State Planning Law mandates that zoning shall be consistent with the Ci•ty ' s General Plan . 2. The subject areas are no longer suited for long range industrial development. " 3 . The proposed residential zoning will provide for more compatible land ::Qeis for the surrounding area. AYES : Geiger, Bazil , Higgins , Kerins , Finley, Slates , Porter NOES : None ABSENT : None PLANNING COMMISSION RECOMME14DATION: The Planning Commission recommends approval of Zone Change No. 75-3 "D" , a change from M2-0-CD to R2- O--CD. SUMMARY OF STAFF REPORT: Area "D" in located directly southeast, of the intersection:`cf seventeenth and Lake Streets . Included in the subject area is th6 Southern pacific Railroad right-of-way 'and a 261400 net equsre foot site presently occupied eZ ZONE CHANGE N0. 75-3 "D" Page 2 by three industrial structures. The existing structures have existed on the site many years and are in poor condition. This area has also been designated for Medium Density Residential use . The staff recommended that it be rezoned to R2-0-0O3 Medium Density R�sidential- Oil Suffix-Civic District . ENVIRONMENTAL STATUS : The proposed zone change is a lesser part of another project for which EIR No. 74-13 has been previously prepared and approved by the City Council on March 10 , 1975 . Staff recommended that the request be modified from R2-5 . 5 to R2-8 and be so approved . a PLANNING COMMISSION ACTION: ON MOTION BY FINLEY AND SFCOND 'BY PORTER ZONE CHANGE 75-2 WAS APPROVED AS REQUESTED, WITH THE FOLLOWING FINDING BY THE FOLLOWING VOTE : 1 . The Zone Change will bring the subject property into conformance with adjacent properties to the east . AYES : Geiger , Hazil , Kerins , Finley, Slates, Porter NOES : None ABSENT: Higgins SUMMARY OF STAFF REPORT: Tree applicant had been processing a tentative map under the Planned Development concept Lut then 'changed the development concept to single family homes . The Planned Development suffix does not permit single homes . The applicant has thus requested a change of zone to be able to proceed with the tentative map. V / 0 PAGE TWO The e+PPlicant ' e, request brings to light an inherent conflict between the zoning ordinance and Land Use Element to the City ' s General Plan . e That is the R2 district permits a density of 1 to 1�3 units per acre , whereas the General Plan .designates Medium Density with a range of 8-15 units---per acre. A strict inter retation would not permit develop- ment P P P ment of single .family homes at a density of less than 8 units per acre. However, modifying the rngmeet to R2-8 would provide a zonl&ng designation in conformance to the Ganeral Plan and processing of the tentative tract map. ADDITIONAL INFORMATION : The Planning Commission at its meeting of March 18 , 1975, after, con- siderable discussion of the issue of consistency, found that the appli- cant' s request would be 'consistent with the General Plan and that the change of zone would allow development of the property in conformance with surrounding properties . EMII RON+IENTAL STATUS . The Environmental Review, Board by minute , action at its meeting of March.-II , 1975 found .that the ,proposed change of zone, would be in accordance with the adopted Environmental Impact. Repo t No . 73-26 , and thus , no additional environmental documents were required .
