Drive would be looked upon favorably by the property owner. Generally, the positive factors as result of an R3 zoning on the subject property as well as the south parcel out weigh the negative underlining impacts and the unfavorable factors under the exisiLng Ca zoning . 6 . 0 RECOMMENDA':ION Since the proposed zone change is in conflict with the Land Use Element to the General Plan, it cannot be approved by the Planning Commission without subjecting the City to possible civic suit (Section 65 of the Government Code) . Staff feels the proposed zone change has merit however, and offers the following for the Planning Commission consideration: As, part of the Phase II of fort of the hand Use Element, the entire quarter section bound by Ellis, Newland, Garfield, and Beach, elvd. be reanalyzed and included in the Phase II Element particularly in :reference to the deletion of the Route 39 Freeway and strip commercial along Beach Blvd. rurthermore, Zone Case No. 74-4 should be continued pending adoption of the Phase li Element.
