Bad zone clianges are those that wor): a hardship on the Community generally or which result in an unnecessary hardship on the immediate neighbors . Good zone changes are those that benefit the Conununity generally and (under the best of circumstances ) either do not harm or , positively benefit the immediate neighborhood . M. J . Brock & Sons , Inc . the owner-applicant in this appeal , believes that its proposal will result in over.:ll gar: for the entire community and a positive benefit to the immediate ne-'*ghbuL hood . This position is based upon the Facts of the case : an unan'-icipated change of circumstances from the original C4 zoning , the present acono;mi.cs of site development , the immediate and long range needs of the community and the essential enviromental, benefits resulting from the proposed change . 1 . CHANGE Oi CIRCUMSTANICES : In the 20 year period from 1960 to 1980 , the total population of the City is anticipated to leap from 11 , 492 to 197 , 000 , most of which increase has already occurred . This stupendous and wholly un- anticipated development has and will. continue to Justify planning adjustments where the facts justi.iy them . 2 . ECONOMICS : (A subject not always welcome in a discussion of community p?anning) . The McConnell Economic Survey attached as Appendix D to the Westec EIR, clearly indicates the v-:ry high risks inherent in any commerri.al development in this already ccnunercia.11y o•rer-deve) ,_:ed area . The risks referred to are not those of the other- j developer alone ; the Survey indicates that over-c.orc►merial- ization can have a deleterious effect on the community-- at--large . . As a corollary , and one that should be noted at this point , the report by Ashley Economic Services , Inc . The Fiscal Imnact of Urban Growth referred to on page 46 of tie EIR , is a case study analysis which factually reflects the often quoted but prejudicial maxim that residential development is a drain on community resourczs . This report is commenced to you and your staff riot only for this applicatio;a but, for its informational value . 3 . ENVIROMENTAL BENEFITS : Of the 10 elements of enviromental `. . impact analyzed o`-n page 68 of the EIR, only 4 reflect a positive or Less negative effect from commercial develop- ment while all cf the remaining 6 impacts are positive in a residential development . Of these 4 , one relates to Revenues ( refute,l by the Ashley Report) , one relates to Solid Waste Disposal (and here the impact is merely less negative) and the last is natural gas service (but tFie"- Gas Co . has indil:ated that providing service to a residential development can be accomplished without an Ia significant impa,.t-see pages 51-51) . ON i _ _ 1 As a furthar benefit , M . J . Brock & Sons , Inc. does not plan to develop the property to its maximum allowable densit,..? (i .e. 15 Dwelling Units per acre) but will develop only 130 units on the site . (A density of 12 . 1 D .U . s/acre) . This of course results in greater open , recreational space , fewer automobiles and thus , less air pollution , traffic and/or congestion ar ' from a more immediate point of view, fewer children resulting ir; a lesser burden on local schools (From an anticipated 97 children 101 elementary , 16 High School ) to 65 children ( 53 elementary , 12 High School] ' ' Your favorable consideration of this zone change appeal which the applicant believes to be in the public interest ; will be appreciated . The rezoraing request will further extend the commercial zoning an additional 50 feet to ,the west which will provide for an overall commercial depth of 168 feet when combined witii the three separate existing parcels to the east. The specific site of whe request is located behind these existing commercial parcels and thug accesrs would be provided via Ronald Road . ' l These parcels to the east are presently under the ownersh`f' of the applicant and are developed with office buildings and a single family residence . (Refer to existing Land Use Map. ) These office uses could incorporate the subject site into a commercial expansion project or the residential parcel could be cleared and combined with the subject site to create an integrated commercial project. Analyzing the proposed site as an independent commecial property would indicate the following : 1. The site has limited arterial euposure . 2 . The site would be a non-conforming commercial property in that the minimum frontage in the C4 district fP 60 feet and the proposed site has 50 feet of frontage and thus the size and shape of the parcel may provide difficulty in attaining a desirable site layout. 3. As a commercial site , it would r�rovidd an additional buffer area for the existing residential uses to the west . To develop the site as presently zoned would place residential users within 118 feet of the State Highway# thnB subjecting them to high noise levels . 4.
